WASHINGTON (CNN) - The Supreme Court has dismissed a second emergency appeal questioning Barack Obama's eligibility to be president because he had dual British-American citizenship at birth.

The justices without comment on Monday refused to intervene in the November 4 presidential election, dismissing the claims of Cort Wrotnowski, a resident of Greenwich, Connecticut.

In his appeal, Wrotnowski claimed that because Obama's father was a Kenyan-born British subject, the president-elect does meet the Constitution's requirement that the president be a "natural born citizen" of the United States. Obama was born in Hawaii in 1961. His mother was a U.S. citizen, born in the United States.

Many legal analysts questioned Wrotnowski's argument.

"The law has always been understood to be, if you are born here, you're a natural born citizen," said Thomas Goldstein, founder of the Scotusblog.com Web site and a lawyer who has argued numerous cases before the high court. "And that is particularly true in this case, when you have a U.S. citizen parent like Barack Obama's mother."

A similar appeal was rejected a week ago by the high court, from a retired lawyer in New Jersey.

In another lawsuit making its way through the courts, Philip Berg of Pennsylvania alleges the president-elect was actually born in Kenya. Berg claims Hawaiian officials will not let him see Obama's original birth certificate, although the campaign posted a copy of it online this summer, following numerous blog postings over the citizenship question. That case had previously been dismissed by lower federal courts.

The appeal rejected Monday is Wrotnowski v. Bysiewicz (08A469).

No, we have'nt heard the last of this. There are numerous suits being filed against state canvasing boards that certify the election results and that award electoral collage votes. The suits are being done on a state by state level to stop the certification of the election and the swearing in of a new president. It only takes a few states to or courts to agree to hold up the swearing in . Obama should just clear it up before there's a constitutional crisis and Bush continues to be president...

Maybe I don't get it. How does being born on US soil with dual citizenship cause you to not be able to run for President? My mom was born and lived in the US for 44 years. She moved to Canada 5 years ago and has dual citizenship. Does this not make her a natural born American? Also, just because you have dual citizenship does not mean you have dual allegance.

This really defines what it means to be republican. It's not just sour grapes, it's racism. And some racists will never bring themselves to stop trying to fight a black man winning. Some are even trying to pacify their minds by saying he isn't actually black, so it's kind of ok. If you're racist, let's face it, the republican brand is for you. They just removed the country club pic from their web site, until someone realized that might be contrued as racist. Bush just moved into a racist neighborhood that prohibited non-whites until 2000, and probably still is. My point is you don't have to look far to see their racism, and this is just another example.
The same goes for the Hillary supporters that would rather vote McCain or not vote instead of voting for a black man in their own party. At least some of those were conflicted enough to realize they were democratic racists.
I say great. Now we know who they are. Isn't that what they were afraid of in the first place? And now that they are out of the closet, the stink of racism will stigmatize the republican brand from now on, and we will see those ideologies for what they are too, at least the ones they cater to.

@starboardhelm – According to the State of Hawaii, Department of Health, the certificate you've seen on places like Obama's web site as well as other independent sites like justthefacts.org is in fact legal. Each state is given the right to set its own laws on what documents can be used as proof of birth. I was also born in Hawaii. When I applied for security clearance with the DoD, I too received that same green certificate with the stamp. And the DoD, as well as any other federal government entity accepts this certificate. ALL Hawaii citizens has this. If, however, you're looking for the certificate that was originally issued by the hospital, and includes the footprint and doctor's signature, the SOH does not keep that on-record, so you will never ever see that document. Once that original birth certificate is submitted to the State for processing, the data is entered into the database. It is this database that generates the green birth certificate. Again, this differs from state to state, but in the State of Hawaii, the green copy is 100-percent legal and can be used just like the original document. So please do not use your state's laws and attempt to apply them to Hawaii state laws.

