WASHINGTON (CNN) - The ranking Republican on the Senate Judiciary Committee announced Monday that he will not vote to confirm Judge Sonia Sotomayor for the Supreme Court.

In an op-ed published in Monday's USA Today, Sessions concedes that Sotomayor "will likely be confirmed." But the Alabama Republican says that "as someone who cares deeply about our great heritage of law, I must withhold my consent."

Sessions says he had decided not to support Sotomayor because of three decisions he finds troubling: a 2006 private property decision, her 2008 New Haven firefighters decision, and a 2009 decision about gun rights.

"These rulings have three things in common," Sessions writes in the newspaper. "Each was contrary to the Constitution. Each was decided in a brief opinion, short on analysis. And each was consistent with liberal political thought."

Sessions is the third Republican on the Senate Judiciary Committee to announce his opposition to Sotomayor. He joins Utah Sen. Orrin Hatch and Texas Sen. John Cornyn. South Carolina Sen. Lindsey Graham, another Republican on the committee, has announced he will vote for Sotomayor. The committee is expected to vote Tuesday on Sotomayor's confirmation.

Exactly! Sotomayor has attempted to justify her racial bias as "empathy," but the bias alone is sufficient to disqualify her as a Supreme Court justice.

Does this therefore apply to all Supreme Court Justices who dissent on any decision made by the Court? According to Sessions, a dissenting Justice would also be against the Constitution.

So two reasons he is not voting for her is based on two decisions where if she ruled how Sessions wanted her to rule, it would have been legislating from the bench/judicial activism. This is also something Sessions has claimed he is against in the past.

I also wonder why Sessions is so offended by the concept that a hispanic woman might, just might, come to a better decision than a white male. I mean the remark made by Sotomayer was a bit "stupid" one to make the way it was phrased and deserves criticism; but Session sseems a bit too offended.

I applaud those who vote to not approve this candidate.
She is CLEARLY trying to make a statement as " A HISPANIC FEMALE" not a non-biased Supreme Court Judge. The Supreme Court is a final destination for many pleas and we should be able to be CONFIDENT that our plea will be Judged FAIRLY based on rule of Law – not a BIASED opinion based on a hispanic/female's twist of judgement. A rational individual would not make the outrageous comments sotomayer has been making in regard to her past decisions ( ie; the New Haven Firefighters) .

we assume he is a citizen and would want to see his Birth Certificate to clear every doubt about where the parent lived when he was born and while they have the same last name prior to their marriage.

I can't say that I am too surprised that Jeff Sessions is not going to support her, and I am certainly not surprised my silly senator John Cornyn isn't either. But I am a tiny tiny bit surprised that Lindsey Graham is. She will be confirmed, they only thing from keeping that is that today is Monday and not Tuesday. And even though the democratic caucus can vote her in with no GOP support, it would still be good to get as many votes as possible from her. Still, not surprised with Sessions, Cornyn, or McConnell for that matter. That's ok. They unknowingly constantly push away minorities from their party.

I am very disappointed in the lackluster whining of the Republican senators' response to Judge Sotomayor. Senators Sessions and Hatch show no respect for diversity in their defensive comments. Rather, Senator Sessions, particuarly, shows an unflattering Southern ethnic bias in his statement about withholding support for Judge Sotomayor. On the other hand, Senator Olympia's Snowe's enlighted response is thoughtful: "I was impressed with Judge Sotomayor’s comportment and obvious mastery of the law during this week’s nomination hearings. Her presentation reinforced what I learned about her during our meeting in June at which we discussed her judicial philosophy and view of constitutional interpretation -..."

Sessions wore it on his sleave. He had no intention of voting for Sotomayor. He just wanted to be front an center. And John Cornyn from my great state of Texas, well, he was just playing to his conservative base. I wish Rick Noriega would have beaten him during the last election. This is why we need to put term limits on all our Congressional Reps in Congress. Many of them start to vote not for what is best for People and Country but for themselves.
I am not surprised that he is not voting for her. The political system in the US is a joke now and while through the years we have always had political party viewpoints that were opposing, they would make sense. However since the days of Newt going forward the political structure in Washington has been in shambles. I think it is time for America to really visit term limits on all elected Officials. So if Sotomayor had gone against the current precedent in the New Haven case and ruled with the white fire firefighters she would be OK, but since she followed and respected the current law she is an activist judge? Sounds as if Session wanted an activist judge in the New Haven case but didn't get it, yet now he claims that is what he doesn't want for the Supreme Court. Can somebody ask him about this paradox? It's clear Sotomayor has more integrity in her pinky than Sessions has in his body.

This is just awful politics. George W. Bush appointed two justices and, with the exception of Harriet Miers (Bush cronyism at its worst), had them heard and seated with very little antagonism from democratic sentators. Now that Barack Obama has nominated a highly intelligent and qualified minority judge, the worst of the GOP is showing through yet again — fear, xenophobia and revenge politics.

How many thousands of decisions has Sotomayor made over the years? Sessions wanted to vote against her from the get go, and had to figure out a way to back up his position. Hatch and Cornyn caught flack for their shallowness in saying that their opposition was based on her speeches, while ignoring her judicial record. So Sessions picks apart her thousands of judicial decisions, and finds three that he disagrees with, to "justify" his superficial position.

The only reason Sessions opposes her is because she is an Obama nominee, and it's the Republican playbook to oppose all things Obama.

If G.W. Bush had nominated her in place of John Roberts to be Chief Justice a few years ago, Sessions and the other Republicans would have been falling over themselves to get her confirmed.

Citing three specific cases is just pure searching for reasons to try to give cover to what he had decided anyway.

And those who claim to be against her because of 'judicial activism' while complaining about the firefighter decision are hypocrites of the highest order. She has explained quite clearly how the decision the appellate court gave was driven by adhering to established precedent and the overturning was the higher court establishing new precedent. She was in the position of judicial restraint in that situation.

Why wouldn't these Senators vote for Sotomayor? Her record is stellar and shouldn't base their vote on the decision of 3 cases. The fact that she explicitly stated she will follow the rule of law and abide by the Constitution and her life and career experience make her one of the most qualified for the Supreme Court. She will be a very refreshing voice in the ever increasing ivory tower most of the justices are in. Sotomayor will be confirmed easily. I am very proud of the 2 Republicans from my home State of Maine who will be voting for Sotomayor. Obama made an excellent choice.

The vote should be based on each senator's judgement. If this is what he believes and how he feels then he is doing the right thing. She will likely be confirmed anyway.

Congress has to get away from making political votes and make more principled votes. If every congress person actually read the bills they were voting on and voted their principles, things would probably be better. Earlier this year the so-called stimulus bill was voted without anyone reading it and completely along party lines. I think a search of their hearts and reading of the bill could have saved us a trillion dollars in additional debt.

As long as Sotomayor gets confirmed, thats all America cares about. Like the lame GOP ,all Sessions cares about is grand standing. His reasons for confirming No to Sotomayor has no substance and is very vague. He doesn't really speak well. He has a southern twang slang dialect.

Wow! Sen. Graham is the only republican on the judiciary committee who will vote for her. That says alot for the GOP. And sen. Sessions not voting is not surprising. I fealt he had animosity toward Judge Sotomayor the entire time.
