Republican Sen. Norm Coleman has instructed his lawyers to move forward with the lawsuit contesting the decision to certify results of the Minnesota recount.

(CNN) - Former U.S. Sen. Norm Coleman has officially filed a lawsuit to contest the state canvassing board’s decision to certify results of the statewide recount which put Democrat Al Franken on top.

Appearing before the press for the first time in months, Coleman said he has instructed his lawyers to move forward with the lawsuit.

Watch: Coleman to contest recount

"Not every valid vote has been counted and some have been counted twice," Coleman said, repeating allegations made by his attorneys. They lay much of the blame for these alleged errors on the secretary of state’s office, saying officials there have sympathized with Franken.

The Coleman lawsuit, filed in Ramsey County District Court, would produce a trial that would be presented before a three-judge panel. Coleman attorney Fritz Knaak said he "would not be surprised" if the trial lasts for a solid two months.

Knaak added that "technically, we could re-do the entire recount," although that was not currently in their plans.

There is still no official winner in the state’s Senate race, since Republican Gov. Tim Pawlenty won't sign off until legal battles have been exhausted.

Ginsings Songs   January 6th, 2009 8:22 pm ET

I say let the process play out. There's nothing wrong with this going to the courts. That's what the courts are for.....to mediate and decide disputes. I'm a democrat, but more importantly, I'd like to know that the person THE PEOPLE elected is eventually seated, democrat or republican. If it takes some time, so be it. It will be resolved eventually and we can all rest assured that the issue has been examined to ensure the one elected becomes senator. With such a close election, I'd be more suspect if the results were not disputed and closely examined.

Carl Justus   January 6th, 2009 8:22 pm ET

Norm Coleman is trying to mimic Bush in Florida in 2000, but he will waste his owners money by going to court, he lost and being typical republican of the last 16 years, they think they are here to run the world and do not enough brains to run a childs toy.

Proud American   January 6th, 2009 8:22 pm ET

I just can't believe that a republican thinks they could win anything in this country. Mr. Coleman go hang out in the mens room at the airport and make a wide stance. lolololololololol Republicans god love them.

CL Get your facts straight   January 6th, 2009 8:11 pm ET

FIRST OF ALL- The officials including the secretary of state and the canvassing board have done and upstanding job of carrying out the recount. To blame the secretary of state is slanderous and pathetic.

A court ruling dictated that previously uncounted absentee ballots could be included in the recount if AND ONLY IF both candidates (or there spokespersons) and the canvasing board agreed that the ballot in question was legitimate and ought to be counted. Each party agreed to these stipulations and the process proceeded as such. THUS Coleman himself has approved (HAD TO APPROVE) all of the additional ballots to be counted . To cry "ERROR" now is a ridiculous attempt to insinuate wrong doing now that he knows his time is up.

Read the articles carefully. They include this information. There was no slanting and my state followed the legal guidelines for this automatic recount with great care.

Betsy-California   January 6th, 2009 8:04 pm ET

Isn't Coleman under investigation for corruption? So why does he bother since he might end up having to resign anyway? Oh, I forgot its only Democrats that should resign, Republicans can stay in office corrupt or not. This is so ridiculous.

Even among Republicans, there is a growing feeling that Coleman will eventually have to concede. Even if there is a trial and the verdict is challenged, this case will be back to the Minnesota Supreme Court, The majority of the members including the State Supreme Court Justice Eric Magnuson (who is on the Canvassing Board) were appointed by the Republican Governor Tim Pawlenty. Evetuallym the people of Minnesota will get ired of this enough that someone will pack it in and it will Coleman. Pawlenty will swallow hard and sign the certificate. Senator elect Al Franken will be sworn in and Senate Minority Leader Mitch McConnell (R-KY) Coleman said that the people of Minnesoat will decide this not Senate Majoirty Leader Harry reid (D-NV). Will Coleman say the same to Senator John Cornyn (R-TX) to keep his nose out of it too? I doubt it!

How come it was OK for the People to keep asking for a recount in FL in 2000 but not in MN in 2008. This is such a bad example of a double standard for the Dems.