I need to add something that is so apparent that it is going to really sound stupid, but I just have to say to the person who said Obama is using two first names "Barry" and "Barack". Barry is a nickname. He obviously used it in place of the more formal and rather unusual name of Barack which is his given birth name. What else would you call someone named Barack – Racky? Has it ever occurred to any of you accusing the posters here of being racist that race has nothing to do with it? First of all, McCain had to produce information relative to his birth in Panama. He did so without problem.
THe problem with BO is not necessarily that most people believe he isn't a US citizen, it's that he, as he did throughout his election and will likely do throughout his presidency, acts as though he is above that AND NO ONE CALLS HIM ON IT. The same thing happened with his medical records. I believe a big problem with Obama is his lack of openness, his lack of disclosure and this odd sense of arrogance that he doesn't have to answer to the public the same way every politician has. I don't know if BO's paternal grandmother said she had witnessed the birth or not, but if she did there is a simple cultural explanation for that. All African traditional societies (like Kenyans) are very possessive of a newly born male child. In the Swahili culture, they strongly believe in the spirit and that death and birth transcend space and time. It is not uncommon for a grandmother in Africa to claim witness to the birth of her grandson, since she was there in the spirit, or the birth happened, spiritually that is, at the ancestral village of the Obamas, even if the child was born in outer space.

The term "natural born Citizen" is not defined in the Constitution.

The definition applicable to President-Elect Obama is contained in the Immigration and Nationality Act of 1952. The question regarding Senator McCain is materially different, as US immigrational and citizenship law was different at the time of his birth.

A "natural born Citizen" is NOT restricted to birth in the United States or its territories. It is defined as a person born in the United States or territories subject to the jurisdiction of the United States, OR a person BORN ABROAD "of parents, one of whom is an alien, and the other a citizen of the United States" under specific conditions of residency – namely, Obama's mother had to be a resident of the United States for five years prior to the birth of Barack Obama. 8 U.S.C. §1401 (a), Section 301 (a) of the Immigration and Nationality Act of 1952

My son was born overseas under the same conditions, and he is not a naturalized citizen, he is legally a US citizen at birth.

The Wrotnowski case (denied today without comment) alleges two things:

1. The natural born citizen issue whihc was covered in the article;
2. That Obama, when adopted by his Indonesian step-father became an Indonesian citizen. This is based on Indonesian law, the school issue (only citizens were permitted to attend public school), adoption laws of Indonesia, etc.

The supreme court may feel they do not have standing to rule now. Maybe after the electors elect Obama, or afther congress confirms them, then their standing may change.

I believe there is enough question that it warrants ckearing up. Mybe this is the issue that Biden implied will "test Obama" after Obama takes office?

Perkins v. ELG, 307 U.S. 325 (1939): The U.S. Supreme Court concluded that Marie Elizabeth Elg who was born in the United States of Swedish parents then naturalized in the United States, had not lost her birthright U.S. citizenship because of her removal during minority to Sweden and was entitled to all the rights and privileges of that U.S. citizenship. In this case, the U.S. Supreme Court affirmed the decree that declared Miss Elg "to be a natural born citizen of the United States."

Since they never went back on that matter, and the INA has no saying (neither recognizing, denying, pro or against) about the question... it is not against the law to have dual citizenship!!!!

First of all, when you purchase a "copy" of your child's birth certificate you do not receive the "original", you simply get a certified copy of the live birth and depending upon the state, various information about each parent is printed on thet "certified" copy you receive. Also, the date you receive the certified copy is actually stamped on the certified copy.

Secondly, Obama's mother was not in Kenya when he was born because his father was attending school in Hawaii; Obama Sr left Hawaii to attend school at Harvard when Obama II was 2 years old.

And there's a simple answer: Hawaii. There is no basis in any of the conspiracy theories out there. And even if there were, the courts would not entertain them. In almost all instances, the federal courts do not recognize "taxpayer standing." You can't file a lawsuit just because you're a taxpayer. You have to show a personal interest in the outcome. A collective interest (such as the result of a presidential election) is insufficient, because your interest is no greater than anyone else's.

