A bogus flyer telling Democrats to vote the day after Election Day has been discovered.

(CNN) - Virginia State Police may press charges against the person responsible for a bogus flyer in the Hampton Roads, Virginia area that told Democrats to vote on the day after Tuesday's election, according to the state's Board of Elections.

"It was a joke that got out of control on the internet," says Virginia Board of Elections Secretary Nancy Rodriguez.

The state's official logos appear on the flyer, which started circulating on October 24. It said Republicans and Independents leaning Republican should vote on November 4 — Election Day — and Democrats and Independents leaning Democratic to vote the following day.

It says the change in voting times is due to "larger than expected voted turnout" and says an "emergency session of the General Assembly has adopted the following emergency regulations to ease the load on local electorial (sic) precincts and ensure a fair electoral process."

Communicating false information to voters is punishable as a class 1 misdemeanor under Virginia election law.

When it pertains to issues of national importance, how can any individual see such a stunt, particularly one which bears an official seal as a good joke. This only proves that modern day "Jim Crow" tactics and antics still exist. All one needs to do is to examine the faces that appear at all of the Republican rallies, and what you DO NOT SEE are images that are representative of a democracy (people of different race, age, creed, etc). One only needs to look at the Democratic rallies to find a real "united" people of this country. Nonetheless, Republicans are to busy creating division within the country and justifying it by what ever means possible. What about some of the anti-american behavior of Todd Palin? And of course, John McCain is far from a Maverick, because after viewing the profile of the candidates on CNN, he ventured out into the deep end during times that he should have followed cleared directions. This flyer was without doubt misleading and those responsible should be punished regardless of what the Board of Elections Secretary says. The flyer had the official state seal and that should be a punishable criminal act. Things like this need to be stopped as unlawful voting barriers in the future.

For those of you still undecided voters because of moral issues:

Look Bush opposes abortion – and til this day for the 8 years I have not heard that abortion has ceased.

A president, no matter how democratic or republican should NOT be determined because of his morale. As we've witnessed, IT MAKES NO DIFFERENCE.

If a woman has an abortion or not, it is not going to matter how many years of prision she gets or how much happiness the killing of her baby will bring to her.

One thing is for certain: a woman's conscience will be a far greater imprisonment than jail itself after having an abortion.
I don't care what the reasons for the abortion were.

Therefore, whether Obama agrees with abortion or not, or whether McCain agrees with same sex marriage or not.
It should not weigh in on our vote.

What a president thinks regarding moral issues should not be a standard for any of us to follow.

Remember Republicans say they're pro-life only to attract the Catholic vote!! it has been that way since the Reagan years.

Morals come from within you – from your upbrining.

If it all depended on the president, believe me, right we'd all be voting for McCain (we'd all be rabid monkeys).

Hell yes there should be charges. Anyone caught in these voter suppression scams should face harsh penalties to discourage it in the future. I say 5 years minimum. For those people that say we democrats cannot name a single thing Obama stands for, I suggest you go to nbc.com/politics and there you will see in black and white where each candidate stands on the issues. For me the fact that McCain's tax plan would reduce my taxes by $300 some dollars vs. Obama's reduction of $1,100 shows a large difference. Also, as a retired person, social security is important to me. McCain says nothing on this and says anything is allowable including privatization of social security. If this had happened as he wanted, my social security check would have disappeared along with my 401K and I would be in a worse position that I am now.

And kudos to Hillary supporter for Obama. Thank you for listing the way McCain has voted in the past. I had already checked this out and was appalled that the way he's voted is at contradiction with what he is saying at his rallys.

Political Experience: Not negligable. Illinois State Senate, US Senate. As a community organizer, interacting with political parties and PACs to invoke change at the local level.

Foreign Policy: Sitting member of Senate Foreign Relations Committee next to Joe Biden, whom even before he was picked as VP, noted Obama as a critical member of the Committee as well as knowledgeable.

Accomplishments: In Illinois Senate, moved legislation to adopt universal healthcare for all Illinois children not already covered. Influenced and moved legislation for ethics reform in state Senate.

Those are among a FEW.

I don't think this is an innocent "prank" at all…this is disenfranchising voters and undermining the very mechanics of democracy.
This is no joke but a very serious matter and should be prosecuted to the fullest extent of the law to discourage anything like this in the future.

Anyone thinking this is not a deliberate suppression of the Democratic vote is naive and ridiculous and it's things like this that take unfair advantage of the elderly and less educated in order to reduce the Democrats voter turnout. That's about as serious an election fraud as there is.

I already voted for OBAMA. Really, McCain don't know how it feels to be poor. He didn't experienced it. Many of us work hard to finished school. Unfortunately, even with a 4 year college degree it's difficult to find a job that pays well. Unless you're a nurse, a lawyer, a doctor and or well connected to people. Between paying my student loan, rent, food and other necessities there's nothing left.

I wish the government pay my student loan too like the way they bailed out the rich companies!

Some of the comments are rediculous. It was a joke, and anyone who fell for the joke should have their right to vote revoked. I think a person needs to show some form of intelligence in order to get a vote, and falling for a prank like that obviously show a lack of it.

The right to vote is sacred. Interfering with another’s vote makes a mockery of every Veteran that died in a war to preserve our freedom. Where ever voter fraud is found, it needs to be investigated aggressively and prosecuted with Zero tolerance to the full extent of the law. Even minor transgressions need to be punished severely and examples made of those who perpetuate it. If a voting screen is not adjusted correctly to where a voter selects the wrong candidate, then this needs to be investigated and failure to preserve the evidence is tampering with evidence in a crime and also should be prosecuted.
