California's Supreme Court ruled Thursday that the state's ban on same-sex marriage is unconstitutional.

WASHINGTON (CNN) - In a much-anticipated ruling issued Thursday, the California Supreme Court struck down the state's ban on same-sex marriage as unconstitutional.

Several gay and lesbian couples, along with the city of San Francisco and gay rights groups, sued to overturn state laws allowing only marriages between a man and a woman.

"There can be no doubt that extending the designation of marriage to same-sex couples, rather than denying it to all couples, is the equal protection remedy that is most consistent with our state's general legislative policy and preference," said the 120-page ruling.

California just moved up a notch on the human rights scale.

A sad day in America.

for the good of the democratic party   May 15th, 2008 3:45 pm ET

keep them coming...i think this qualifies as a flood...about 40 superdelegates in 9 days...wow

Clinton supporters keeping bad-mouthing superdelegates....it shows how mean spirited they really are. I wish they would realize that Obama won't be denied. Instead of being gracious and recognizing that, they are prepared to take this to the convention and that is unacceptable. We as democrats should start aiming are fire at John McBush. If we do that, the democrats will take the white house in an unprecedented fashion. I have no doubt that It will be a Reagan type victory where we win an astounding victory. So democrats unite

say NO to failed bush policies on IRAQ
say NO to failed bush policies on ECONOMY
say NO to failed bush policies on HEALTHCARE
say NO to failed bush policies on EDUCATION
say NO to failed bush policies on ENVIRONMENT

TRUE democrats will unite around Obama due to the MAJOR policy differences between Mccain. Democrats who don't are the scum of society and shouldn't be considered true democrats anyway.

This is an outrageous decision by the court! It's going to lead to profound moral decadence in a country that says: "In God we Trust"

JRO   May 15th, 2008 3:43 pm ET

It's about time that California allow loving same sex couples to marry. Any state that decides to follow their fair minded ways should also do so. Gay couples are denied basic rights daily in this country, and must live with the constant threat that everything they own and have worked for could be taken away because they "aren't married." Same sex marriage should stay a state-level matter, and the President and Supreme Court should stay out of it. In a country where citizens are free to practice whatever religion they choose, biblical scripture should also stay out of the debate.

We are people, too... who deserve the right to protect ourselves, our loved ones, and our families. When my partner had 6 hours of emergency surgery this Spring to remove a tumor on her ear drum, I was denied entrance into the recovery room and was told I "wasn't family." Let any opponent of same sex marriage go through a similar situation, and we'll see how quickly their attitudes change.

MD Houston   May 15th, 2008 3:43 pm ET

Once again, a court is overruling elected representatives who should be carrying out the will of the people they represent.

Yolanda   May 15th, 2008 3:38 pm ET

In my humble opinion Holy Matrimony is different than a civil marriage. One is a function of the church and is sacred and the other is a function of the secular state. The state cannot discriminate against its citizens without violating their civil rights. Separation of Church and State forever!! This is my belief and I do not care if I get excommunicated blah blah blah. Good for you California!

God Job Cali...Thats why I love California!!

Ron L   May 15th, 2008 3:29 pm ET

I can understand some people having a major problem with this. I have to admit I don't particularily care watching men kiss men or women kiss women. My problem comes from ANYONE trying to convince me that it is normal or an alternative life style. NORMAL by definition is something done by the vast majority. I am not calling it perverted or any other negative term, it is what is, just don't tell me it is normal.
Also I have no desire to see gay couples on TV to the point that you think 50% of the population is that way when it is closer to 10 to 15%. Other than that I REALLY don't care.

By the way..THE BIGGEST THREAT TO MARRIAGE IS THE 50% DIVORCE RATE. We need to focus on that a heck of a lot more than this.

Ennis, LA   May 15th, 2008 3:28 pm ET

Dr. Truth, Boston   May 15th, 2008 3:16 pm ET

This is not judicial activism. This is enforcement of the law! Equal protection for all. Bravo California.

