WASHINGTON (CNN) - Senate Republicans will not attempt to filibuster the nomination of Judge Sonia Sotomayor to become the first Hispanic Supreme Court justice, a Republican senator said Wednesday.

"You will get that up-or-down vote on the Senate floor," Sen. John Cornyn, R-Texas, said to Sotomayor on the third day of her confirmation hearing by the Senate Judiciary Committee.

Cornyn and other Republicans on the committee have criticized Democratic filibusters of previous judicial nominees by Republican presidents. The Democratic filibusters prevented a full vote by the Senate.

Facing a filibuster-proof 60 Senate seats in the Democratic caucus, Republicans have said they expect Sotomayor to be confirmed by the full chamber.

GOP knows that filibustering wont do them any good with the latino votes in future elections.

Josh Maloney   July 15th, 2009 12:38 pm ET

Republicans have no one to blame but themselves for the imminent Filibuster-proof Senate. Its too bad the Democrats don't have a viable party to challenge their agenda. All the Republicans can do is complain, insult people and drive a wedge through this country. Wake up, Conservatives and challenge the Democrats with viable alternatives to our country's problems. You need to help find the best solutions that work for as many Americans as possible and stop worrying about your 2010 and 2012 prospects.

Robulous529   July 15th, 2009 12:26 pm ET

The GOP is absolutely, unequivocally impotent to stop the appointment so perhaps reality is finally setlling in with the likes of Sen. Cornyn.

GOP showing more maturity than the dems did during the Bush years.
------------------

That's really funny, but WRONG. It's called, GOP knows they cannot stop the inevitable so they have no choice and don't want to risk angering the hispanic voting bloc. Nice try tho.

Kevin B   July 15th, 2009 12:23 pm ET

A fillibuster would ensure the GOP shrinks to even less than the current freak show constituency of conspiracy theorist and right wing america hating nut cases.

So go ahead and please fillibuster, I dare ya..........

citizenjane   July 15th, 2009 12:18 pm ET

I see all the GOP aliases are in full force today.

It doesn't matter what the GOP does or doesn't do. Sotomayor is a shoe-in. Kudo's to her for maintaining her cool during these hearings.

svs   July 15th, 2009 12:15 pm ET

Uggh. As an independent, I find it frustrating that the two parties will fight to the death (and eventually become polarized into inaction) over the subjects that could most benefit Americans, in general, meanwhile, they lay down and quit whenever it's something that warrants real, in depth consideration.

Dems were right to filibuster several of GWB's appointments, and conversely, the GOP needs to do the same with Sotomayor. These SCOTUS appointments are too important.

Maybe this woman is the right candidate, but I, for one, am in no way convinced that she will not attempt to legislate from the bench, as of yet. She may not have a voluminous history of doing so, but the few cases and public comments in question are enough to warrant continued debate.

Turnabout is Fair Play   July 15th, 2009 12:14 pm ET

That's right Republican fools! Eat it! You KNOW that you idiots cannot stop her from being nominated so you have NO choice but to bend over and take it. She WILL be our next Supreme Court justice and she will steer the court back to the left. Just as it should be.

Peter   July 15th, 2009 12:12 pm ET

Just happy I did not have to hear the rich white trash Ted Kennedy blather on during this confirmation.

What scares you most about that...the taxes they will be contributing once they become citizens or the fact that they'll be entitled to minimum wage so they won't be able to "take jobs away from the 'real' Americans" by undercutting on wages?

What, no "nucular" option this time? Republicans know they do not have the votes against a well-qualified nominee, and some of their members could likely vote in favor of Judge Sotomayor to the Supreme Court.

TCM   July 15th, 2009 11:40 am ET

this falls in line with Obama's agenda to change the constitution....Americans will soon regret the day they voted for this fraud. His planting of a puppet on the SC, merely because she's a Hispanic, and nothing more, is an insult to all Hispanics...it's like Obama's saying, "...We'll accept her, and her dismal track record because it aligns with Affirmative Action..." Hispanics should want her to be the best judge possible, plain and simple. Whether you're male or female, black, white....should be immaterial. This is what this country deserves after electing and supporting someone who cannot get through a complete sentence without a teleprompter or some sort of spoonfeeding....pathetic....

The"latina" comment was understandable. But it was coming from a latino woman minority who strugled unlike rich white boys who live in a bubble. The perspective is different, she has live and seen and experienced things that the rich white boy hasnt so obviously she has the first hand knowlege to make better decisions,

worriedmom   July 15th, 2009 11:38 am ET

who cares anymore. this was a done deal and these hearings are a waste of time. Obama and his thugs will threaten anyone who stands in their way. Isn't that what he is now doing with Democrats who don't want to push through his half-a– health plan. Again why the rush of having it before August so people can go on their break! Look, folks we are working hard to support our families and if we need to work longer than so be it. It is time for us to stop this rushing of Congress so they can go on their vacations and say they did something. No one has done anything since January to help us!! Things have gotten worse and all you who still defend your Chosen Leader, I feel sorry for you because you will be so disappointed when your new tv, rent paid for and you can sit on your tail end all day checks don't come thru and you were taken advantage of.

. . .

I have never been so ashamed of my government and the apathy shown by many Americans.

