WASHINGTON (CNN) - The U.S. Senate on Thursday confirmed Judge Sonia Sotomayor as the first Hispanic justice on the Supreme Court.

Sotomayor was confirmed in 68-31 vote. Nine Republicans joined a unanimous Democratic caucus in supporting her nomination.

The 55-year-old federal appeals court judge will be the 111th person to sit on the high court, and the third woman justice.

I am so tired of listening to the Republican arguments about legislating from the bench in attempting to undermine this appointment. The fact is judges frequently legislate from the bench whether they are liberal or conservative. The current Supreme Court just overturned the decision of the City and two lower courts, who were following precedent, in the Ricci case to change the long standing law of the land. Justices Roberts, Scalia, Thomas and Alito legislated from the bench in this case and others, but Republicans are in support of their actions because it changes law to meet their political position. Judges decide cases and create law when unique facts don't fit neatly within the statute or precedent as written. If the current conservative court of Roberts, Scalia, Alito and Thomas get their chance to change the law of the land as they want, many of the basic rights and freedoms that we have come to know will be gone in very short order.

Several weeks ago, I predicted she would get 68 votes. I later revised my guess upward to 72, but I should have stuck with my first instinct.

VERY slowly we are starting to see the Court reflect the people it represents. If this Court were a true representation of the American people, then we would see roughly 50% female justices. And we would see black, white, Hispanic, & Asian representation for sure.

But as long as the justices are fair & impartial & interpret the law as written, then hopefully we will be on the right road.

I do think it odd that the very same woman the Republicans pushed hard to get seated in her role in the lower court has now, apparently transformed herself into someone that all but 9 Republicans are dead set against. Sorry folks but Sonia Sotomayor is not the first Hispanic justice on the Supreme Court. That honor goes to Benjamin Cardozo, a descendant of Portuguese Jews who immigrated to America. He served on the Court from 1932 until his death in 1938. Although today's Hispanics may, for political reasons, want to identify Sotomayor as the first Hispanic, Sonia Sotomayor may only lay claim to being the first woman Hispanic on the Court.

Until the day when the NRA is gone, and the 2 Amendmend is amended to not allow any fool on the street to carry a gun, I will have to dream.

I am the white/old/businessman/ex republican who thanks God that someone like this can start with nothing in this country and go to the top. so all those archie bunkers out there-I want there names to be shown to the world at every election. ITS TIME to stop politics and think of our country first. We have these human behavior studies on ethic groups then when one climbs the ladder archie tries to stop them.
