Romney: Sotomayor nomination 'troubling'

Former Republican presidential candidate Mitt Romney issued a statement Tuesday on Sotomayor's nomination:

"The nomination of Judge Sonia Sotomayor to the Supreme Court is troubling. Her public statements make it clear she has an expansive view of the role of the judiciary. Historically, the Court is where judges interpret the Constitution and apply the law. It should never be the place "where policy is made," as Judge Sotomayor has said. Like any nominee, she deserves a fair and thorough hearing. What the American public deserves is a judge who will put the law above her own personal political philosophy."

Why does it matter what Mitt's opinion is? He has no say in the matter.

We know that people like Mitt, Limbaugh, Cheney, Bush, etc would oppose the nomination of the reincarnation of Reagan himself if it came from a Democratic president.

Hmmm, why am I not shocked by the Mittster's comments? He is going to be one of many right wing nut jobs who take this segment of a longer quote out of context and use it against a highly qualified judge.

Again, the Republicans are attempting to put their party's philosphy above the interests of the country–oh yea, I forgot, their philosophy should be the that of the country. And, if you don't beleive that just wait until Rushbo submits the party's viewpoint!

Sotomayor is right and Romney is wrong – and he ABSOLUTELY KNOWS IT. Policy IS made and always has been made by the appeals courts and by the Supreme Court.

Hard cases make it there for a reason.

It's amazing how the GOP preach this crap when a democratic president makes a nomination. But for their own nominees they wanted a right wing sonservative to push their agenda. The could have cared less about the law. Sotomayer is a great pick! She has more than proven herself to be the kind of judge we would want to see on any bench in America. Democrats, liberals, moderates, and espcially Hispanics, need to get behind Obama on this choice, and make their voices heard to the GOP!

Too bad Romney is not aware that the judge's statement is true. When the law fails to address an issue, then the court ends up settling that issue which is then considered POLICY.

That policy remains in place until the government (state and/or federal) establishes the finalty of the POLICY. If the government does NOT develop a law to govern the issue, then the courts judgement reamis as POLICY.

Anyone can disagree with this statement, but judges still continue to establish POLCIES.

The American public deserves is a Government who will put the law above their own personal political philosophy. A repubilican has little credibility when it comes to putting the American Public before their own interest. Repubilican will only be happy when every human on the planet marches to their political philosophy.

I agree with Mitt Romney on the court and the position of a judge. Whether its upholding Roe vs Wade or recognizing the equality of same sex marriages, a judge should enter the court without his or her personal views attached to the decision.

I applaud Pres. Obama for his choice of a Latin woman but I also hope that he is not buckling to pressure to nominate a woman or a latin or any other race because it is what certain groups of people want. Every choice should be based on the right person for the job whether white, black, man or woman.

when the legislature doesn't have the guts to make a law that covers the subject or makes a law that is unfair, then it is up to the judges to make the law. none of us like it, but until we elect senators and congresspersons that will make laws that cover all areas of the law and are fair and equitable, then we're stuck. I'd rather have a highly intelligent justice than some wh only see things in black and white. It's a living color wolrd out thee, we need to move on. Minorities, black, Hispanic, etc are the new Majority. Get used to it. In my opinion, Mitt Romney is a White Supremacist, he needs to get used to it.

"All of the legal defense funds out there, they are looking for people with court of appeals experience because the court of appeals is where policy is made. And I know this is on tape and I should never say that because we don't make law. I know. Okay, I know. I'm not promoting it. I'm not advocating it. I know."

Romney is correct in that Sotomayor deserves a fair hearing. But it is clear from her past that she wants to rule from the bench on her own personal experiences. The Supreme Court was designed to be enforcers of the constitution which was set in stone to keep this great country from abandoing its founding principles.

The Republicans probably had a similar statement prepared for all the nominees since they were gearing up for a fight before the nominee was even chosen. If Romney thinks that Scalia doesn't bring his personal philosophies to the bench, then he hasn't been paying attention. That makes sense, though, because truth, for the current GOP, means nothing. They'll say whatever comes to mind, whether based in truth or not, and just hope that we don't notice.

