(CNN) — Georgia must allow thousands of people whose citizenship was questioned by the state's new voter verification system to vote in the upcoming election, a panel of federal judges ruled Monday.

The court ruling will affect about 4,500 people in Georgia who had been "flagged" by the new voter verification system and faced being denied a chance to vote Nov. 4 because their citizenship was questioned.

It could also affect more than 50,000 other registered Georgia voters also flagged by the new system because of mismatches in their personal identification information, such as discrepancies in addresses.

The three-judge panel also ordered Georgia Secretary of State Karen Handel to inform all the flagged voters that they can vote.

"We are very pleased that the court agreed with our legal position that the state violated the Voting Rights Act," said Elise Shore, a lawyer with one of the civil right groups who brought the lawsuit.

Shore said the ruling applies to the 4,500 Georgians that were flagged for citizenship reasons and she was uncertain whether it applied to the some 50,000 others that were flagged for other reasons.

The issue was raised in a lawsuit filed on behalf of a Georgia college student who claimed that the secretary of state's voter verification system violated the Voting Rights Act and the National Voter Registration Act and caused an illegal purge of voters in the weeks before the election.

Federal law prohibits widespread voter purges within 90 days of the election. In Georgia, that has become a heated issue with some calling the purge "voter suppression."

Handel, a Republican who began working on purging voter rolls from the time of her election in 2006, said the act of verifying voters is not voter suppression.

"I'm grateful for the District Court panel's decision which reinforces the state's voter registration verification procedures," Handel said in a statement. " It is unfortunate that the plaintiffs filed suit to halt this federally required process."

This is going on in all or most of the toss-up states where republican state attorney generals are systematically trying to remove mainly democrats and especially minority voters – I am very happy there is at least one story here. It would be great if we could see an investigative report on this actual voter suppression – verses the continued hysteria over ACORN where none of the bad registrations would even lead to one fraudulent vote yet Lou Dobbs shrieks daily about ACORN, ACORN…. the sky is falling!

I lived and voted in Ga. back in 2004, I felt hopeless back then being one of the few in that state to vote for Kerry and even now living in South Carolina is kind of the same way but at least I got the chance to vote.

I love how Republicans complain about voter registration fraud, like Mickey Mouse is going to vote on Nov. 4th, when if you really think about it, if the economy wasn't so bad those ACORN people wouldn't have had to make up new voters to keep their crappy jobs in the first place. This on the other hand, when American citizens aren't allowed to vote because of a systematic attack to keep a dying political group (republicans) in office is just awful and makes me sick thinking about it.

Just remember Obama/Biden folks, get out and vote even if you don't think your vote will count in your state, you never know and at least you will be showing your support instead of letting more of this crap happen for 4 more years.

As a WASP Georgian, I am so pleased to see this. Not since Lester Maddox has Georgia be run by segregationist. The Georgia Republican Party began with the Julian Bond delegation being seated by the Democratic Convention instead of the segregation delegation. That delegation returned home to become Republicans. Interesting to note as well, that this article is titled "flagged" which is what the Republicans with the help of the Sons of Confederate Veterans did to former Governor Roy Barnes who removed the Confederate Flag from the state flag. Barack Obama has credibility and charisma, charm and common sense. He is the kind of person the USA needs at this time, a fine example the rest of the world can relate to: a capable leader with clear ideas for the future. Colin Powell was right!
By contrast, McCain and Palin fall far short of the standards a major democracy should be setting for the rest of the world. I am especially alarmed at the divisive tone of their campaign rallies. Hatemongering does not engender unity and hope, only fear and loathing. The only thing that could possibly save them is election fraud, voter suppression (which already looks to be happening in some places) and a few clever tricks by their equally sly friends in the White House (check out the war games being played out in Syria and Pakistan right now).
Hopefully a majority of the US electorate will come to their senses this time!

Well, when are we going to address what's going on in Wisconsin and Colorado??? In Wisconsin, an Attorney General and Republican state honorary co chairman of McCain's election campaign, is filing another lawsuit against the State Election Committee because he believes that people are voting illegally but this has not been substantiated. This seems a bit fishy seeing that he had GOP lawyers in his office recently and when asked if they asked him to file the lawsuit, he said "No, but they may have told some of my lawyers to." Isn't that the same thing as saying yes?!? Colorado's Secretary of State, Michael Coffman purged 30,000 voters illegally from voter rolls. Coffman's office believes that he hasn't done anything wrong and believes that it was "only" 14,000 voters that we purged. Does this make his wrong-doing any better??? Why is it that Republicans seem to be the only politicians behind this voter suppression in key battleground states?!? Luckily courts are allowing formerly purged voters in Georgia to vote. They were also told by their Republican Secretary of State that they weren't allowed to vote for various bogus reasons such as they weren't US citizens.

I am a georgia voter an I waited in line from 10:25am to 6pm to vote today. It was a very diverse group in the huge line. I'm black but the people who where around me were white, we never spoke about who we were voting for or anything political. One person I discovered worked with my father years ago, an older couple told me that their son an I attend the same church, and the woman next to me was a patient at my practice recently. My point is regardless of who we voted for, we all stood as proud Americans. Regardless of race, gender,age, or party we appreciated each others company and love for this great country.

