Judge Sonia Sotomayor would be the first Hispanic U.S. Supreme Court justice if confirmed.

WASHINGTON (CNN) - The Republican Party risks further alienation from Hispanics by challenging the nomination of Sonia Sotomayer, who would become the first Hispanic, and third woman, on the Supreme Court.

On Tuesday, President Obama nominated 54-year-old Sotomayor - who is of Puerto Rican descent - to replace the retiring Justice David Souter.

Sotomayer is a judge on the 2nd U.S. Circuit Court of Appeals, named to that post by President Bill Clinton when she was a U.S. District Court judge, nominated by President George H.W. Bush in 1992.

The barbed comments about Sotomayer began almost as soon as the announcement was made at the White House on Tuesday.

Conservative radio personality Rush Limbaugh called Sotomayor a "reverse racist" on his show. Limbaugh, who is known for stirring up controversy, said he hopes Obama's nominee fails.

"Do I want her to fail? Yeah. Do I want her to fail to get on the court? Yes. She'd be a disaster on the court," he said. "Do I still want to Obama to fail as president? Yeah. ... He's going to fail anyway, but the sooner the better here so that as little damage can be done to the country."

southerncousin is still seething over Jackie Robinson. It's hard to look forward when you can't stop staring into the rear view mirror.

Marcus Tate   May 27th, 2009 12:39 pm ET

She was only chosen because she is a woman and hispanic. Obama and the Democrats said from day one the candidate should be a woman, and it would be good if she was hispanic. (After they told us the candidates race and gender "Didn't matter.) If a candidate were chosen because they were white and male, there would be charges of discrimination. I hope the Republicans can find a way to block her confirmation, because I am not happy with this candidate, because she was chosen in this manner.

Nan in Bloomington   May 27th, 2009 12:39 pm ET

Out of 110 justices in the history of the Supreme Court, two have been African American and two have been female. The other 106 justices have all been WHITE MALES.

End of story–get over yourselves.

Kenneth Slarkenstein   May 27th, 2009 12:39 pm ET

I guess calling the nominee and the President of the United States "racists" is walking a fine line. But the junior high bully approach seems to be the only strategy they have.

Why have such large number of conservatives decided that the wildest, most totally absurb exaggerations are "the truth"? I think we should call them "Kazinski Republicans."

Could the Republicans be doing a better job of alienating themselves from reasonable people? Is it possible for them to lose more support and credibility?

Paula   May 27th, 2009 12:38 pm ET

can someone for the love of life please shut Rush Limbaugh up?
i am tired of hearing him rant about how he wants everyone to fail.
know what RUSH – i want you to fail and fall over a steep cliff....
we need solutions and cooperation, not your whining and criticisms...but that apparently is indicative of exactly how little you have to contribute to any intelligent discussion

Ted Tartaglia   May 27th, 2009 12:38 pm ET

The racist, overweight, drug addicted, cowardly, uneducated Rush Limbaugh calling some a reverse racist. What a joke! No wonder he is the leader of the RepubliCONs.

Michael M, Phoenix AZ   May 27th, 2009 12:35 pm ET

What is a "reverse racist" any Rush? Someone who stands up for EQUALITY under the law, something you apparently forgot to remember about after you read the Declaration of Independence and the Bill of Rights.

mw   May 27th, 2009 12:35 pm ET

God's richest blessings on Judge Sotomayor.

Lucifer Limbaugh will not get his wish for failure with his hate speech.

God bless our country.

God forgive the idiots in our country. God forgive the supporters of the hatemongers in the world.

chad   May 27th, 2009 12:34 pm ET

So if you round your statistics, RealityKing, that's pretty much how the Court is made up. We have 1 black, if Sotomayor is confirmed we'll have 1 Hispanic, and 7 whites. If we replace one of the white justices with an "other," which may very well happen some day, then we'll be right on as far as representing a cross section of American ethno-racial demographics.

RealityKing   May 27th, 2009 12:33 pm ET

correction noted.., and glad you guys are now seeing the mindlessness of a Supreme Court reflecting the ethnicity of America

Steve - Connecticut   May 27th, 2009 12:32 pm ET

Republicans think it is wrong to have the Feds involved in the Auto Industry, the Banking Industry, and Wall Street. They say Goverment is too big. But they are ready for a Constitutional amendment to ban Gay Marraige, or interfere in a persons right to die (Terri Shaivo). They can't have it both ways. That is why we have a 10th Amendment and States Rights.

