WASHINGTON (CNN) – Former Vice President Dick Cheney had his facts wrong when he blasted Attorney General Eric Holder last week for launching an investigation into past CIA interrogation techniques, an administration official asserted Monday.

Holder's decision to review waterboarding and other enhanced interrogation techniques was politically motivated, Cheney claimed in remarks broadcast on FOX News Sunday. Cheney made clear in the interview, conducted last Friday, that he believes President Barack Obama directed Holder to launch the review in response to pressure from left-wing Democrats.

But the administration official, who asked not to be identified, said, "The attorney general made a determination independently, based on the facts and the law."

The official also objected to Cheney's statement that "the president is the chief law enforcement officer in the land."


"That's not true," the official replied. "It's the attorney general."

During his FOX interview, Cheney repeated his past defense of the effectiveness of what are called enhanced interrogation techniques, or EITs, such as waterboarding.

The techniques "were absolutely essential in saving American lives and preventing attacks on the UnitesdStates," Cheney said. "I think they were directly responsible for the fact that for eight years we had no further direct attacks on the United States."

In response, the official noted that a recently released 2004 report from the CIA's inspector general concluded that "the effectiveness of the enhanced interrogation techniques are hard to measure."

The official highlighted a page from the report stating, among other things, that "measuring the effectiveness of EITs, however, is a ... subjective process and not without some concern."

The official also noted a separate conclusion in the report that "the effectiveness of particular interrogation techniques in eliciting information that might not otherwise have been obtained cannot be so easily measured."

The official also took issue with Cheney's assertion that a new interagency group tasked with overseeing terrorist interrogators will spend the bulk of its time deciding "who gets to ask what question and who's going to mirandize the witness."

"Mirandizing" refers to the process of informing an individual of his or her rights under the U.S. Supreme Court's 1966 Miranda ruling.

The primary goal of the High Value Detainee Interrogation Group, or HIG, will be intelligence collection, not law enforcement, the official said.

The group will be based out of the Federal Bureau of Investigation, which, according to the official, currently mirandizes less than 1 percent of detainees.

"That will be the same practice" with the new group, the official asserted.

Actually every US citizen has the right to an attorney, right to be heard, or any other such right. Sorry but Cheney is no more criminal than any other VP over the last 100 years. It Kills me that republicans are always saying that Cheney and the Bush Admin. kept America safe from attack for 8 years as if Sept. 11th never happened on their watch. And from all accounts, it wouldn't have happened at all if the 'we kept america safe' crowd had been a little more attentive to all the reports about a possible attack on american soil by bin laden. However, the republican crowd would, have, and is overlooking this crucial aspect of their totally lack of competence of an administration. Maybe if Cheney and the war mongers would have been so alarmed about a possible attack and DOING something about it BEFORE it becomes a reality instead of reacting stupidly by torturing and everything else after an attack, then its possible that we wouldn't even be having this discussion in the first place.

Regarding the staffer's statement on the "chief law enforcement officer", he is wrong. The president is the chief law enforcement officer under the constitution. The executive branch is charged with enforcing the laws. The president is the head of the executive branch. The attorney general is appointed by the president. Even if the president were to delegate 100% of the enforcement responsibility to the attorney general, he still has the power to remove the AG at any time. Whether he's involved in the day-to-day or not, the president is still the chief law enforcement officer, by the very nature of his position. It's really not debatable.

One cannot be a Law Enforcement officer unless they have the power to arrest or prosecute. Mr Obama has only the power to make a citizens arrest. He can order troops into battle, sign laws into effect and administer the business of the executive branch. Cheney continues to insist that "advanced interrogation techniques" (read, torture) "protected the country" and cites the fact that we weren't attacked between September 12th, 2001 and the end of the Bush presidency as proof. There's one major flaw in that argument; namely, correlation. More simply put, terrorists may have chosen not to attack for any of a number of reasons besides the fact that U.S. officials tortured terrorism suspects. It could just as easily have been lack of planning, lack of money, lack of desire, or any of a number of other things that kept terrorists from attacking. But I'm sure that if we torture them they'll give us a reason...probably a false one.

One has to to wonder why Cheney, who during his term of office tried to keep the Congress and the American people in the dark, is now trying to defend his actions. The answer is simple. He is the most contemptible, corrupt, traitorous, and dishonest person in the country who sneers at the Constitution and the principles on which it was founded. I pray for the day that I see him on television (probably not on Fox News) being led away in handcuffs and shackles doing the "perp walk".

Yes, I'm sure this investigation has absolutely NOTHING to do with Obama's plummeting poll numbers.

I'm sure it has nothing to do with the plummeting poll numbers of his healthcare takeover.