If you don't like that, you can always ask your representative to introduce a law to amend the judiciary act. Perhaps start a specialized court to hear all of the lamebrained schemes that would result. If so, I hope you like paying the additional taxes needed to pay for the court.

If he were adopted by his Indonesian step-father he would have gained Indonesian citzenship but they do not recognize dual citzenship, the US on the other hand would have recongized his dual-citzenship and he would still be a "natual born citizen" no matter how hard you try you can't take that away from him or anybody else that was born in the US.

Actually, a search of Wikipedia will define natural born citizen three ways: by blood, by location of birth, or by ethnicity/religion (used primarily in Isreal. The US only uses the first two. You can be a natural born citizen by being born to a parent – jus sanguinis – (only requires ONE) that is a U.S. citizen, or by being born on U.S. territory – jus soli – (which includes the US Virgin Islands, Puerto Rico, and Guam - or any U.S. military base located in a foreign country). So even if President Elect Obama were born anywhere else other than Hawaii, he still is considered a natural born citizen due to his mother's citizenship. We can pick nits on this topic for years, and there are a number of bills that have been introduced in the Legislature to define this more carefully, but I think you nut-cases are stuck with the fact that President Elect Obama is being inaugurated as our next President. If I can stand 8 years of a nausea-producing Twig like Georgie Junior, you can deal with it.

The head of the Department of Health has looked at the original and verified the information on the original long form. The story was in the papers in Hawaii.

when a dual citizen child becomes an adult, they choose which citizenship they are going to have. So even if he was an Indonesian citizen through his step-father, as a child he would still have dual citizenship. He would not loose his American citizenship as has been suggested.

As for another poster commenting that you had to be an Indonesian citizen to enter Indonesian schools, I am not knowledgeable about Indonesian law, but I would say this, Americans study in schools outside the U.S. a lot, including at one time (former) President Bill Clinton. Clinton did not "give up" an American citizenship to study in British schools, nor was he required to. And even further, if mom did have to provide a temporary "dual citizenship" status for Prez elect Obama, she also returned with him to the states after the ending of her second marriage. Mom guaranteed that by returning Obama back to the states, and with the specifics of the law itself, that Obama spending the rest of his youth growing up on American soil, that he would indeed be an American in accordance with the law. The law says, that he is eligible to be President. The law is the final word on the matter.

Barack Obama attended school in Indonesia. In order to attend school in Indonesia, one has to be a citizen of Indonesia. In order to become an Indonesian citizen, one has to give up all other citizenship. One also must practice Islam in order to go to school in Indonesia.

So, even if Obama is a citizen, he would have gone from a natural born citizen to a non-citizen to a naturalized citizen due to his status in Indonesia.

Berg was stating this at least as far back as September and by doing a little research, one can find it to be true.

Of course the constitutional eligibility of the President-Elect is of the utmost importance. But there is no question of constitutional interpretation here – it's simply a question of fact. We have a lot of people here making claims about what the facts are in this case, but since I personally don't get to walk into an office in HI and examine his birth certificate myself, I'll have to trust the officials who have when they say it matches what Obama posted on his website over the summer. All the random schlubs on the web forums shouting "Why won't he show us his birth certificate" don't actually prove that he hasn't.
Now, if McCain had won the election we would be having a very similar discussion but the argument would not be about the facts of the case, but about the interpretation of the constitution with regard to the term "Natural Born". I think the SCOTUS would have been reluctantly forced to take that case. And my understanding of the Constitution and the SCOTUS leads me to the conclusion that McCain would have prevailed, but it would require an "activist" interpretation, which McCain himself professes to oppose. I think a strict constructionist interpretation of the constitution would say McCain would have been ineligible for the Presidency. This question has never been force upon the SCOTUS because the numerous historical candidates with circumstances similar to McCain's have never happened to win the election.
But that's a very different question from Obama's eligibility, which seems to be a matter of fact. The fact that every court has rejected these lawsuits leads me to believe that the evidence presented to them is clearly in Obama's favor.