Jean, MS   May 27th, 2009 12:31 pm ET

Oh boo hoo. Sonja beat up on white guys.

Something tells me the "White Guy Society" will be just fine. It's the rest of us that need representation on the court, and have had for years, and years, and years.

President Obama made an excellent selection and now it's up to the voters to make our voices heard.

Lee-- Dallas, TX   May 27th, 2009 12:30 pm ET

Why do the repugnicans leave out the fact the Judge Sotomayor sided on the side of the New Haven people? There stepping into dangerous territory trying to make her out to be some far left-wing extremist, especially when her record show that she's sided with her republican counterpart about 95% of the time when decisions were made across a panel.

Not to mention there are no truly radical decisions she's made as a judge. The Obama people did there homework on this one... If it’s a fight the right wants, I would tell them to reconsider.

Conservatives and Repugs, I only have one question:

Why do you continue to cut your nose to spite your face?

If she were a white male with the same qualifications, would you be opposing this nomination? And why are you so worried, it's still mostly white old men who have that position. Geez.

I can't even begin to imagine who McCain and Palin would have nominated (thank goodness they didn't win).

Andi   May 27th, 2009 12:28 pm ET

southerncousin – I'm just about speechless. What kind of ridiculous racist statement was that? On what planet would that comment help any cause?

The gasbag Limbaugh would oppose Obama's nomination even if he were the nominee. Shows what drugs can do to an already feeble mind.

ghost   May 27th, 2009 12:24 pm ET

Fair, I'm doing well. Hope all is well with you.

To be honest, I think this whole thing is silly. You have Steele being careful for political reasons only. If he thinks this is a bad pick, let's hear some honest discourse on it. Thus far, I've only heard some ramblings about this and that. Rush is just ridiculous, but what else is new? Huckabee's arguements are hot air only. A judges expeiences influence their rulings most of the time anyway. So all this back and forth to me is a waste. Let them do their jobs and if they find some reason, turn her down and let's move on.

Dutch/Bad Newz, VA   May 27th, 2009 12:19 pm ET

@ Fair is Fair

I'm just bringing to light that Bush tried to appoint a lady with no comparable record to Judge Sotomayor. That's all. Now when President Obama picks the perfect candidate, the right gets their panties all in a bunch.

JS007   May 27th, 2009 12:18 pm ET

Turning the spotlight on Limbaugh might have been one of Obama's (with credit to Emauel) best decisions. Ha ha!

America is 63% white, 18% black, 18% hispanic and 1% other.

So.., for all you progressively educated dems who blab on about the Supreme Court reflecting America, that actually means:

1.1 hispanic
1.1 black
4.1 white
.7 other

Good luck with that!!

GOP = 21st century dodo   May 27th, 2009 12:15 pm ET

Ben   May 27th, 2009 12:15 pm ET

Are Republicnas really allowing Rush Limbaugh to be their spokeperson? Don't get me wrong, I love the idea. He will keep the whole party in a state of perpetual failure. At some point there will be a halfway intelligent Republican that will need to muzzle him, but in the meantime it's like having your favorite shock jock running a political party–it's hilarious. Until someone has the guts to shut him up, Republicans will be on the outside looking in at the White House and the Senate. Between Michael Steele and the corpulent pill popper, the Republicans look like they might chew their own arms off before they realize they've swirled down the toilet.
Oh well.

The firefighter's case should never have reached her court and that was kinda the point. Nobody was discriminated against. Nobody received a promotion. Had they promoted minorities, then they would have a case. However, I don't agree with the initial ruling anyway. But it's not a civil right's case or a case of reverse discrimination. If anything, they should sue to have another test created and taken or some other criteria for promotion.

Policy is made in the court, simply due to the court having to decide heavily if something violates the Constitution. Roe vs Wade, Brown vs. the Board of Education are prime examples.