I'm sure it has nothing to do with the fact that republicans are polling at least five points higher than democrats on a generic congressional ballot... in which respondents have said they trust the R's more than the D's on a nearly every issue on the poll INCLUDING healthcare. Republican advantage on healthcare is a first, and it's a very telling piece of information about where registered voters are right now.

I'm sure this investigation is certainly not a glittering distraction, a red herring, a tail wagging the dog, to distract the public from their once-in-a-lifetime-level of voter outrage against this administration.

The administration official who said that the Attorney General is the chief law enforcement officer of the land is wrong. It is the President. There is more law enforcement in the federal government that is outside the Department of Justice than there is in DOJ. As a practical matter, the Attorney General has (and must have) independence to decide on how to handle major criminal investigations, but that does not make him the "chief law enforcement officer of the land."

However, none of this means that Cheney is right in what he has said. To the contrary, he is wrong on this issue, just as he has been wrong on so many other things.

We should be thanking the CIA, not investigating it....if we do investigate, it should be a classified investigation to gather "lessons learned" only. Prior to the enhanced interogation techniques, Kalid Shiek-Mohammad gave up little information, and nothing forward looking. After 183 waterboardings and other enhanced techniques, he became a treasure trove of information that led to many additional captures and killings of terrorists.

Any way you look at it, but the democratic way, the techniques are a resounding success. No wonder why Obama has so much trouble, he has his own way to measure success.

Thanks Bush and Cheney, you are both true-blue Americans.

Given the utter devestation that the Bush Administration, with Cheney as second in command, wrought on the United States specifically and the world in general, the man has no credibility to speak of on anything at all. If he told me the sky was blue, I check for myself to be sure. Why would anyone given any degree of validity to anything he says now?

In addition to that, it is now becoming crystal clear that much of his conduct in his role as VP was criminal, illegal and immoral, so again, why would anyone take anything this man says seriously? His track record speaks for itself. He ought to be in prison, and if there is any justice to be had anywhere in the known universe, that is exactly where he will end up eventually. I'd like to know what was learned from these so-called enhanced interrogation techniques. The Bush/Cheney admin does not have a good track record of acting on known threats. (1)They had the NSA report of bin Laden determined to attack within the US, yet 9/11 was not prevented. (2)Their intelligence about Iraqi ties to al Qaeda and WMDs was all wrong. (3)They knew, along with anyone following the news, that hurricane Katrina was going to hit New Orleans, yet their response was tragically slow and inept. How many Americans– military and civilians–have died on the Bush/Cheney watch? It's beyond an apalling disgrace. It's criminal.

What does it matter whether you like or don't like Cheney? If he was the man-in-the-moon the issue he raises is what matters. If Holder wants to investigate he should issue a blanket amnesty to all parties involved, (except the prisoners). Find out the truth in an atmosphere in which no one has to fear that they'll be made a scapegoat. Doing so under the threat of terminations and prosecutions would destroy the morale and effectiveness of any organization

If Holder's decision is suspect then Obama gets to either keep him or fire him. If he keeps him, then Obama associates himself with the suspect decision and his motives are subject to suspicion as well. If you are suspicious of Dick Cheney then suspect him as much as you think is justified. But denouncing and dismissing Cheney has nothing to do with resolving the issue he has raised.

It's not just the fact that Cheney never served in the military; it's that all the archtects of the Iraq War – Bush, Rumsfeld, Wolfowitz, Cheney, Rove, and many of their most vocal supporters like Limbaugh – all found ways to "defer" from serving.

They didn't listen to General Colin Powell; Rumsfeld in particular, did not listen to the generals who told him that we would need a much larger force for the invasion and securing Iraq immediately after. They did finally come around to the notion that invading Iraq wouldn't be a "cakewalk," but not until things had totally gotten out of control and many thousands of lives had been lost.

It's the arrogance and ego, lack of understanding and seeming incapability to admit, let alone learn, from his/their mistakes – and not just his lack of military service – that makes Cheney and his cronies so despicable.

If Bush and the Republicans were/are so concerned about al Qaeda, then why did they ignore the August 6, 2001 Presidential Daily Briefing that explicitly stated that al Qaeda was determined to attack the U.S. using airplanes? The memo was entitled, "Bin Laden determined to strike in US."

Why did the Bush Administration ignore all the intelligence and information from the Clinton transition team about the threat from al Qaeda? And why did Bush let the capture of bin Laden become such a low priority?

Renaming prisoners of war "enemy combatants" is simply a word game that was used by the Bush Administration to exempt them from the Geneva Convention. Despicable, at best, and showing contempt for our military and legal traditions.