Sad when the ONLY country in this hemisphere to show TRUE commitment to a correct-form of governing is Honduras.

johnnie   July 15th, 2009 11:34 am ET

The (GOP) is a disgrace to the american people, to even suggest or even think of a (Filibuster Proof 60 seat Senate) is political abyss.Judge Sotomayor is so qualified ,for (Supreme Court Justice) and am appalled by the way (Sessions) and that (arizona senator) who name is not worth mentioning, have conducted themselves. First of all, they have no manners when comes to a lady, they show (No Class) and are making this hearing more about the (President). It is guttless, and shows how bitter the GOP is ,about President Obama. They will suffer more pain , in their (No Win Party). American showed proof in this last election,we have come a ways, and we are not going backwards, like the (gop) would like. I predict ,that Judge Sonia Sotomayor will be confirmed by a landslide, the republicans know that their power base is obsolete, and are in the wilderness of politics, and to vote against this appointee, is more damage to the (Party of No). Judge Sotomayor was fantastic yesterday, and showed the (gop) she could stand up to them with power. America should be proud of our country to see its (First Latina Supreme Court Justice).

GOP = Party of Tolerance   July 15th, 2009 11:34 am ET

Cornyn and Graham are trying to provoke a meltdown but it doesn't seem to be working. Why fight a such a well-qualified nominee? This just makes the GOP look like they don't want Hispanics in the party.

david, CA   July 15th, 2009 11:33 am ET

so, Republicans still want credit for not filibustering because they wouldn't be able to anyway because they face a filibuster-proof democratic majority?

that sounds about right.

awaitingliberalizationbyCNN   July 15th, 2009 11:31 am ET

Thats good to hear. They should not play the same type of obstructive politics of personal destruction that the liberals play. Unfortunately, being liberals they will not learn by example and will be back to their whiny ways when the republicans are back in power in 3 years.

Proud Member..Party of No   July 15th, 2009 11:27 am ET

The republicans are spineless. They should do whatever it takes to keep her out. She is the poster child for what is destroying this country...political correctness. In the democrat's world it's not who is the most qualified person, it's who is the most politically correct. And then the same people wonder why the country is going downhill............

buckwheat   July 15th, 2009 11:24 am ET

As a Republican I see only bluster and hot air from the Republicans. We should cede the US to the Hispanics ,especially California because it is broke from paying welfare and the effect of crime, and be done with it. The rest of us can go on government assistance and watch this plane take off. If we think we need a Hispanic thinking government or an African or a Russian thinking government ,or whatever , we should shop around and pick the best one we can find and remodel our Constitution after it. I wonder why people keep busting their ass to get here to this hated, unwanted government that has done so much wrong.

Sam Sixpack   July 15th, 2009 11:24 am ET

Hey, how come I can comment on this nonsense but you deleted the hundreds of negative comments about the great health care robbery now in progress?

Do you really want the government to decide who can and can't afford to give all their money to fat, greedy, rich insurance execs?

notfooledtx   July 15th, 2009 11:20 am ET

Finally, the republicans are coming to their senses. After the disgusting spectacle they've put on the last couple days, I think they should cut their losses and press on. Her confirmation is all but assured.

Jeff Sessions has been an abyssmal embarrassment to their party.

Mike   July 15th, 2009 11:20 am ET

Took long enough already...

Joseph   July 15th, 2009 11:19 am ET

No need replicate what the democrats have been doing for the last 8 years and filibuster ever appointment they find distasteful. Sotomayor is unqualified (just like OBAMA) and has outright lied the last two days about her record but Cornyn is right we do not need to stoop to their level and waste time and resources.

John Black Hills/SD   July 15th, 2009 11:18 am ET

Republican senators will approve Sotomayer to sit on the Supreme Court, but not before exercising their jaws so their constituents can see that they're more than an Armadillo rolling with the majority for approval. More child like than a group of accomplished DC politicians. I suggest representatives watch their time in the frame of a camera to find the reason why Americans have replaced the used car salesmen, with politicians as the sticky substance on the bottom of your loafers.

RR   July 15th, 2009 11:15 am ET

GOP showing more maturity than the dems did during the Bush years.

Aunt Bea and Opie   July 15th, 2009 11:14 am ET

Thanks John, thats mighty big of you since over half of Texas is now hispanic and you can only pull 2% of their vote.See what happens when a Texas redneck tries to spell "corn".Maybe they should have changed their name to corny. His days in the Senate are numbered, but he can always get a job as a spoksperson for big oil and gas.

Larry   July 15th, 2009 11:11 am ET

I know Republicans are stupid but......

What would a filibuster accomplish?

Republicans are such an example of desperate people losing all their influence in government!

Dutch/Bad Newz, VA   July 15th, 2009 11:11 am ET

Confirm her already. She's proven to be over qualified fo the job.

James M. Holmes   July 15th, 2009 11:09 am ET

How nice of them... now maybe they can stop fillibustering EVERYTHING else?

The fact of the matter is they would fillibuster Sotomayor if they had the numbers, but they know that all the Democrats and a few Republicans (who aren't stupid enough to play to the racist right-wing base) are voting for her and the fillibuster would go down in flames AND for political reasons, the Dems would LOVE for the GOP to try and fillibuster this nomination...

Nothing newsworthy here... just more GOP grandstanding...

Mark   July 15th, 2009 11:08 am ET

Republicans have no leg to stand on anyways... the Republican party is a dead party of white establishment.
