(CNN) – Virginia State Police have decided not to file charges against the individual who created and circulated a flyer with incorrect information about the date for voting in this week’s presidential election.

“After a thorough investigation into the origins of a fake election flyer that began circulating in the Hampton Roads region last week, the Virginia State Police have determined no criminal activity occurred and no charges will be filed,” a press release issued Monday said.

The flyer incorrectly stated that Republicans and Republican-leaning independent voters should vote November 4 and that Democrats and Democratic-leaning independents should vote November 5. The flyer claims that the separate dates for voting by party were enacted by the Virginia legislature to ease the strain on the polls during high turnout that is expected Tuesday.

But that information is incorrect. Polls in Virginia are open Tuesday, November 4 for everyone, regardless of party affiliation or political leanings.

The Virginia State Police said in a statement that they had determined the flyer had not been created in order to deceive voters. “The flyer has been evaluated as an ‘office joke’ and was not intended as a means of a misinformation campaign targeting registered voters,” they said. The department noted, however, that circulating incorrect information to voters is against the law in Virginia.

My thoughts are with Senator Obama and his entire family on the loss of his very beloved Grandmother. What a wonderful woman she was and what values she gave to him. Despite his personal grief, he is still continuing his quest for change. He, thankfully, was able to visit a long time with her for a day and a half and bring closure and come full circle with her.

I am so sorry she missed the chance to see him fulfull their dreams.

May her spirit linger and her love over a long lifetime bring them comfort and peace.

That's not as bad as the St. Pete Times publishing a story in the paper that told absentee ballot voters that they could mail in there ballots on Nov 3 and still have them counted (in fact, they will not be counted if mailed today). As their are a historically large number of these voters this year, maybe somebody should investigate that.

Regardless of whether it is a joke, if someone tries to vote on Wednesday their right has been compromised and should sue the indvidual that created/distributed this flyer. He/She is responsible for his/her actions. SHAME SHAME SHAME Virginia Police. Wonder which way their votes lean...

this is a pretty miserable injustice... for all you people screaming about acorn, here is the REAL voter fraud....... the actions of the employees of acorn, while illegal, did influence the election in any way – its impossible to. THIS on the other hand, tells people to vote on the wrong day. a clear lie, and a clear attempt at manipulating the outcome of hte elction.

the crazy names (mickey mouse, etc..) that were attempted to be registered to vote can not influence the election in any way possible. the only way mickey mouse can vote – even if registered – is if mickey mouse shows up with proper ID to the correct polling place and votes. since there is no mickey mouse, and no ID, there is no vote by mickey mouse – thus, all this acorn drama is a creation of the desperate right wing.

This is horrible. Joke or no joke, by using the state seal and taking the extra steps to make it look official, they took it way too far. It sends the wrong message and opens the door for others to attempt similar acts.
Something should be done to discourage this type of activity. The police were wrong not to act on this one!!

Nice story CNN. However, there is a Youtube video where Obama says that he is willing to bankrupt the coal industry. Though he is "in favor" of carbon sequestration and clean coal, he is apparently unaware that 50% of America's electricty is generated by coal.

I guess throwing thousands of people out of work in Ohio, Pennsylvania, West Virginia, Virginia, etc. is OK with Obama.

CNN, as usual, stands by their policy of Certainly No News that would upset the Obama express.