Cynthia - Arkansas   January 6th, 2009 7:43 pm ET

Colemen, you need to let it go. YOU LOST! Please accept reality.

jjd: Have you been paying attention to this thing? This recount was run on the up and up, complete with attorneys, the courts and election officials. It's probably the most accurate count in any state ever. There were a lot of votes disgarded originally that shouldn't have been. Having seen that done here in GA, guess which areas get rejected?

Normie's a liar, cheat, flip-flopper, and Republican lapdog. He's been an embarrassment to our state. Now, he gets to show the world how pathetic his lawsuit is after every election board has legitimately gone over the ballots. The colossal failures of the Republicans, from the war to our economic collapse, entangles Coleman, who voted for every one of these debacles. Good Riddance!

Lyndon from CA   January 6th, 2009 7:37 pm ET

Its been my experience that if all the votes are counted they will favor a Democrat. Democrats want EVERYONE to vote and the Republicans want to supress the vote. This has been since before all our civil rights legislation was passed with LBJ.

So, all you Red State freaks out there.... lets count 'em all!!!

That way Franken will go from 225 to over 1000 maybe. Cuz its all absentee votes that first Coleman didn't want counted and now wants to count all of them.

Minnesota Candidate   January 6th, 2009 6:54 pm ET

I am probably one of the few candidates in Minnesota who has actually had a recount for an election. I ended up losing by about a half a dozen votes. What I learned is that elections are an imperfect process. Machines make mistakes because people make mistakes. Rules help us, but not always. Many of the problems have been cited here today, yet Minnesota has a strong tradition of election excellence. During my recount I gained significant votes, but not enough to win. There were improper procedures and I could have challenged them, but in the end I didn't want to take my community throudown that harrowing and distractdful road. I conceded before the full recount was even finished. I think this is something Senator Coleman needs to learn. Yes, we want a fighter, but we also want a gracious politician who knows when to place country or state before self. In my humble opinion and experience, it is time for Senator Coleman to concede. Please Senator Coleman, there are millions of people in this country who are losing their jobs, starving and lacking proper medical attention. We need to get on with fixing this country, not sitting in court discussing a system we already know to be imperfect. It was imperfect before the race and you knew it and it is imperfect today. Please concede for not just the well being of Minnesota, but for the well being of the entire country.

Beverly, NYC   January 6th, 2009 6:51 pm ET

Minnesota, wouldn't it have been cheaper and faster to do a complete re-vote. Rather than milk this re-count for 2 months? This could have been done like American idol, over in one day. Each voter over 18 enters their SSN and votes by phone, DONE!!! We can send men to the moon land robots on Mars but every 4 yrs we re-invent the wheel to cast one vote, pathetic.

Remember even Richard Nixon didn't make a "fuss" about the 1960 Presidential election when he thought Chicago was stolen. He went on to win several years later. Coleman should let it go - if he cares about his state - and then run later if he wishes to do so.

Melissa B ~ California   January 6th, 2009 6:39 pm ET

It is quite apparent that Sen. Norm Coleman does not care about the will of the people who voted, but only about the ballot count and ballot technicalities. Coleman has clearly lost a close election but he refuses to concede graciously in defeat. The will of the people does not matter to Norm Coleman, only Norm Coleman matters to Norm Coleman. He is typical of the worst kind of career politician, one who serves only himself.

Charles Atlanta   January 6th, 2009 6:39 pm ET

Well.. let the court to sort this out. Folks, calm down, don't be so angry from both sides. But I don't think Coleman has too much ammunition. Minnesoda superior court has rejected the appeal before. The governor can delay signing the results but sooner or later, he will have lots of pressure too.

Vicki5   January 6th, 2009 6:37 pm ET

So, for the good of the people doesn't really matter to Coleman. It was a fair recount and they both had their opportunities to challenge. I think it is a shame that he will hold up Minnesota from having representation in the Senate. Shame on Coleman.

Frankly, I support Coleman proceding with his suit. I'm confident that it will 1) more clearly validate Frankin as the winner of the election and 2) completely alienate the people of Minnesota from supporting Coleman, Pawlenty...or any Republican...in the foreseeable future.

Tina Mattson   January 6th, 2009 6:21 pm ET

Coleman is showing his true colors. He had asked Franken to dispense with the original recount "to save the state money." Now he does whatever the cost to try to ensure his victory. Coleman is slimy scum and the state will be better off once he slithers back under the rock from whence he came.