It is an abomination that they violated the Voting Rights Act, a landmark piece of legislation of the 1960s, achieved only after unspeakable atrocities had been committed, and that reaffirmed the right of all African-Americans to vote, despite the attempts by Klan-loving, ax-handle-wielding, poll-tax-promulgating bigots to deny the rights which were supposed to have been guaranteed by the Fifteenth, and supplemented by the Nineteenth, Amendment to the Constitution. Karen Handel is a disgrace to Georgia and to the fair and democratic ideals our country was founded upon. For those of you who don't know, it is rumored she is planning a run for the governorship in the coming years and the only way she can ensure that happens is by keeping her party in power by all means necessary. That is why she is reverting to these underhanded and illegal tactics and robbing eligible voters of their right to vote. While she may have lost this lawsuit, I am not sure what desperate means she will go to to ensure that her personal mission becomes a success. She has already filed a lawsuit against to remove Jim Martin (D) who is running for the Senate from the ballot, even after early voting has already begun. As you can tell, this is a selfish and conniving woman in our midst. I fear for the future of my state with someone like her in power.

This is a pretty brazen attempt at voter suppression.

It is unfortunate that the defendants even tried to suppress this federally protected right to vote in the first place, however not particularly surprising. There is a reason that this is supposed to happen at least 90 days before the election. You are supposed to be able to have ample time to get it straightened out so you can participate in the election. Easier for the already registered and eligible but rejected voter, easier for the administrative people to deal with the new registrations that always pour in LESS than 90 days before the election. Not only is this clearly an attempt to suppress the vote, its also an indication that some of the legally legitimate processes we use here are broken anyway, as this computer purging program shouldn't be flagging so many people who are clearly eligible to vote in the first place.

Thank God that people have finally started to realize that the Republicans have been suppressing votes for years. This is, by and large, a group of people who cannot stand to see the status quo shaken up. I understand the corporate fat cats and wealthy not wanting to say goodbye to their meal ticket, but I have never understood the blue collar, uneducated mindset of people who vote Republican despite it being against their best interests.

Once a upon a time in our history this could be directly proportional to that false wisdom of "POLE TAX". Behind that wisdom was racism. At least we again found equality at the federal level. Voter rolls need to be purged of ineligible voters. However, that needed to be done months ago, giving flagged voters plenty of time to remedy the situation. Obama No Doubt!, there is no physical connection, nor should there be, between a voter and his or her vote. There is no way void a voter's ballot after the election. At least that is the case here in Iowa; I don't know what insane system your state may use. And there is no republican conspiracy to suppress voter turnout.

The Republicans lose again. I tried to early vote in an Atlanta suburb in Gwinnett county today, and gave up after almost a 6 hour wait. This was definitely designed to discourage voters in this neighborhood where Obama is popular.

Isn't Handel a lawyer? She's apparently not a very good one as she doesn't understand the law or the decision. She says "I'm grateful for the District Court panel's decision…" Well, too bad the decision doesn't allow the Secretary of State to be incarcerated. She says she's "grateful"; if she were locked up so she couldn't screw around with the election process, a lot more people would be "happy".

The court system worked on the side of the people against the republican machination to win at all cost which includes compromising the democratic principles of rule by the people. I am disappointed and dismayed by the blatant display of power of the aristocratic rule by them. Of course they would argue that they are protecting the citizens by limiting the invasion of those who are not eligible to participate in the democratic process of election.

May be the repugs need to spend money on limiting and supervising their own politicians from engaging in illicit activities like the two convicts from Alaska.

I'm relieved that the courts got it right this time. We don't want to have a repeat of what happened in Florida in 2000 and Ohio in 2004. It sickens me how Republicans are constantly trying to suppress the vote. To me, there is nothing more "Un-American" than corrupting the democratic election process.

I guess I must really be missing something. I am surprised that the process of voter verification and authentication appears to be an event that occurs shortly before an election. It would seem to make more sence for that to be an on-going process with notices being sent to questionable voters at a specific time each year. Surely that would avoid these 11th hour nightmares.

Now before you vote make sure you check all the facts and you will find some extreme corruption in Alaska.Palin has made a diaster by abusing her power and ethics in the Alaska Pipeline project.Do some research and you will find she is indeed not part of doing the right thing,and the opposite of a reformer on this so called independent energy project.She broke ethics law on the negotiations for bidding in a very big way.She is slated to be VP and runs on reform, and mavericking and is the complete opposite.Look out and beware

It's great that the Feds put the hammer down on Georgia. If Georgia had a problem with these voters being ineligible, they should have raised the issue more than 90 days before the election. That way, any questions about their citizenship could be thoroughly investigated. Raising these issues weeks (now only 1 week) before the election is ridiculous. These tactics are typical of Republicans in hopes of supressing voter turnout, especially amongst the disenfranchised and minorities. If it does turn out that these voters were not citizens, then their votes can be voided after the election. If they aren't allowed to vote and it turns out that they were citizens, they will have been denied their fundamental right to vote for no reason.

Voter verification stories such as this led me to check my own identification cards for accuracy. Everyone should do the same immediately. I found the street name on my I.D. misspelled and was able to have the error corrected. Having a voice in this election is far too important to take a chance of being denied the right to vote because of a clerical error.

Let your voices be heard — it doesn't matter who registered you (ACORN, Campaign GOTV, or if you did it yourself) – if you are legal you are legal — period.

To those who think Obama is here because of the black support:
In case you haven't noticed but blacks only make up for 17% of the voting population and history has shown that about 12% vote Democrat during a general election. With that being said, the Democratic nominee is guaranteed about 12% of the electorate votes. The reason why I say 12% because Bush got 5% of the black vote in 2004 and almost 3% in 2000. Anyway, Obama is where he is at because of the support of AMERICANS who want change…black, white, asian, hispanic, rich, poor, handicap, young, and old.