The only Naturalized citizens are the Indians. The rest of us migrated here from other parts of the world or were born to parents that migrated here or we are the decendents of others that migrated here from other parts of the world.

Upon coming here the Indians were found to have a fair judicial system, low or no crime or disease or poverty and the migrants attempted to improve on what the Indians had and look at the mess we are in now.

Give the man a break. Let him do his job. If you cannot accept having an African American as your President there is always Mexico, Iran, Iraq, or other countries that would be glad to have you.

For the record, I am not a particular fan of President Bush, and I did not want either Sen. Obama or McCain to be President–it is difficult to imagine that in a nation of 300 million people, we couldn't come up with two people who were better qualified to be President than the two from whom we chose.

That said, all of us should be concerned about our politicians living by the Constitution–even those tenets we may not understand. Rather than heap scorn on those who want to be sure that the man who swears to uphold and defend the Constitution actually does so, perhaps it would be reasonable to ask Senator Obama to produce the long form of his Hawaii birth certificate. After all, this matter should be easily put to rest, and remaining silent simply doesn't speak well of him–both our current President and our future President seem to have an imperial attitude that they do not need to answer to those they seek to represent in the highest office of the land.

In Hawaii, every one gets a certified copy of live birth. No one gets the original. The original is kept on file with the department of health. The head of the department of health in Hawaii, looked at the original or long form and certified that the certified copy matched the original long form.

When someone becomes an adult, they loose the ability to have dual citizenship and must choose. Children can have dual citizenship. So even if he went to Indonesia and became a citizen, it did not eliminate his US citizenship.

Obama's mother did not follow his dad back to Kenya according to biographies, which is why he only saw his dad a few times in his life.

What I don't understand is how has this gone on for so long and why is cnn giving it so much attention. Any one who has lived in Hawaii understands that the original has to remain on file so only copies are given out. The copies are certifide as correct copies.

The issue is with the term "Natural Born Citizen". 200+ years ago when our constitution was written world travel was particularly difficult as it was for the following 150 years. Not to many Americans were born in foreign countries. The founding fathers could never have foreseen how easily travel would be in the 20th and 21 centuries. Natural born citizen should be redefined to any child born of an American citizen MOTHER no matter where the child is born Even if the father is not an american citizen.

Here are 2 examples, My nephew with both parents American citizens was born on an US air force base in Germany. He can't be president? But parents from a foreign country here on vacation give birth to a child here and that child CAN be president? As usual these people trying to make a stink about this are likely the same hypocrites who like to use words in another old out of date book to fit their own distorted views of modern society, the bible. As far as I'm concerned Natural born means not born in a hospital. Get over it people, he's just as American as any of you. And he's going to be one of the best presidents this country has ever seen, leave him alone and let him do his job.

Actually, Ricki, Obama's grandma never did say anything like that at all. Both Slate.com and YouTube have the facts on the matter.

If people looked up the law as had at one point "The Chicago Tribune" on the American status of children born out of country, even if Prez elect Obama was born in Kenya, his mother being an American under the specific statute, Obama would still be qualified and certified as an American. So, why are we quibbling on this issue when even the law favors Obama. And the U.S. Supreme Court won't allow even an appeal on this utterly ignorant lawsuit to go forward because well, they may as well question the relevance and reality of a decades old law. As long as mom was born and raised an American, then the law itself says that Obama is an American.

I'm amazed that the continual aspersion against anyone who dislikes Obama is that he's black. Frankly, I disagree with most of his policies, same as I do Barney Frank, Ted Kennedy, and Nancy Pelosi. Hmmm...so what does that make me?

Race has nothing to do with this; McCain was challenged on the same point (with, in my opinion, stronger grounds.) There are always nuts out there, on both sides, who refuse to let something go. How many times over the last 8 years did we hear statements about Bush supposedly "stealing" the 2000 election? Its been a month, vs. 8 years...I think you can allow those elements of the Republican Party who have troubles to finish their adjustment process, given that Dems never did over 8 years.

