(CNN) - Hillary Clinton's pay check has officially been cut.

Congress voted Wednesday night to reduce the Secretary of State's salary back to its pre-2007 level of $186,000 to conform to a clause in the constitution stipulating a member of congress cannot be appointed to a government job if the position's salary has increased during the lawmaker's current term.

Clinton's second term began in January 2007.

The conservative activist group Judicial Watch circulated the clause in question, Article 1, Section 6 of the Constitution, soon after President-elect Barack Obama announced he was nominating Clinton to the top diplomatic post. Noting the clause, Judicial Watch said it was illegal for Clinton to be nominated to the post since President Bush authorized a nearly $5,000 pay raise for job last January.

"There's no getting around the Constitution's ineligibility clause, so Hillary Clinton is prohibited from serving in the Cabinet until at least 2013, when her current term expires," Judicial Watch President Tom Fitton said in a statement.

But lawmakers have gotten around the clause before in the same fashion they have now: with Congress changing the salary of the office in question back to what it originally was.

It happened when Ohio Sen. William Saxbe was named President Nixon's attorney general in 1974 and again when Texas Sen. Lloyd Bentsen became President Clinton's Treasury secretary in 1993.

While Clinton is missing out on the nearly $5,000 pay raise, she still stands to make about $10,000 more as secretary of state than she currently draws as a U.S. senator.

I agree Hillary Clinton would have made a better President but I don't think Obama is going to be a bad one and I am glad he had the wisdom to nominate Mrs. Clinton as S.O.S. My goodness, Obama won because he is qualified, look at the quality of the campaign he ran. Look with open eyes and you will see a man with much foresight and a keen ability to read road ahead.

He will lead the US back to her former glory. He absolutely knows what to do and how to be President.

Remember experience is not everything.

Clinton is meant to be Secretary of State at this time-this is a more crucial role for her than if she were elected President.

The entire country voted, and quite frankly Hillary fought a less than honorable fight, but she has certainly demonstrated that she is strong, capable, dedicated to serving the country, and a bigger and better woman than many thought. It's a technical matter that appears to have been resolved. If she and the future President have put this behind them, why can some of you? I think it's great that she'll be Secretary of State. It doesn't really matter who you think should have been president when you look at the salaries these politians make. The article stated that she will still make $10,000 more than as a senator. So I guess the average senator makes around $175,000 a year plus expense accounts. I wonder how much the average member of the house makes?

If they really want to be public servants then maybe they ought to limit their salaries to the minimum wage and see how alot of people out here have to cope with only making $15,000 to $30,000 a year.

I supported Hillary in the Primary, knowing full well that (overall) this country is still not ready for a woman sitting in that office. My wife and I discussed it and knew people would elect a man of color before they would put a woman there. Sad but true.

The 'why' of it would be a good subject for discussion. My theory: The majority of men bow to their wives at home after having spent the first years of their lives bowing to their mothers; therefore, when it comes to the workplace and other 'positions of power' they have a tough time acquiescing control.

As to the SoS position, any group such as Judicial Watch I suppose was right in bringing it up – but I certainly hope they didn't really think she'd be kept out of the position!

I'll sleep better tonight knowing she'll be okay with the $5K pay cut.

I can't argue with Judicial Watch about the part of the Constitution here, but seriously people, do you think when she voted for that raise for Secy of State that she had any thought whatsoever that it might be her in that office in 2009? Personally, it would not have bothered me for her to get the raise in the new position. I think she's going to earn every dime of her salary and that she's going to be a great Secretary of State. I disagree. Most americans placed blame for the economic crisis on the Republicans, and Hillary (just like Obama) would have benefited from it. However, I do think the race would have been closer because 1) African Americans would not have voted for Hillary in the large numbers as they did for Obama and 2) McCain would not had chosen Palin as his running mate if he faced Hillary.

The intent of the clause and others like it is to keep an elected official from voting to inflate the salary of a job and then leave office to take that same job. It was never intended to keep a Congressman or Senator from leaving office to take another position. Congress is upholding the spirit and intent of the Constitution by lowering the salary. Judicial Watch is out to lunch on this one. They are just trying to promote a skewed reading of the Constitution to give Hillary some grief. They know perfectly well the SCOTUS would look at the existing precedent and let things stand.

That's a brillian thought, BB. But it wouldn't be fair for Biden to make $6.50 an hour while his boss had the same paycheck. Or maybe we could let the Illinois governor buy the job of president by offering to work for $1 a year. . . not that such a move would make sense to him.

The reality is I don't think we want to deprive our leaders of the compensation they earn. I want the good ones to get everything they deserve. . . . come to think of it, I want MANY of them to get what they deserve, because that would be a pay cut for most Senators and Congressmen and women.

At first I was in favor of the Bail Out – now that every company, city and orginization has their hand out I have a better idea. I heard this as a joke but now it makes perfect since.
The government should send every American citizen over the age of 25 a stimulis check for $100,000.00. Then the people, whose money this is anyway, will shop and put the money back into the econmy. We won't go on $440m spa retreats and we won't fly in private jets requesting help. The government won't have to pay an over seeer to watch how the monies are spent (another savings). $100,000. is not enough to retire on or stop working. It is enough to pay off dept , shop and get our lives back in order. Some families / friends may even combine their monies and start a small business.

Soundly defeated ??????- Hillary beat Obama in the popular vote and he was only able to secure the nomination becasue he had more support from the super delegates. Obama could not even claim the nomination until the very last contests in June – that's how close it was Arc – get real.

As for the "racist" accusation – Hillary (and Bill) Clinton has a 30 year public record of supporting and promoting civil rights. Anyone who would question their commitment to equality obviously knows nothing about them.

Hillary Clinton has a law degree from Yale, she is a former First Lady, sitting United States Senator, and Secretary of State-designate. Why on earth should she try living on $6.50/hour? I think that she took steps in her life to avoid having to live on $6.50/hour.

I do not think her pay should be cut. I know how hard it will be to try to live on appox. $170,000.00 a year. I only make $46,800.00 a year and it's hard, so if all she gets is the $170,000.00 I think it will be hard for her to live on it. I know that if that was all I was making, I would really have to tighten my belt to live on the little bit more she makes above my present pay.

I hope they do not make her pay for her own meals or jet fuel and I hope the government does not charge her $15.00 for the first checked piece of baggage considering all the baggage she carries with her. LOL