Lynda/Minnesota   May 27th, 2009 12:11 pm ET

It is expected; it is their job and the media just can't let an opportunity pass by to sell some yellow journalism.
Sotomayer will be a good choice and add to the balance required for balanced opinions. It matters lilttle what ethnicity she is, what religion she might practice or her gender...she just needs to do her job of interpreting the constitution the best she can.

Yes, indeed, I watched the tape of her making those comments. And quite honestly, her laughter to me seemed condescending and her "dismissal" as you call it seemed disingenuous.

ghost   May 27th, 2009 11:56 am ET

She said that a latino woman with a myriad of experiences would be better than a white man with a sheltered life. How exactly is that racist? Lose the race and gender and simply say that a person who lead a life without much exposure to different races and/or classes of people won't relate to those different than themselves. Quit trying to justify your own racism by accusing others.

Chuck, Tennessee   May 27th, 2009 11:53 am ET

There was an article about how Sotomayor's confirmation would contniue a trend of making the SC more catholic. Well, she may have been raised catholic, but she is not a real catholic if she strongly supports abortion rights, which she does. If she is qualified, I think she should be confirmed. But if she is not qualified, as I don't happen to think she is, she should not be confirmed regardless of her gender or ethnicitiy.

Hey Mike in Syracuse,

In "her disgusting reverse discrimination ruling on New Haven firefighters," she was applying the law, not deciding whether New Haven's decision was good policy. A judge often has to affirm policies they disagree with when those policies don't violate the law. Do you know what they call it when a judge disregards the law and instead bases their ruling on what they personally think is the best policy? Judicial activism.

By the way, would you have the same critique of her if she were a white man?

Sniffit   May 27th, 2009 11:51 am ET

Dear fellow libs: do not damage our position here by referring to the Court in any way as having ANYTHING to do with "representation." We have a brach of government designed for that...the Legislative Branch. The Court is supposed to be insulated from all public opinion and political concerns and the SOLE concern is the qualifications of the individual as a legal scholar and judicial analyzer. Focus on that. Sotomayor is MORE than qualified, but it has NOTHING to do with her genitalia or her ethnicity.

Dennis   May 27th, 2009 11:50 am ET

The large ratio of her rulings which have been reviewed and overturned by the supreme court, indicate that she is an inappropriate candidate for the supreme court.

ThinkAboutIt   May 27th, 2009 11:44 am ET

Of course Rush Limbaugh wants President Obama and Judge Sotomayor to fail! The more they succeed, the more apparent it becomes what a failure Rush and his ilk truly are.

Think of what Rush has to lose as Obama and his Administration succeeds: Who will listen to Rush the Bloated Windbag (or pay his exorbitant salary) when everyone realizes that it has been and always will be people like him who tear society apart and do absolutely no good, with their egocentric, nonsensical rantings?

How will Rush get his fix without his oxy and his drooling followers? He will positively explode from frustration.

jerry   May 27th, 2009 11:44 am ET

This idiotic, why is everything about race?! This sad, angry, hate-filled conservatives always fail to mention the fact that she was first confirmed to federal courts by senior George Bush and then by Clinton. She has more federal court experience than both John Roberts or Samuel Alito before they were confirmed to Supreme Court . And they failed to mention that close to 99% of her rulings have been upheld by the S. Court. Now that an African American prez confirmed her most of you silly cads are whining. So i will end by asking you not to hide your hatred behind a political agenda and go join the Skinheads.

CitizenJane   May 27th, 2009 11:43 am ET

Hey GOPers. Try as hard as you like, the race card isn't going anywhere – - – the only people throwing it out are the racists themselves.

Butch, having trouble with your own christian morals, are you, else why question others christianity?

Super D   May 27th, 2009 11:43 am ET

The CNN commentary on her true qualifications was enlightning.

I have to agree. This is not based on merit. Obama wants to practice affirmitive action on the court, and this is race based politics. Pretty sad, but what can you expect from our trainee president.

The best legal minds belong on the High Court. Soto is not one of them.

Teena   May 27th, 2009 11:43 am ET

hey Butch–sorry to inform you that the republican party DOES NOT have the corner on Christianity–there are plenty of Christian democrats!
So, stop the narrow-minded thinking please!

JT   May 27th, 2009 11:42 am ET

By 'Fine Line' is the GOP referring to Truth vs. Lies?

