WASHINGTON (AP) — Two days before Thanksgiving the Senate had a 22-second session, a fleeting moment in the life of an occasionally droning body but plenty of time for majority Democrats to keep President Bush from making "recess" appointments.

Senators have been taking turns standing sentry duty this week — just to prevent Bush from circumventing the confirmation process by immediately installing people in federal posts while the chamber is in recess. Sen. Jim Webb, D-Va., who carried out that less than glamorous task Tuesday, is a relative newcomer, a low-ranking freshman and a senator who lives just minutes from the Capitol; he wielded his gavel before an empty chamber Tuesday, devoid of senators and even the young pages who serve as messengers.

"I'd much rather be doing this than allow the president to skirt the confirmation process in the Senate," Webb said in a statement. "This is an exercise in protecting the Constitution and our constitutional process."

The Senate must confirm major presidential appointments and judicial nominations, providing a constant source of confrontation between the White House and Senate Democrats. But when the Senate is off, as it is now for the Thanksgiving holiday, the president can make recess appointments that are not subject to confirmation hearings. These appointees can serve until the end of the congressional session, which at this point would be until Bush leaves office.

Among the more controversial recess appointments Bush has made have included John Bolton to be ambassador to the United Nations and Sam Fox, a GOP fundraiser and contributor to the Swift Boat Veterans for Truth during the 2004 presidential campaign, as ambassador to Belgium.

Showing the level of distrust between the White House and the Democrats, Majority Leader Harry Reid, D-Nev., announced that he would employ, apparently for the first time, what are called "pro forma" sessions as a tactic to technically keep the Senate on the job and stop recess appointments.

A pro forma session, during which no legislative business is conducted, satisfies the constitutional obligation that neither chamber can adjourn for more than three days without the consent of the other.

These pro forma sessions will continue throughout the current holiday recess.

Reid blamed the president for the move, saying the White House had been stalling on Democratic-recommended positions to several independent agencies. Agencies such as the Federal Communications Commission and the Nuclear Regulatory Commission are by law required to have Democratic representation.

Reid, in a floor speech, last week, said he would confirm various appointments if the administration would agree to move on Democratic appointments. "They would not make that commitment."

White House spokeswoman Emily Lawrimore said the Senate had failed to act on some 190 pending nominations, including key spots in the departments of Justice, Agriculture and Veterans Affairs. "If the Senate would provide fair hearings and votes the question of recession appointments would never be a topic of discussion."

According to the Senate historian's office, Bush has made 165 recess appointments, putting him fourth in recent history behind Ronald Reagan with 243, Harry Truman with 195 and Dwight Eisenhower with 193. Bill Clinton made 140 recess appointments.

Webb's office said Webb was leaving for a trip to Iraq next week, and several other Democrats with homes in the Washington area would take the role of single-handedly running the Senate, if only for a few seconds.

Wow, you have to give it to the Dems. They truly know how to legally "work" the system.

Recess Appointments are but one of the many powers given to the Executive Branch, and taking advantage of this option is not only legal but smart, too.

The Legislative Branch can't really even be accused of slight-of-hand, as they are also working within the confines of their powers as provided by the Constitution.

Keeping Congress "in session," even if the effort is merely window dressing designed to thwart the Executive Branch from exercising it's powers, is truly a brilliant move.

As a Conservative who does not share Congressional Democrats' stands on issues, I have to give credit where credit is due. Good show, indeed.

this is for jeff from jersey if you're still out there, I saw your reply post to mine and began to write a post where i carefully pointed out the many posts implying or expressing dismay at a seemingly unconstitutional (to a layperson) practice by President Bush, I was also going to point out the very clear implication of Senator Webb's own statement about protecting the constitution or some such political hyperbole, however i soon realized that none of this was necessary, you can read just as well as i can and you must have seen these statements and understood them in the context of the debate, so my only question for you then is this, why did you get so angry at my mentioning of a specific constitutional provision that vindicates the President's actions that you would stoop to using the caps lock key in your response,

If anything, it seems that the DEMOCRATS are the ones trampling on the Constitution - the Constitution allows for recess appointments, and, generally, this is a good example of a check/balance. The Senate gets to confirm nominees, but if they aren't doing their job (as they currently aren't), there's a way around it - recess appointments. Senator Webb is not protecting but abusing the Constitution.

Good for the Democrats. While recess appointments aren't necessarily UNconstitutional, Bush has abused the power by appointing radical ideologues to key positions by sidestepping congressional approval. For the delicate Republicans wallflowers out there who are clutching their pearls and wringing their lace hankies over Democratic "obstructionism", perhaps you should take a look at your side of the aisle. The Republicans have filibustered everything making it nearly impossible for any meaningful legislation to get through this term. It kind of makes me wish they HAD passed the "nuclear option" way back when, when the Democrats has THREATENED to filibuster. Oh wouldn't THAT be sweet. And if you want to know why this congress has low approval ratings, it is because the Democrats and independents are upset with the LACK of accountability for Bush and this administration, not because of it.

The President is supposed to make appointments with the advice and consent of the Senate. As Senator Reid has correctly pointed out, President Bush has refused to take that advice; Senator Reid is simply refusing to allow Bush to make recess appointments because Bush won't take the advice of the Senate.