The US does not recoginize dual or multi citizenship. Just google "US dual citizenship" and you will see. So BO was not a dual citizen at birth.

This situation is rediculous. It's like saying to BO prove you were not speeding on the highway on March 7 1993. Go ahead prove you weren't speeding. The plaintiff has to support sufficient evidence to have a case heard and obviously.

I worked in Vital Statistics, vital records are not available for public scrutiny. Even if he did produce the long form they would make up some other lies.

The Constitution doesn't say that one must AT MOST be a US citizen by birth. It says that one must AT LEAST be a US citizen by birth. The Constitution does NOT say that having another citizenship ON TOP of ones US citizenship makes one ineligible.

B.O. just wondering, where does it "basically" say in the Constitution that you can't have dual citizenship at the time of birth and be president? I thought it only says "no person except a natural born citizen, or a u.s. citizen..." Does that mean a U.S. citizen who had dual citizenship at the time of birth can't be president? Just wondering. I'm no expert on this topic, but I'd potentially be swayed if, say, the Supreme Court has interpreted it that way.

Pretty simple – if you have a parent who is a U.S. Citizen when you are born, you are a "natural-born" U.S. Citizen regardless of the location in which you were actually born. A friend of mine was born in South Africa to an American mother and he's just as "natural-born" as anyone born inside the country to an American mother.

The U.S. Congress has defined “natural born citizen” in Title 8 of the U.S. Code, Section 1401, which says the following people are “citizens of the United States at birth”: anyone born inside the U.S.; any Indian or Eskimo born in the U.S., provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe; anyone born outside the U.S., both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.; anyone born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national; anyone born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year; anyone found in the U.S. under the age of 5, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21; anyone born outside the U.S., if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time); a final, historical condition: a person born before 24 May 1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

That means Obama is a U.S. citizen, since the State of Hawaii says he was born there. Wrotnowski's constitutional argument is interesting, but it doesn’t actually have anything to do with real life.

First it was a copy of his birth certificate, which he provided, because NO ONE gets the original, not even the President. Now it's the long form, that will just provide addtional information which is not relevant as to the place of his birth. You're just looking for something, anything, and I'm glad he is no longer playing into this sick and tired game. The courts decided correctly, by stating there is no issue here. The Supreme Court looked at the decision(s) (all the information) provided by the lower court and concluded that there was no irregularities. But that is not enough. Next , it should be the round form, or the white form, or maybe it is not in the correct type or format. He would not have made it out of the starter block if there was serious doubt about his citizenship. The Bush Administration would have blown the lid off this, if they knew it would get McCain elected. Let it go.

No, we DON'T think he's hiding anything. He showed a certified copy of his birth certificate online for months. Nobody can go in and take their original birth certificate out of the records department. They will only give you a certified copy that is considered the legal equivalent of the original. Moreover, birth certificates are NOT public record, so people waltzing into a records department and asking for other peoples' birth certificates are told to go eff themselves. IT'S CALLED PRIVACY. But I forgot...the GOP wants to rid the country of that inconvenient right so they can institute secular legislation of their religious dogma in an attempt to force everyone to adhere to their interpretation of the word of God. This was frivolous from the get-go and no judge dismissed it as such because it was safer to let it play out so nobody could ever say something was covered up.

The only rulings coming down from the lower courts are based on 'standing'. This determines nothing on the merit of the suit, but only that which person has the legal right to issue the suit.

Obama never released his original birth certificate. The very day McCain's citizenship was questioned, he released his original birth certificate. Why can't Obama do the same? McCain's status as an American citizen was brought up early in the race as he was born on the Navy base in Panama. That was not brought up very much during the election. President-elect Barack Obama has had this charge going against since he first started to run. Yes, he was born in Hawaii as American citizen. His mother was a citizen. Even if his father was a Kenyan-born British citizen, he would still be consider American because his mother is. I have friends who consider President-elect Obama as being a Muslim. He is not. So he hasn't found a new church yet in Washington. Well, he probably will when he moves to Washington. As others have mentioned, check the Constitution. I can't wait until he takes office.

