WASHINGTON (CNN) - The Justice Department will deploy more than 800 federal observers and monitors to voting sites in 23 states to make sure voters' federal rights are not violated on election day.

While many of the problems that may occur in what is expected to be a record turnout next Tuesday will come under the purview of state and local officials since they have the primary responsibility for running elections, the federal government is responsible for making sure federal laws are not violated. The primary law in question is the Voting Rights Act, which bans intimidation based on race, color, or religion. The department will also investigate and prosecute cases of voter fraud.

Unlike in years past, the Justice Department announced last month it will not use any criminal prosecutors to monitor elections to allay concerns of some voting rights advocates including them would discourage some from voting.

The observers will come from the Office of Personnel Management while the monitors will be Justice Department employees. Usually the destinations chosen are ones where claims of discrimination have occurred in the past or where there are current allegations.

Attorney General Michael Mukasey said the goal of those monitors and observers is to make sure "all Americans who are entitled to vote are able to do so" and also said "The Department of Justice will do all it can to help ensure that elections run as smoothly as possible – and, equally important, that the American people have confidence in our electoral process."

Besides the monitoring effort, staff members of the Justice Department's civil rights division will be manning a toll-free number (1-800-253-3931) where voters can report complaints related to free and fair ballot access as well as investigating incidents reported through DOJ's website. There will be special efforts in all 94 U.S. attorney offices across the nation to deal with any
reports of either voter intimidation or fraud.

The Justice Department monitors will be in 29 jurisdictions, including some that have seen past problems concerning voter access: Duval, Hillsborough and Seminole Counties, Florida; Jefferson and Orleans Parishes, Louisiana; Cuyahoga County, Ohio; Philadelphia, Pennsylvania as well as ones in Arizona, California, Indiana, Kansas, Michigan, Mississippi, NOrth Carolina, New Jersey,
South Carolina, South Dakota, Texas, Virginia and Washington state.

Observers are usually sent to areas that have been determined by a federal court or the Attorney General to need such action. They will be positioned in precincts in Alabama, Arizona, Illinois, Louisiana, Massachusetts, Mississippi, New Jersey, New Mexico, New York, South Dakota and Texas.

Civil rights advocates have called on the Justice Department to be aggressive in its efforts to protect the rights of voters. Almost 40 representatives of various groups met with the Attorney General and other DOJ representatives last month.

One specific area where the Justice Department says it is prepared to act is concerning identification laws. While the Supreme Court ruled Indiana's photo id law is constitutional, officials also say the civil rights division will act if individuals report such a measure is being applied to them in an illegal or discriminatory way.

Just watched a documentary called "uncounted". It sends chills up your spine. Everyone needs to vote, and every vote needs to be counted. Elections appear to have been "fixed" in the recent past, for the sake of Democracy, this one had better be an honest one. I don't think the voting public will stand for shenanigans this time.

For McCain to win he only needs to do four things:

1. Replace Palin with C. Rice.

2. Go on National TV and admit his negative campaign was wrong for the country and wrong for the Republican party.

3. Go ahead and copy the rest of Obama's programs as his own, not just the ones he has already stolen and claimed.

4. Visit every state not looking to go staunchly Red already and lay out real programs instead of just telling us he has ideas and he will tell us about them after the election.

In reality, he will still lose the election, but he will at least appear to have some trace of dignity and self-pride. Something sadly lacking in his campaign this year.

i hope these justice dept. observers are fair, honest and impartial. i seem to recall there being some problems with people from the justice department being fired for political reasons and the attorney general had to resign. but if it's a bunch of Bush appointees observing then they should ne called injustice observers.

Voter intimidation is a serious problem in some places and it's great to see DOJ stepping up to the plate to do something about it. However this still won't prevent folks from tampering with voting machines to change the outcome.

After this election I hope Congress will enact uniform standards for federal elections to restore public confidence in the process.

In Nevada I voted for Obama and it kept switching to Mccain. I had to ask the representative why my vote kept switching to Mccain and she said because it's a battle ground state. After about the fourth try it finally sticked...I hope.

I hope they do. During a conversation this morning with the local Board of Elections, I was told that a soldier in uniform was told they were unable to vote while wearing a uniform by a campaigner outside the polls.