People, research Sonia Sotomayor's impressive resume for yourself. It is readily available. Fact is – she is incredibly well qualified. Rush Limbaugh, Huckabee, Romney, and Pat Buchanan are playing the low-info crowd for easy marks.

Look at Sotomayors education, experience, and character compared to these tools and the other Supreme Court members. The GOP is clearly lying with racially and sexist loaded comments about her education and qualifications. These comments have already backfired on the GOP in a bad way.

lulu   May 27th, 2009 11:41 am ET

The GOP does not need to "walk a fine line" in opposing her. She is racist, her views and rulings have been condemned by others familiar with them, while others have labeled her as not too bright.

Oh heck, what was I thinking? He needs someone on the court to cover his butt if that pesky birth certificate issue reappears.

david, CA   May 27th, 2009 11:41 am ET

Here's hoping the GOP faithful follow Rush et al into the sewers of hell where he seems bent on making his permanent home.

RealityKing   May 27th, 2009 11:41 am ET

Sotomayer – “Um, all of the legal defense funds out there, um, they’re looking for people out there with court of appeals experience, because court of appeals is where policy is made. And I know, I know this is on tape and I should never say that because we don’t make law, I know. Um, um — [laughter] — I know. I’m not promoting it, I’m not advocating it, and, I’m … you know. [laughter]”

SNL skit anyone??

JA/TN   May 27th, 2009 11:40 am ET

we are edging toward true representation of America's diverse population

Mari   May 27th, 2009 11:40 am ET

*************ONE MORE COMMENT PLEASE CNN******************

@ Romney 2012........ "racist"??! REALLY? SO....... having ONLY one minority, Clarence Thomas, and ONE woman, on the Court represents America??

Choosing Sotomayor (who was placed on the Federal bench by none other than George H.W. Bush!) balances the Court! We are a Nation of diversity!

Why do you oppose a woman who is Hispanic? She is well qualified, indeed much better qualified than Bush's pick, Harriet Myers!

Why is it that when a minority is chosen the GOPers all cry RACISM??? ARE YOU A RACIST?

ThinkAboutIt   May 27th, 2009 11:39 am ET

Judge Sotomayor looks good so far, but will wait for the confirmation hearings to make my final assessment. Hopefully, the Senators will do the same.

gmoney   May 27th, 2009 11:39 am ET

How wonderful is the goodness of our lord in heaven. He can do anything. James 1/17. Congradulation judge sonia sotomayer. Congradulation again on your nomintion.

Tom in Wheaton, Illinois   May 27th, 2009 11:38 am ET

I used to occasionally vote for a Republican in non-presidential elections, but you idiot right-wing, born-again posters to this site have made me think I never will again. The Republican Party (with the possible exception of Colin Powell) has become the party of reactionaries and fear-mongers. If this keeps up, after the 2010 election, they will become almost totally irrelevant in national politics.

nick   May 27th, 2009 11:38 am ET

Is it possible for the Republicans to get a more distructive voice?
R. Limbaugh is a one-man wrecking crew. He is doing more damage to his party, then Nixon did. How can he hope to succeed with his messages of hate, fear, racism, and failure. I can´t believe that responsible, elected, Republican Congress and Senate members do not speak out forcefully against this vile man.

doug   May 27th, 2009 11:37 am ET

Why does cnn still post what rush limbaugh says?? He is not relavant. If i wanted to hear what a junkie had to say, i would talk to one wandering the streets of downtown akron. Ughhh why did i waste my time commenting about him? I am just gonna go talk to one of the junkies, I am sure they have somehting more productive to say.

Cardinals Fan   May 27th, 2009 11:37 am ET

Jeff,

Dont you have a tea party to attend?

All you guys have is teabags, teleprompter jokes, and mustard.

Mike from Iowa   May 27th, 2009 11:37 am ET

Forgive me... I was speaking of Rush Limbaugh

Mike, Syracuse, NY   May 27th, 2009 11:35 am ET

Yes, she has had a lot of experience, which didn't seem to matter so much to Obama supporters who elected him. Of course 75% of her rulings appealed to the Supreme Court have been overturned, and her disgusting reverse discrimination ruling on New Haven firefighters will be overturned. Those who have been in her court have come away less than impressed by her legal mind. But hey, she fills the woman and Hispanic quotas, so it she must be OK.

tinu   May 27th, 2009 11:35 am ET

Republicans want the right to destroy america themselves? Somebody show the failing limbaugh a stock ticker please. Also explain the reversal of recession that his nemesis, the POTUS has unleashed upon us. I have a growing conviction that Limbaugh is Ahmedinijad's long lost brother.