the argument against goes he had DUAL British/American citizenship therefore he is NOT a natural born citizen, followed by the one that goes well he is a natural born citizen but because he got a Citizenship in Indonesia to attend school and therefore renounced his citizenship in the US. The first one is totally ignorant, the US DOES accept duan British/American citizensship and therefore he IS an American citizen by birth and therefore this is a moot argument. the second is based on the fact that the US does NOT accept dual citizenship in Indonesia and America. HOWEVER since Obama never gave up his American Citizenship (yes you actually have to sign a form to give it up or publiclly renounce it, neither of which he did) AND INDONESIA accepts dual citizenship it stands to reason that he was always, and stillis an American citizen. Many countries honor citizenship of Americans without them having to give up their American citizenship. From the US standpoint, however, he was NOT a citizen of Indonesia but always an American citizen

The HI 'long form' has not been released to the public. HI, through the 60s, has issued foreign born children to US citizens, HI birth certificates.

The 'long form' contains the doctor's signature for children born in HI. If not born in HI, the country of birth is listed. Releasing the 'long form' will take care of any questions regarding eligibility.

Since Kenya has 'sealed' all of Obama's records and the original HI form posted by Obama's campaign was a copy of a form issued in 1972, there is sufficient question to ask for proof since all we have is Obama's word that he is a citizen.

McCain had to produce his proof of citizenship in the 2000 elections. There was much furor regarding whether he was born on a US military base in Panama or off site. The question was asked in 2000 and McCain released his records.

All Obama has to do is release his 'long form' and there will be no question he is legit. By not releasing the long form and sealing all of his Kenyan records, you have to question, why?

Steve, Berg has changed his tune at every turn trying to prove Obama isn't a natural born citizen. The crap about Indonesia is just the latest twist. First he said he was born in Kenya and that he didn't have a US birth certificate. So Obama produced his birth certificate, then Berg complained it was a copy (like we all get) & not the long original version. So the head of the Dept of Health for State of Hawaii said he personally had inspected Obama's original long form birth certificate and that it was valid.

So now Berg is trying to say that because Obama had dual citizenship as a child in Indonesia he became a naturalized citizen when he moved back to the U.S. This is crap once you are born in the U.S. you are ALWAYS a natural born citizen, you can never change that.

The US Supreme Court refuses to hear most cases brought before it. They only see cases if they believe the lower courts erred on a point of law or procedure.

Why won't Obama just produce an original birth certificate that's authentic and be done with it.? Obama's grandmother says she he was born in Kenya as his mother was detained and not allowed to fly back for the birth due to advanced pregnancy. Why not just be open and show the proof of US birth and be done with it?

One thing is certain, the constitution must be followed – even if it disqualifies Hillary to be Sec. of State given she voted for her own pay raise as Senator. If the Constitution is not followed that will lead to bigger problems in other situations.

Kenneth – McCain was questioned about the location of his birth. He produced his birth certificate and showed the portion of the law that details how a child born to US citizens outside the US is a natural-born citizen.

And the reason people question Obama's birth is the fact that his paternal grandmother has said that he was born in Kenya, that she was in the delivery room.

It also makes folks wonder when they find that Kenya has sealed any medical records of Obama in Kenya.

I think he is probably a citizen, but has something on his birth certificate he does not want to come out, otherwise, why not release the long form, which is much more detailed, than the short form, which even Hawaii will not accept for some state programs?

Why had Obama hired two law firms (not lawyers, but firms) to keep his birth certificate out of the public eye. Wouldn't it be better if he just showed it and cleared up the courts time. What's he hiding? Also, Hawaii issued him a "certificate of live birth" which is different from the regular birth certificate. It was given to those born outside the country. No problem if your mom or dad is a U.S. citizen. But Obama's mom gave up her citizenship. And his day was Kenyan. Look on YouTube and you'll even see his Kenyan grandma bragging about watching him be born in Kenya. Now that I've made most of you mad, I still think Obama should be president. The courts should, however, clear this up so no member of a foreign state, like Russia, could come and run for president. The way elections have become about "image" vs. issues, the populace needs protected from itself.

