Former Republican presidential candidate Mitt Romney issued a statement Tuesday on Sotomayor's nomination:

"The nomination of Judge Sonia Sotomayor to the Supreme Court is troubling. Her public statements make it clear she has an expansive view of the role of the judiciary. Historically, the Court is where judges interpret the Constitution and apply the law. It should never be the place "where policy is made," as Judge Sotomayor has said. Like any nominee, she deserves a fair and thorough hearing. What the American public deserves is a judge who will put the law above her own personal political philosophy."

How is interpretting the Constitution NOT making policy?

As far as expanding the role of the judiciary you should look at how the GOP has expanded it into the bedroom and homes in general by allowing warrentless searches and seizure.

The constitution said that the supreme court finds laws and policies constitutional or not. But if you look at American history, the powers of the supreme court have been expanding *since the beginning of the government*. And by definition, finding a law "constitutional" or not is setting policy.

It is clear to me, that CNN, thinks every Republican in office, out of office, never should of been in office, or who is seeking an office, should be heard on any matter regarding a decision by our President.

Tell me CNN, how does a US citizen, tax payer, veteran, registered voter, etc. get to have a atricle posted on this "Ticker"? Are the slots reserved for only those who you deemed important? Are citizens,of no consequence? Is CNN a news organization or a Politican organization?

Wow, you really are a dolt. SCOTUS interprets law as it pertains to policy. Based on law, SCOTUS can either declare a policy as constitutional (being within the bounds of law) or unconstitutional (outside of the bounds of law).

I've never hear of SCOTUS writing a bill and sending it to the President for his signature.

And if all judges thought the way you do, we would still have slavery, women would not be able to vote, we would still have "separate but equal" schools, elections that disenfranchise urban voters and on and on and on.

I guess Alito is the kind of white male you prefer on the court. After all, he was the lawyer who argued in the "Casey" decision that married women should have to have their husband's permission to get an abortion, like that idea was in the Constitution.

Every president who nominates Supreme Court justices chooses candidates based on whether they agree with his personal philosophy. President Bush certainly did so. Why should we think that President Obama would not? President Obama was elected based on his political opinions and personal philosophy. I would think that his Supreme Court nominations would reflect this.

As a retired military officer and conservative who generally votes Republican, I believe Romney's comments are old school that adds no benefit to the discussion. If the the GOP doesn't move away from the far right and if it continues to blindly support incompetents the likes of Bush, Cheney, and Limbaugh, then the GOP will become more irrelevant than they are now.

He's right. The role of the Supreme Court is to rule on cases based upon the legislation our forefathers have already outlined. Whether she leans to the right or left doens't make a difference. Her job, as is the other justices, is to interpret and uphold the law – not create it. That's role falls to our Congress.

The Supreme Court pick is troubling to Romney. He should make that clear. The fact that it is troubling is a personal viewpoint. And I take it with a grain of salt because Romney is a potential presidential pick was troubling. Why should I care that Romney thinks the SC pick is troubling. Is he saying that her career is flawed, that she is a flawed person? She is good enough to have had her career so far but flawed as a SC judge because he disagrees with her views?

Obama is a POLITICIAN and as a politican, is required by his party to nominate someone that will keep the judicial balance as it currently stands. Sotomayor has made extremely sexist and racist remarks about a Latina judge making better decisions than a white male judge, based solely on the life that she has led. If a quote like this came out during Roberts' confirmation hearings, he would have been crucified in the Senate chamber.

Not to mention the fact that Sotomayor has stated that courts make policy....she is an activist judge, through and through.

Makes no difference. Prince Harry will make sure this nominee sails through and we will be stuck with her for the next 30+ years.

The Republicans probably had a similar statement prepared for all the nominees since they were gearing up for a fight before the nominee was even chosen. If Romney thinks that Scalia doesn't bring his personal philosophies to the bench, then he hasn't been paying attention. That makes sense, though, because truth, for the current GOP, means nothing. They'll say whatever comes to mind, whether based in truth or not, and just hope that we don't notice.

Romney is correct in that Sotomayor deserves a fair hearing. But it is clear from her past that she wants to rule from the bench on her own personal experiences. The Supreme Court was designed to be enforcers of the constitution which was set in stone to keep this great country from abandoing its founding principles.

when the legislature doesn't have the guts to make a law that covers the subject or makes a law that is unfair, then it is up to the judges to make the law. none of us like it, but until we elect senators and congresspersons that will make laws that cover all areas of the law and are fair and equitable, then we're stuck. I'd rather have a highly intelligent justice than some wh only see things in black and white. It's a living color wolrd out thee, we need to move on. I agree with Mitt Romney on the court and the position of a judge. Whether its upholding Roe vs Wade or recognizing the equality of same sex marriages, a judge should enter the court without his or her personal views attached to the decision.

I applaud Pres. Obama for his choice of a Latin woman but I also hope that he is not buckling to pressure to nominate a woman or a latin or any other race because it is what certain groups of people want. Every choice should be based on the right person for the job whether white, black, man or woman.

When will we get a homosexual on the bench, then?!

Too bad Romney is not aware that the judge's statement is true. When the law fails to address an issue, then the court ends up settling that issue which is then considered POLICY.

That policy remains in place until the government (state and/or federal) establishes the finalty of the POLICY. If the government does NOT develop a law to govern the issue, then the courts judgement reamis as POLICY.

Anyone can disagree with this statement, but judges still continue to establish POLCIES.