Obama is a POLITICIAN and as a politican, is required by his party to nominate someone that will keep the judicial balance as it currently stands. Sotomayor has made extremely sexist and racist remarks about a Latina judge making better decisions than a white male judge, based solely on the life that she has led. If a quote like this came out during Roberts' confirmation hearings, he would have been crucified in the Senate chamber.

Not to mention the fact that Sotomayor has stated that courts make policy....she is an activist judge, through and through.

Makes no difference. Prince Harry will make sure this nominee sails through and we will be stuck with her for the next 30+ years.

But you can't avoid the fact that she has said the Supreme Court is "where policy is made". This may be true in Mexico but not in our constitution-based America. But, it makes no difference, a female Hispanic satisfies two large constituencies and she is a shoo-in.

The Supreme Court pick is troubling to Romney. He should make that clear. The fact that it is troubling is a personal viewpoint. And I take it with a grain of salt because Romney is a potential presidential pick was troubling. Why should I care that Romney thinks the SC pick is troubling. Is he saying that her career is flawed, that she is a flawed person? She is good enough to have had her career so far but flawed as a SC judge because he disagrees with her views?

Every president who nominates Supreme Court justices chooses candidates based on whether they agree with his personal philosophy. President Bush certainly did so. Why should we think that President Obama would not? President Obama was elected based on his political opinions and personal philosophy. Obama is dumb on this nomination, he KNEW the history of Sotomayor, she's using her gender and made racist comments. Sotomayor and Obama are two peas in a pod.

@ Tulsa, who said "No opinion from "Mr. Mittens" is worth even listening to."

Actually, let's be very clear here: this is NOT his "opinion." It is regurgitation of something he read in an email from the RNC, which was sent so everyone could goose-step into line on the issue. It's evidenced right down to his use of the "where policy is made" quote. If nothing else, the GOP is good at making sure everyone is vomitting the same talking points like a hive of angry drones.

Mitt Romney's oppinion on things is so respected by the american public that he neither got the nod to be the republican party presidential candidate in the last election, nor even the VP slot. Who, exactly waits for what Mitt thinks on anything?

    Mr. Romney,
To interpret the constitution, and apply it as law, from it's writting in 1776....One would have to deduce you're interpretation is to narrow ideas of newfound problems based on old experiances when the new found problems were unknown. In effect, you're claiming the country should never grow as the world evolves. This may be how they view things in the Mormon tabernacle....but not in American society....

    TO: We Love Sarah,

Wow, you really are a dolt. SCOTUS interprets law as it pertains to policy. Based on law, SCOTUS can either declare a policy as constitutional (being within the bounds of law) or unconstitutional (outside of the bounds of law).

I've never hear of SCOTUS writing a bill and sending it to the President for his signature.

I suggest you go back to your Schoolhouse Rock CD and listen to "I'm just a Bill" again.

Of course it's "troubling" to Romney. It's not a wealthy conservative white male. Continue to play to the GOP base, Mitt ... it's at something like 21% and shrinking daily. If the GOP has a lick of sense (which I doubt) they WON'T oppose a Hispanic nominee to the high court. Otherwise the number of Hispanics voting Republican in 2010 will be about as large as the number of African-Americans voting Republican in 2008.

Democrats always say Bush stole the 2000 election but what they fail to realize or bring up is the Florida Supreme Court(One of the most liberal State Supreme Courts in America) made new rules and laws up as they went and essentially tried to steal the election from Bush .The only reason it went to the Supreme Court is because the Florida Supreme Court got it wrong and tried to steal the election themselves. Democrats want to make policy from the Bench and good for the GOP for calling them on it.

Liberals never cease to amaze me. Half of the comments here read like they were written by Obama himself.

All Liberal arguments are based on criticisms of the policies of others. Liberals present no new ideas, only criticisms of old ideas.

Change? Obama has adopted almost all of the Bush-era policies, with the glaring exception of Gitmo, yet continues to claim that all of the country's woes are because of Bush-era policies.