This guys argument may or may not stand up to legal scrutiny. It doesn't matter because the Supreme Court refuses to consider the matter for fear of causing a consititution problem. Phil Berg of Pennsylvania actually has a different argument. That is, regardless of Obama's previous status as a "natural born" citizen, the fact that he enrolled at one time at an Indonesian school makes him a "naturalized" citizen. Indonesian laws at that time requires people who enrolled at their schools be citizens of Indonesia. That means Obama's mom had to get Obama a dual citizenship at that time. The problem is, the United States does NOT recognize dual citizenship, ergo, from USA's perspective, Obama actually gave up his citizenship then. When he had his citizenship reinstated upon returning to Hawaii, he became a "naturalized" citizen. By law, naturalized citizens can NOT be the President of the United States. That is the argument against Obama's eligibility for POTUS.

Wrotnowski was not questioning whether Obama was a citizen. His claim is that Obama did not meet the higher constitutional requirement to become president- that of being a "natural born citizen". The only place that term is used in US law is in the constitutional requiremnent for president, and to the founders it had a very specific meaning, whcih is lost or not dicussed in this article.

Wrotnowski also proposes that Obama gave up his citizenship when he was adopted by his step father in Indonesia. This claim may actually be pretty strong.

I suspect this issue will dog Obama's presidencey. Whether for or against Obama, the best situation will be for someone to review this issue. At this point the electors have the right to question his eligibility, then in January congress can question it.

Please don't mix Cort Wrotnowski's case with Berg's. Doesn't matter where he was born since he admittedly held dual-citizenship at birth. (also on Obama's factcheck.org) AT BIRTH. Not Narural-born. if there is admitted dual-citizenship, there's nothing NATURAL about it.

The Supreme Court chose not to rule on Obama's Natural-Born Status. They voted "present". Possible SCOTUS is afraid of upholding their oath? Can't say.

If the electors "rubber-stamp" Obama & don't uphold their oath, to faithfully support the Constitution, then NOT ONE of them will request more clarity on Obama's admitted dual-citizenship AT BIRTH. Precident will be set. The first admitted dual-citizen at birth will be elected POTUS.

Half the country will know this when Mr. Obama places his hand on the Bible Jan 20. How can he take an oath he's admittedly broken? No doubt, every Law, every Executive Order, every military action will be brought back to SCOTUS. This is not to be taken lightly.

Is it legal to demand someone else's original birth certificate in HAWAII? If it's not then Phillip Berg (of PENNSYLVANIA) has ZERO rights to complain about it. If the Hawaiian authorities protects their official records against anyones who THINKS that has the rights to see them, and just that no other justification but the mere thought of a right, then Berg must move to challenge such protection first.

Funny, there was more argument against having McCain which is why Congress actually has signed a document claiming that they recognize him as a natural-born citizen of the United States and eligible to run for President... despite being born in Panama under circumstances that were not explicitly covered by the Constitution.

These same idiots don't realize that dual citizenship AS A CHILD isn't something you CLAIM; and Obama, when he turned 21, did not claim that Kenyan citizenship (which is what the British citizenship turned into when Kenya became its own country).

This is getting a might bit ridiculous. Obama is an American plain and simple. And if you really want to get down to who a real American is-how many of us are descendants of immigrants who came here from other countries. This is a nation founded by immigrants. The people who can truly say that they are natural born citizen are people of first nation's descent – the native's who roamed this land long before the Mayflower arrived at her shores.

I am proud that Obama was elected President. If you cannot handle having him as President them move to another country – one that you find more to your liking.

At the time Obama was born the rule was if you were born in the US, you are an US citizen. Last I checked Hawaii was part of the US. What an idiot! I hope this means that people will let it go, but I doubt it. The court has never dealt with this specific question before, and they certainly are not going to look at it in the context of a presidential election.