Mike from Iowa   May 27th, 2009 11:35 am ET

For all you Republicans who sincerely care about your party and wish to advance its cause........
Who are true Americans and believe in the voting process,

PLEASE figure out a way to stop this hate monger.

Sniffit   May 27th, 2009 11:35 am ET

Walks a fine line? Seriously, the hyperbole involved in taking out-of-context soundbite-style quotes and misrepresenting them as 100%indicative of someone's entire career and judicial philosophy is fairlly sickening. And saying "we're going to be 'fair' and use the 'wait and see' approach" out of one side of their mouths, all while releasing a talking points memo via email that reads like their playbook for no-matter-who was nominated and having every potential 2012 nominee release a statement designed to prejudice their base and the public PRIOR to the hearings and any real factual analysis has taken place...well, I really don't see how that's walking a fine line. More like they're on a shortbus headed towards a brick wall and someone forgot to strap them all into their helmets.

Laverne   May 27th, 2009 11:35 am ET

With the high hispanic population in Arizona, I betcha John McCain won't oppose her nomination as well as senators from New Mexico, Texas and other heavily hispanic populated states.

ROMNEY2012   May 27th, 2009 11:34 am ET

This was a racist pick, pure and simple. In addition, it secures more votes for Obama. The rest of the country? The majority of us that are affected by Supreme Court decisions? Well, you're on your own...Obama got his, hispanics got theirs.....Change you can believe in....that'll screw you every time!

demwit   May 27th, 2009 11:34 am ET

why so much hate from CNN viewers??

Charles W. Skinner   May 27th, 2009 11:34 am ET

CNN needs better proof-readers. There is no 2010 Presidential Election.

"Potential 2010 presidential candidate Mike Huckabee . . . ."

"Another potential 2010 GOP candidate, Mitt Romney . . . ."

once upon a horse   May 27th, 2009 11:33 am ET

haha Rush Limbaugh calling another person a racist is like "Joe the Plumber" calling somebody an idiot. I figured that if ONE GOPer would come up with something negative about her it would be Rush and low and behold he had to go and play the "race card"! I have to say though I hope if qualified that she is confirmed and the HC will start to look more and more of what America DOES look like.....in spite of Judge Thomas being there.

Doug, New Jersey   May 27th, 2009 11:33 am ET

Mike, Rush is going to heaven because he is an honest man who has had a positive impact on mankind. As for you, just from your dishonest attack of this real partiot, I'd really change your liberal ways before you meet your maker. I believe god judges us on how we treat others, if that is true you certainly don't want to be a and answer for acting liberal Democrat.

Jonita   May 27th, 2009 11:33 am ET

Rush Limbaugh is not fit to speak her name. She is Brillant and he is a draftdodging/Drug addict...

Film Professor   May 27th, 2009 11:33 am ET

Hey, keep at it Rush, you windbag. Every person who is not a white male right-wing nutjob like you is finding a home with the Democratic Party.

106 of the 110 people who have been Supreme Court justices have been white men, btw, including the 2 that Bush appointed. I am also a white male, but find this statistic appalling.

And guess what, Rush? You guys lost the election, and you are going to keep on losing elections into the infinite future, so you are just going to have to get used to the idea of more women and more minorities being represented on the SC. White males do not have a birthright to be nominated for these positions.

Glenn   May 27th, 2009 11:32 am ET

As a middle aged white male, I personally think it's an excellent choice. The highest court in the land should be made up of representatives of many ethnic cultures, not just older white candidates. If you have multiple comparatively qualified candidates, there is no issue with choosing a candidate that represents the cultural and ethnic diversity of our nation. After all our pledge of alliegence does finish with "And Justice for ALL". For much too long a period of time the high court has had a decisively caucasian flavor. How can you say that the high court is fair and balanced unless there is some representation from different ethnic cultures. What one justice may rule as "animal cruelty" another may rule as a observed religious practice based on their experience and intrepretation of the law. That is what I thought the Supreme Court was for, intrepretation of the laws of the land in a manner that is fair to ALL people. Anyway, Congratulations Judge and Good Luck with the confirmation process!