Last night while early voting, I heard one campaigner call to someone in line "you know who to vote for, right? Heck, vote 3 times!"

Finally, a partisan "ride to the polls" vehicle parked 2 feet from the line of people waiting to vote, covered in their candidate's name. Two of those inside were handicapped (we have curbside voting for the handicapped here) and completed their ballots with the partisan campaign employee inside.

Yeah, in all of these cases it was Democratic campaigners. Both sides are out to do whatever it takes to win this election.

How can you defend democracy when you don't HAVE democracy? End electronic voting...it's a travesty (don't even get me started on hanging chads!) Simple handwritten ballots have been defending democracies for 2000 years and as a Canadian, I voted federally in 3 minutes using a paper ballot. The GOP has got America coming and going. Like Joe the Stalin said: "It's not who votes that matters, it's who COUNTS the votes" Thank Diebold for helping Bush steal the 2004 election with a bunch of fishy returns that defied exit polls in tight states. Thank you CNN for finally waking up to the fact that ALL U.S. elections need a vigilent media watchdog. I hope it'll be enough. A close election can be stolen very easily and the GOP is well familiar with Karl Rove's playbook and entrenched system for pulling out votes. Wow, Bush League Justice out to save our election process.

Well, West Virginia is already in the Republican bucket thanks to their computers choosing their pick for president by automatically switching votes from Obama to McCain and from Dem to Rep all the way down the ticket.

The RNC in Michigan has already tried to get those that have been foreclosed on from voting.

Virginia spread flyers saying that if you are voting Democrat show up on November 5th.

The RNC in Florida is upset with their Governor for expanding the early voting poll hours.

So I suspect that the 800 "Monitors" will be dispatched to Democratic leaning counties in battleground states and Pennsylvania.

Bush has not done anything helpful for this country in 8 years, Why would we think he would start now?

As the Republicans create a smoke screen by espousing that Acorn was out to commit voter fraud, they act to suppress the vote. All Acorn did was register voters, no one, with any knowledge of the situation or a even half a brain really thinks that the fraudulent voter registration forms could realistically translate into voter fraud. What else are they up to?

If this election proves to be rigged, then some one needs to hang for it. Eight years ago, the election was stolen and the absence of accountability has left a pervasive attitude that such corruption would go unpunished. Now with electronic voting it would be just too easy to adjust the screen to have the voter select the wrong candidate or just later flip a bit to change a vote.

This is does not bode well. On the surface one would think the FBI providing monitoring would make us feel better, but seeing how the Bush Administration has done everything in its power to undermine our confidence in their truthfulness – and proven its ability to ideologically distort the missions of its agencies – this is frankly the scariest thing I've heard all election season.

We'd better hope that Obama wins by a landslide so that any effort to "defraud" the election in favor of McCain can be quelled. The inane confidence of McCain and his campaign aids today, combined with this announcement, makes me wonder if he really isn’t inane, and perhaps just a tad bit too giddy that he now gets to drive the criminal get-away car that Bush ran him over with in 2000.

If this turns out to be a nationwide Florida – brace yourselves – the wheels are going to come off and there is going to be some serious civil unrest.

people need to remember that the votes were not suppressed by direct means, but by subtle ones.
Poor neighborhoods being covered in lying flyers. The poor neighborhoods have far too few machines, so that hourly workers, who cannot wait in long lines for fear of losing their jobs and wages, do NOT get the chance to vote. It isn't that they don't care, it is that they simply cannot risk the financial loss. Please everyone be vigilant, let your employees have some extra time, be nice to your poll workers, and if you can, vote in the middle of the day so that lines are shorter in the morning and evening.