In addition, the President does not have the authority to make recess appointments for vacancies that did not occur during the recess. The Constitution is quite plain: "The President shall have power to fill up all vacancies that may happen during the recess of the Senate…" If the vacancy exists already, the President doesn't have the authority to make the recess appointment. Kudos to Senator Reid for keeping the Senate in session to block this theft of Legislative power by the Executive branch; Democrat Presidents and Republican Presidents have both abused it, but it took a Democrat to figure out how to block it and to implement that block!

The Democrats haven't been filibustering. Rather, the Republicans have been using the threat of a filibuster an unprecedented number of times in order to force the supermajority vote needed to cutoff a GOP filibuster. Normally, a simple majority is needed to pass a bill, but if that were to happen, (a) some work might get done, and (b) the Democrats would win the vote.

I'm not sure where you get the idea that it's Democrats getting nothing done, since it's been the Republicans abusing this technique. They're filibustering at a rate three times the norm and they've gone as far as to admit that obstruction is their new favorite tactic.

There are people here complaining about the Senate doing nothing. They're mistaken.

The Senate is trying to do something. The only problem is that King George will veto anything they pass for the good of our country. The only thing Bush cares to sign are bills to have more of our tax dollars poured into the black hole he created in Iraq.

The President should be allowed to make appointments during a recess when the process is congested with pointless politics. Ask yourselves these questions? Does the President have the right to make recess appointments (YES)? Does the President have the right to present appointments to the Senate for confirmation (YES)? Has the President received an Up or Down vote from the Senate on these appointments (NO)? What is the appropriate course of action? Do we not fill the positions or do we wait for the Senate to actually do something instead of delay, delay, delay, delay…. it would be one thing if the President did not provide appointment candidates and the surprised everyone with recess appointments… but work in this country needs to go on, even if the Senate work goes undone…

Good for the Democrats! Reid tried to make a deal with the President and Bush refused, so drastic measures may be called for. Bush is refusing to make appointments to three panels that by law have to have Democratic appointees so why is the President dragging his feet?
I remember watching Republicans and also reading about it, that when Clinton made a recess appointment of an Ambassordship, Republicans threatened to never confirm another judicial appointee he put forth for the rest of his term if he ever made a recess appointee again without the republicans okay.

The President is to appoint nominees, and the Congress is to vote on them up or down. They refuse to act in what is their express duty. They have the majority in the Senate (the two indies lean their way), so why are they afraid of votiing on the nominees? If they pass, it would be by a majority of the nations Senators, or get his, representatives of the people. So they stall, stall, stall, in the mean time these posts stay vacant, and the jobs that are suppose to be getting accomplished are not. If a majority of the Senators elected by the people vote for them to serve, so be it. It the majority votes against, so be it too. Then we can have others a nominated. I wonder what you would have said if Pres. Bush fired all of the U.S. Attorney's.

For the historically challenged: Bush DID FIRE ALL of the prosecutors when he took office. Republicans NEVER mention that FACT.

Bush has now made 20 more recess appointments in 6 years than Clinton did in 8 years. In addition, Bush's fellow Republican Ronald Reagan made 100 MORE appointments than Clinton.

We need to get rid of the recess appointments or modify the rules, but one party has obviously taken more advantage than the other.

The things Bill Clinton did in office didn't ruin the economy, isolate the middle class, kill thousands and wound 10's of thousands of Americans. I’d bet my last dollar there were 10,000 military(home of records VA) serving overseas, who would have changed the out-come of that Senate race, had their votes been recorded. For those who don’t understand the “Military-Way” : Sometimes when your caught up in the middle of a WAR and your hunting the enemy, trying to avoid hostile fire , things like “absentee ballots” take a back-seat to survival in a combat zone. I'm no Republican and i'm no fan of Bush but jeez, you folks that want Bush impeached obviously haven't read that section of the Constitution very well. There are specific guidelines regarding what violations a President must commit before he's allowed to be impeached and technically, there's nothing to prove that he violated any of those guidelines. As much as yall want him impeached, it just can't happen, legally that is, and until anything can be proven, impeachment would be unlawful.

One wonders how the great country called America became great and continues to be great with silliness such as this. Arent some of these appointments required to keep the business of government and law moving forward.

Pelosi promised a new government but this looks just like the old government. Instead of an elephant (republican) we have an ass (donkey) (democrat).

I am not saying that Bush is great - far from it. But this 22 second session is just being silly and immature. games will not make our country great again and competitive.

I don't see how this prevents President Bush from "circumventing the Constitution." A recess appointment doesn't circumvent the Consitution at all — it's written in black and white in Article II, Section 2.

As for the Democrats having guts, why don't they actually stand up to the President on the war funding if that is what they truly believe? The answer is they are just too plain scared of the political repercussions.

It seems that to the Democratic controlled congress, this is all just a game. While the President has taken extreme measures to ensure that all Ameicans are protected from radial terrorists, at home and abroad, the Democrats appear to be protecting Americans from the President! It's no wonder they'll go down in history as the do-nothing congress, playing their little games, while the country is at war with fanatics that want to hurt the American way of life by any means and any way they can. No one was begruding Bush's right to fire and hire U.S. asst. AGs at the START of a term. Every president does that as they do with the cabinet posts, etc. What peopkle were upset about, my dear Repugnantcan pukes, is that Bush did it for no reason other than the attorneys were acting independent and weren't taking orders from Rove, Cheney and that sorry sack Gonzo. They were fired for political reasons…nothing more.

The article might have more impact if there was a list of positions the president planned to fill via "recess appointments." Did he plan to appoint 10 people? 0 people? As far as I can tell, this act by the senators appears to be a waste of time. Not surprising considering the nature of Congress.