JD in Moraga, CA   January 6th, 2009 5:55 pm ET

The people of Minnesota are the only losers here. Stop the insanity! They should pass a law that states that elections unresolved by the time Congress is seated will result in vacancies in Congress.

Michael   January 6th, 2009 5:55 pm ET

An interesting contrast between Washington state's election for governor last cycle and Minnesota's senate election. The recount in Washington was also razor-thin but at the end of the day, that was that. Similar outcome in Minnesota now holds the spectre of a drawn-out legal battle. I guess it's what's at stake. The Repubs took a drubbing in 2006 and again in 2008 and they're grabbing for any straw they can find. Maybe they should dig some of those "Country First" signs that were used by McCain in the presidential campaign.....

Unshrub   January 6th, 2009 5:55 pm ET

What a hypocrite, first he didn’t want the votes counted but now that he is behind he wants all votes counted, even those that both sides (and the State Supreme Court) earlier agreed not to count. The republicans are just as bad as Coleman by doing the same thing they complained about Al Gore doing in 2000. It is obvious that they only care about winning regardless of the rules. It’s time Coleman does what he demanded Franklen does and step down. Looser, looser, looser.

That's the problem; too many uneducated, inexperienced people like you are allowed to vote...and that's why the corruption/idiot wave floated your boy to the white house...just wait, you'll see how uninformed you were.....

Center of the Middle   January 6th, 2009 5:38 pm ET

Yes, this is the same Norm Coleman who two months ago - when he was leading the vote count process - said that if he were in Al Franken's shoes, he'd step aside.
NOW...........

Norm Coleman has changed his mind and has decided all he wants to do is sue.

Pathetic

AnaB   January 6th, 2009 5:38 pm ET

Maybe they can just draw straws.

Connie   January 6th, 2009 5:38 pm ET

Congratulations to Sen. Al Franken.

DO LET THE DOOR HIT U ON YOUR WAY OUT!!   January 6th, 2009 5:37 pm ET

I AGREE..IT'S OVER MAN, LET IT GO!!!

Terry   January 6th, 2009 5:37 pm ET

Perhaps the two candidates will agree not to appeal the court's decision. That would be nice.

As a good Conservative, Coleman would not want Federal courts messing with state affairs, so I presume he will be satisfied with whatever the state courts decide.

State officials cannot figure out how to record, count, or recount votes eight long, long, long years after the Florida recount fiasco.

BUSH BEGONE, AND NOW 75% OF AMERICA AGREES, FINALLY!   January 6th, 2009 5:35 pm ET

Coleman should be suing the MN Supreme Court. That is the entity that set or let stand the rules for the recount.

They stated that all votes would be counted that the county officials and both candidates agreed should be counted. The 650 were not agreed upon by all parties.

Rick-Former Minnesotan   January 6th, 2009 5:33 pm ET

No more "Minnesota nice". I trust the court to separate fact from spin.

Objective thinking   January 6th, 2009 5:33 pm ET

Cue ignorant anti-Republican remark from "Proud American" in 3... 2... 1...

Art   January 6th, 2009 5:32 pm ET

Look Coleman, I'm a card carrying Republican and I have to say "GIVE IT UP!" This is getting stupid. I'm not a Al Franken fan, but give it a rest man. It's over. Finito, Done, and whatever else you can call it.

Kaye -Jacksonville FL   January 6th, 2009 5:31 pm ET

Someone save us, please, from who knows how much more reporting on this absurd situation. The recount is over – give it up Norm – the country is tired of you ... poor Repubs – they just can't lose with a shred of grace.

BM   January 6th, 2009 5:29 pm ET

Let it go Coleman. You're a loser!

guythegood   January 6th, 2009 5:29 pm ET

He's good enough, he's smart enough and gosh-darn it people like him. ...

BB   January 6th, 2009 5:28 pm ET

Instead of a silly recount of the recount – RE-VOTE !!!!

Minnesota is looking more and more ridiculous as this thing drags on.

Proud American   January 6th, 2009 5:26 pm ET

Typical Idiot Republican sore loser.

Will-South Dakota   January 6th, 2009 5:25 pm ET