If the legislature is not available because of partisan people that don't share your view or of corruption, the courts are a legitimate location to have greviences. If you can't get something done one way, there are other avenues to get it done.

The former Gov. Romney should sit back on the deck of his home up in there in the Lakes Region of NH and just chill. He's not paying any State income taxes since defecting from MA. so he should be happy along with the zero sales tax provision of NH. It's so perfect for him or most any GOP wannabe.

Leave the Supreme Court nominee to those who have some professional inking in these matters as opposed to whatever Rush, Newt or Dick might conjur up in terms of obstruction and whisper in your ear.

It is clear to me, that CNN, thinks every Republican in office, out of office, never should of been in office, or who is seeking an office, should be heard on any matter regarding a decision by our President.

Tell me CNN, how does a US citizen, tax payer, veteran, registered voter, etc. get to have a atricle posted on this "Ticker"? Are the slots reserved for only those who you deemed important? Are citizens,of no consequence? Is CNN a news organization or a Politican organization?

    Stupid conservatives:

The constitution said that the supreme court finds laws and policies constitutional or not. But if you look at American history, the powers of the supreme court have been expanding *since the beginning of the government*. Who is more troubling to America: Mitt Romney or Sonia Sotomayor? Judging by the last election, it seems Mitt is much more of a problem.

"What the American public deserves is a judge who will put the law above her own personal political philosophy." This coming from Mitt Romney, a man whose "own personal political philosophy" depends entirely on who is writing the biggest checks to his campaign. The man's hypocrisy knows no bounds.

Brown vs. Board of Education of Topeka KS – Supreme Court decision which does uphold the Constitution and does make 'policy' where current powers that prevailed did not have the fortitude to do so.

    @ Dems are Hypocrites

The Florida Supreme court among the most liberal? Seriously? I have a feeling that people like you consider anyone to the left of Attilla the Hun as too liberal.

No matter who Obama picked Republicans would oppose. It's almost a joke. They are looking for a fight and frankly.... BRING IT ON!

Let's see if the GOP can alienate the Hispanic community and continue to fall into history.

Romney should just roll over and go away! Everyone knows his opinions don't count. What does Loudmouth Limbaugh have to say? Of course, he doesn't matter either to reasonable people.

If it is troubling to you Mitt, then you like the rest of the GOP and Sean Hannity are unpatriotic to this country.

Sotomayer's past statements make it clear that she will base her decisions on her own personal preferences rather than the constitution. Only a moron like Obama would have made this appointment.

    -----------------------–

This is pretty funny when you consider Obama is the thrid president to appoint her to a judgeship. I wonder what other facts are being distorted?

You know? Scroll down this blog and take a look at all the name calling. Right wing Nazi's? Stuffed suits?

Unfortunately, there are few adults out there. Liberals and right-wingers alike – it'd be wise to heed Obama's Notre Dame speech – it actually is possible to disagree on issues without reducing the other to caraciture. This is getting old......

"Funny ….Mitt thinks Judge Sonia Sotomayor as a Supreme Court justice is troubling ….yet Sarah Palin as a Vice President nominee was just fine ….."

Another victory for the activist left!

Any person who has explicitly stated that their race and ethnicity render them more qualified to render legal judgements than others is dangerously unqualified for the bench.

"Troubling"? Yes, to say the least.

    @TampaRich who said:
Then why are the democrats trying to burn the constitution, freedom of speech, gone. Guns, soon to be gone.

Where are you getting your information? The biggest step against freedom of speech came during the Bush years, and there has never been an indication that Dems want all guns gone.

Of course any conservative who has any objection to this pick will immediately be deemed a racist. That's because Liberals are phony and have selective memory loss. Conservatives are the color blind ones, while liberals select and elect officialis based only on their pigment. That is the true racism. Liberals are absolutely destroying the fibers of our country

Romney and many Republicans would find anyone that Obama picked as "troubling".

They just don't get it. They have nothing to add to the discussion so just say"no".

Thank you fellow Americans for electing Obama! What an excellent choice he has made for the Supreme Court.