TCM   May 27th, 2009 11:32 am ET

RUSH IS THE MAN! You libs hate him because he speaks the truth....we don't need a bleeding heart liberal with a sob story background for a SC judge; she's only there to secure future hispanic votes for Obama...her record sucks.

@ RANDOLPH CARTER – kudos to you for recognizing criminal activity in the White House....once the country is completely destroyed, I believe it should be divided; liberals on one side and conservatives on the other....physically seperated. Why? Because the conservative side will survive and prosper and the liberals? They'll keep praying (oh, I forgot, no praying allowed) to idiots like Obama...to save them because they're totally helpless.

JC   May 27th, 2009 11:31 am ET

I wish Limbaugh would just choke on a ham sandwich and get it over with. What a relentless hypocrite!

Fair is Fair   May 27th, 2009 11:31 am ET

Sotomayor should be question on her "policy making" comments during confirmation hearings. Those comments are clearly against the separation of powers outlined in the Constitution – which is the very document she is supposed to be using as the basis of her decisions if appointed to the SCOTUS.

Policy making is the function of the legislative branch. The senators on the judiciary committee should realize that such comments undermine the power of their branch of government.

Doug, New Jersey   May 27th, 2009 11:30 am ET

It's funny how all I have done is quote the words said by Democrats and are the beliefs of at least 98% of Democrats, but CNN finds them too racist to post on the ticker.

So just read what libs are saying about people like Thomas, Rice, and Steele. Those race based personal attacks are not racist, but honest factual conservative posts about sotomayor's decisons, her own words, and her beliefs as shown from her comments are completely racist and hateful.

I support gay marriage and a lot of other lib issues but the dishonesty, hate, double standards, and divide and conquer race mongering of the left makes anyone with even just a small amount of morals, values and decency run from the Democratic party. They really are as nasty and evil as they come off on the ticker, come visit a blue state and see for yourself.

Al-NY,NY   May 27th, 2009 11:30 am ET

He will surely do his best to portray any republican who even considers her for confirmation "not a conservative." Good. That fat pill-popper is a disgrace. Let him and his "pure" party wallow in the darkness which they surely will

Butch   May 27th, 2009 11:30 am ET

Hongli...

I didn't know liberals prayed? Maybe you were praying to yourself in the mirror? It is the Obama way, after all.

keekers   May 27th, 2009 11:28 am ET

Rush the GOP leader has spoken, what else needs to be said?

Jeff   May 27th, 2009 11:28 am ET

Mr Hornick,
The next presidential election is 2012 not 2010.

Mike   May 27th, 2009 11:28 am ET

Rush is anti-American. He wants our president to fail because he's not s republican. To hell with American, Rush. It's all about you and your party. let the peopel suffer as long as your happy. You are an idiot who, on his judgement day, is in for a big surprise. I'll give you a hint, Rush. When you are burried, dress light.

hongli   May 27th, 2009 11:25 am ET

I'm praying night and day for Rush Limbaugh to be left penniless and broke. One day my prayer will be answered and this idiot will feel the pain of distruction.

JM   May 27th, 2009 11:24 am ET

Rush is nothing but big fat, blowhard and an abomination (exceptionally loathsome, hateful, wicked, or vile).

Randolph Carter   May 27th, 2009 11:23 am ET

Actually, nominating Sotomayer was a very shrewd move on Obama's part. The republicans will look like idiots no matter what they do and Obama gets more Latino support while keeping the court balanced. Well played, sir. Have a nice day!

Gravitas   May 27th, 2009 11:23 am ET

I want Limbaugh to fail.

GPM   May 27th, 2009 11:22 am ET

Republicans should do themselves a favor and vote to confirm her quickly. The last they need is a backlash from Hispanic voters in the 2010 election cycle. With her qualifications and resume it's hard to imagine legitimate opposition in the Senate. They should save their amo for a fight they can win.

Billy J in Texas   May 27th, 2009 11:22 am ET

She is going to be great! And on a side note... Ilya Shapiro is a tool.