Wish they'd send some to Colorado. Colorado Sec of State Mike Coffman lost a lawsuit and has to let thousands vote who were removed from the voter rolls. YET, thousands are still being removed on a daily basis. AND he is running for office himself! Talk about the fox watching the hen-house. SOMETHING needs to be done here in Colorado. To have people monitoring the polls to make sure there is no voting fraud or voter intimidation, especially in America, makes people like myself wonder what has happen to the American Democratic Process. My God, why is this happening in the USA, the oldest democratic country in the world. We here in Canada take pride in our election process. The polls do not need to be monitored by the feds or justice department. Each poll is maintained by election Canada employees who take their job seriously and make sure all rules are followed. I know. I work for Elections Canada. Maybe the USA federal government should ask Canada on how to run their election process for them. Right now all I can say is the since the republicans have been in power since 2000, they have made a joke out of your election process

That should have been done during this early voting stage and the justice dept should have watchdogs at every polling station. so that every voter gets a vote and to make sure that the vote isn't switched, lost or torn up. I believe the electronic machines are the real scam. The state of California refused to use electronice voting machines. They found that the votes were not counted correctly and can be changed. There have been several lawsuits against these voting machine, I can't understand why they are still being used.

Considering what Bush did to the justice department, this doesn't make me feel better. Will the monitors be the political hacks from that third rate law school Bush put in under his religious initiatives? So now justice is no longer blind. And, just remember something like 23 states don't require a paper trail, so you can't recapture the votes. If the machine was hacked to send a percentage of the votes over to the repub side, there won't be any way to find out. If they steal votes, we won't know. That's what's so scary about this election. All those electronic voting machines need to be replaced with paper ballots. Then, there can be accuracy and accountability. Just go vote no matter what. Don't listen to the polls, if you want Obama to win, you must vote, don't become complacent. It's not over yet!!! Go O & Joe!

It is critical to preserve the people's right to vote freely and from intimidation by any party.

The electoral aparatus need be fixed and made easier to understand to avaid mistake as those that have been already reported. In some cases the people choose to vote for a candidate and some machines bumped them to another candidate automatically, I think this needs to be looked into to fix any defect.

Hello, I'm from Brazil and just recently we had a major election down here, all the cities renewed or re-elected its mayors and councilemen/women.
It was a clean process, because not only each party had its own observers but also there were independent and electoral ones working that day as well. That way the electoral authorities reported many cases of vote fraud that were discovered and neutralized.
In ALL elections we have we hear stories about 'that candidate from that state' dirty and dishonest tactics to get elected, because they are reported by either a party's observer, and independent one or an oficial (electoral authority) one. That's their job and so far they've done it right.
Which is good because in all elections there are those who like to cheat.

I am happy to hear that the justice dept is going to try to prevent problems with the AMERICAN people's right to vote. How sad is it that this has to be?? I don't understand how either party could condone having people interfere with the voting process. Well lets hope so, I heard on the news that people are telling that they moved the voting from the 4th to the 5th...Fraud and dishonesty...
I am hoping that is not going to be another 2000 and 2004...if I am told that I cannot vote I will be very p-ssed off...I may have never voted before, because I could not trust the Government. I just could not take another 4 years of the Republicans. Even though the Democrats have made some blunders,(re-Jimmy Carter)

Lets make our votes count,

this is the beauty of our Democracy, we do have a choice...

Luckily, ACORN has been able to do what it can up to this point for Obama. Campaign financing needs to be further reviewed in the Obama camp. If Obama is going to help all the poor people (95%) that he so claims...where did the money come from? And if only "rich" people (5%) are voting for McCain, why is this race so close? Shouldn't the poll #'s be 5 times larger for Obama? Let me guess, it's a bunch of racists taht aren't voting for Obama...at least that is all I've read from a bunch of you liberal whackadoos!

The first sentence is horribly misguided. What evidence exists to suggest that the federal monitors are there to "make sure voters' federal rights are not violated on election day.". More likely their job is to drum up phony charges of voter fraud and slow down the polls in Democratic leaning districts.

It's great that the Justice Department is doing this! It's a bit worriesome that it's necessary in the United States. This is the kind of thing that we berate third-world countries for. If Justice finds people who are actively trying to subvert the voting process, I do hope these people are prosecuted and sent to jail for a long, long itme.

As long as they cannot check a voters right to vote in that location (drivers license, etc.) they serve no purpose. ACORN and early voting has already interjected all the liberal fraud.

Too many dead people are being allowed to vote in Chicago and Philadephia. I know all too well about the democrat machine that owns Philly. I was a poll watcher there through several presidential elections.
