Gov. Blagojevich names dates to hold a special election to fill former Rep. Rahm Emanuel's congressional seat.

(CNN) - Gov. Rod Blagojevich set a spring date Monday for a special election to fill the congressional seat formerly held by Obama chief of staff Rahm Emanuel.

Blagojevich said primary voters in the state's 5th Congressional District will head to the polls March 3, and make their final pick April 7. The dates are based on recommendations by local elections officials.

Emanuel's resignation of the congressional seat formerly held by Blagojevich himself was effective Friday, January 2.

A special election for Emanual's seat would involve only one congressional district. Special election for the senate seat would involve the entire state. Big difference in cost. Nice thought about having both at the same time, but it just doesn't work out.

A March 3 primary means having to get at least 971 valid petition signatures to make the Democratic Primary ballot (less are needed for the Republican and Green Party Primaries, but candidates in those races are either running for exercise or for a better obituary notice in the newspapers when they die, as they have no chance of winning on April 7). In reality that means getting at least 3,000 signatures in two weeks in the dead of winter, instead of the normal 90 days allocated for petition gathering. (Anthything less than that guarantees a petition challenge that will tie up the candidate until the eve of the March 3 voting, dooming their chances even if they remain on the ballot.)

The law doesn't work that quickly in this country. Yes, its frustrating, but it is also the reason why things actually work - because laws are carefully drafted, contemplated, and considered before being enacted. If we could indict someone immediately and convict them two days later, the room for manipulation and mistakes greatly widens. The case against Blagoyavich, unfortunately, is not one hundred percent clear - it is not clear from the tapes, to me anyway, that he actually received something 'of value' in exchange for his promise of the senate seat. Disgusting and despicable? Absolutely. Illegal? Uncertain. Unfortunately this is one area where we apparently have not thought it all out appropriately, becuase he obviously should be stripped of any ability to appoint a governer in this circumstance. But that doesn't mean that we should rewrite the rules for one person - that could have dangerous implications for the long run.

I wish as much as anyone that this would be over – but before "releasing" Blagoyavich from his wrongdoings, we must actually address those wrongdoings.

My reading of the law says that they should probably seat Burris, and then go for a two thirds majority vote to get rid of him. Just sayin'.

I believe the Illinois constitution states that the governor picks to fill a senator's vacant seat and that an election must be held for a representative's vacant seat. Why not have an election for both? I don't know. Go figure.

Being a Chicagoan myself, I am quite ashamed of this guy's actions. And, while I agree, he should be dealt with quickly, the law does say 'innocent until proven guilty'. Even if you have videotaped evidence and 'blood on your hands over the body', everyone is entitled to a fair trial. That being said, someone who claims his innocene so loudly should also have the integrity to realize that while an investigation is underway, he should ethically hold off on making such pointed decisions.

FACTS-He is innocent until proven guilty, you see charges are NOT enough to make someone guilty, an investigation is not enough to make someone guilty, the courts actually have to do their part in this country we have a rule of law not a rule of accusation and charges.

The Illinois Constitution (I know most of the radical right ignore any Constitution (unless it helps their point of view) or gives them cover to further subvert it but I expected better from the loony left.. guess I was mistaken) states the Governor will appoint, in any manner deemed correct BY THE GOVERNOR a replacement for any Senator who cannot fulfill their time in office. So he could, legally, put the seat up for auction on E-bay and give it to the highest bidder, but since public opinion has tried and convicted this man (long before the courts have their say) I guess he should stop doing the job he is getting paid to do by ythe people right?

So why couldn't he have done this to fill Obama's seat? He could have done both elections at once. Now do you see why we, the citizens of Illinois, want him impeached. He doesn't know how to govern.