Lets face it – gay marriage is a purely invented issue used by right wing fringe to make us feel included as straight people and thereby make us feel better about ourselves. Gay marriage has never produced a problem and never will. It has never turned a staight person gay and never will. This is a fact. Its more a non-issue than an issue.

Jason   May 15th, 2008 3:16 pm ET

You gooooo Joe!! It is about time more people with some clout started saying what most of the country-world think and feel! Bush should have been impeached a long time ago! He has been a war mongrel since he took office.I don't know how he sleeps at night. He has made such a mess of things, it will take years to fix! He actually acts as if he is not ashamed of the legacy he will leave, going down as the WORST president in all of history! Wonder what his grandchildren will think and all his generations from here on when they read about him in the history books! I can't wait till he goes and hides in his hole in Texas.

Hillary or McCain   May 15th, 2008 3:00 pm ET

Good for you California! Gay and lesbian couples should have the same rights and protection under the law as heterosexual couples do.

DJ, LA, CA   May 15th, 2008 2:59 pm ET

Oh that's just great. Here we go again with a fresh round of divisive wedge issues to distract us.

Just a matter of time before the GOP launches fresh attack ads accusing the Democrats of promoting or even encouraging Gay marriage. Or worse scaring voters into thinking that liberals advocate gay lifestyle.

alexis   May 15th, 2008 2:58 pm ET

As a lesbian in California, I am so happy that justice and equality rule the day. I have been with my partner for 16 years and we look forward to getting married.

jonny   May 15th, 2008 2:57 pm ET

finally. this is no different than womens right to vote, or equality of african americans. the religions views of a group of people should not be legally enforced on the whole population.

ShameonCalifornia   May 15th, 2008 2:56 pm ET

Why does this minority group have so much influence? Follow the money. Why do people choose to push their lifestyles on every one. Why should my children see two men and two women. This is not normal behavior. What if a man wants to marry his sister, we must to make this odd couple happy? A man wants to wed a little girl that he says loves him and he loves her, should we allow them to wed too? What is this country coming to?

Kirsten   May 15th, 2008 2:54 pm ET

LOVE TRUMPS BIGOTRY!
California is ahead of the game as usual.

Terry in Fl   May 15th, 2008 2:53 pm ET

We all have a right to love who we want. Thank you Cali Supreme Court for doing the right thing. I wish the nation would learn a thing or two about protecting it's citizens rights. EVERY single person in a relationship with another, regardless of sex, should be protected!

Tired of W, OH   May 15th, 2008 2:47 pm ET

Why not? Why should straight couples keep all the misery to themselves.

Dems Unite to Save our Nation   May 15th, 2008 2:47 pm ET

Good. Tired of church and state mixing. Marriage should be open to anyone who wants to get married.

Politico   May 15th, 2008 2:47 pm ET

As a Californian, I'm proud of my state! I simply don't buy the argument that allowing same-sex marriages weakens traditional marriages. As a married woman (heterosexual union), I don't feel like my union is worth any less because same sex couples are being granted the same freedoms. Anyone who feels that same sex marriages degrade family values likely doesn't live in an area where families built by same sex couples are prominent.

Jeanne   May 15th, 2008 2:45 pm ET

I am so happy. This will hopefully pave the way to give same-sex couples & families the same legal rights & opportunities as heterosexual couples & families. In my opinion, this is a legal matter & not a religious matter. Same-sex families should have equal rights & protection under the law.

Sidney C   May 15th, 2008 2:45 pm ET

Let them get married for pete sakes, they have the right to be as miserable as the rest of us.

David   May 15th, 2008 2:45 pm ET

there will be a price that none of us will want to pay for this. all we can do now is hope this goes to the US supreme court so this silliness will stop. this is not the ruling of the people. time and again has been shown that the majority is against this but a handful of judges do not speak for us. they will answer for it, too.

Karl Rove   May 15th, 2008 2:45 pm ET

GOOD...it should be banned all across the U.S.

Rachel   May 15th, 2008 2:44 pm ET

That is excellent news. I never understood the ban in the first place. It's not like gay people stop being gay... now we're just helping them feel like complete human beings!