First Bush and Cheney fill the Justice Dept with cronies who make up law to support horrendous, ill-conceived policies such as torture. Then when they are seen to be doing illegal and unjust things (such as torture) they fall back on the cronies they installed. Isn't the Justice Dept supposed to be an independent branch of government? Is anyone surprised that when the Bush Administration was in power their justice department (lower case) absolved them of any wrongdoing?? Of course we should take another look at this with a real independent judiciary.

The President is Commander in Chief, which means he is the commander of the nation's military forces. It is by this statute that civilian control of the military is realized, as required by our Constitution.

Translation: We are not a military dictatorship; we are a representative government whose military falls under the responsibility of our elected president. (Who, of course, consults with the Chiefs of Staff and other military leaders when making decisions.)

By using the topic of water boarding Chaney has managed to keep the media from focusing on the more important issue: Why did the Bush administration ingoring the warnings they were given regarding Bin Laden?
For Chaney to say that waterboarding prevented attacks and offer as proof the fact that there were no further attacks is wrong. Bill Clinton could have made that same statement after the first attack on the Trade Towers which alos would have been wrong. Chaney is dilussional. He believes that the president is the law. I think "Bill" hit the nail on the head. Bush/Cheney were VERY deceitful in "defending" this country. I think they were defending their wallets first. Cheney is wrong when he says the President is the chief law enforcement officer. While that was his attitude when he was VP – and was the rationale for trampling the Constitution and breaking the law (similar to what Nixon believed) – it is not correct.

Eric Holder is the chief law enforcement officer.

According to Title 28 of the United States Code (federal statuatory law), Part II, Chapter 31, § 503, the U.S. Attorney General is the head of the Department of Justice, concerned with legal affairs and is the chief law enforcement officer of the United States government.

Cheney thought up the idea to circumscribe the UN conventions against torture, to which the US is a signatory; Cheney directed the CIA via then Director George Tenet to implement the rules on torture that Cheney’s lawyers had concocted; Cheney then ordered the CIA officers and contractors to use the most inhumane and shocking methods available to torture detainees, not to get information from them, because we all know that torture does not work, but, to punish them for having got caught and sent into US custody. It was irresistible for us and here we go for a second comment on Cheney's recent remarks about EITs. We believe he, either, is turning his Nelson's eye to the scientific reports, or, is plain oblivious of Peter Bergen's cogent and coherent articulation of the demerits of EITs as image destroyers for the US.

Abu Zubaida, and Khalid Sheikh Mohammed were waterboarded numerous times, but info. yield was pathetically negligible. They, by no means, contributed to the safety of the US. If Cheney wants to fantasize in his own world, that's his prerogative, but when he expresses his views aurthoritatively about the EITs, it does not wash one dang bit.

Torture was not the official policy of the United States in the Civil War, Spanish American War, World War I, World War II, Korea, Vietnam or at any time during the Cold War. Cheney had the courage to explain what the Obama Administration is really doing. Let me take it one step farther. Obama realizes he will have to abandon the public option in any health-care reform bill that might get passed. In order to placate the extreme Left, he is throwing them a bone in the form of the CIA investigation.
The other thing that Cheney has done is remind Obama that it has been eight years since we have had a mass casualty terrorist attack in the United States. If we should have such an attack, then Obama is going to have to explain why he was investigating the CIA when he should have been putting of all his resources to work pursuing transnational terror groups.
Obama is playing a very dangerous game here with very little upside for him or the country.

I could not disagree more with the former vice president but he is entitled to his opinion. In my opinion, the great men and women in our armed forces have done well in spite of the previous administration. Cheney deserves absolutely no credit for keeping the country safe as far as I am concerned. I think that Bush did the best he could considering all of the bad advice he got from Cheney, Rumsfeld and others. The only person who gave Bush any good advice on defending our great country was General Powell. Bush should have listened to General Powell.

They say he's wrong but the president appoints the Attorney General and can fire him. Also, the president is the Commander in Chief, the highest military authority in the country. He also oversees the CIA. If Obama wanted to protect practices that WORK, the would do it. He frequently asserts that the Bush/Cheney shady techniques kept us safe for 8 years. I don't understand why reporters hosting these shows do not follow up with how about 9/11/2001 Mr Vice President?

I guess Dick Cheney considers that time as under Bill Clinton's watch because Cheney and Bush didn't really get to work on terrorism until 9/12/2001. Up until then, their security meetings were focused on how to build the case for attacking Iraq.

No 9/11 terrorists was from Iraq. They were from counties like Libya, Jordan and Saudi Arabia. Iraq was attacked for Bush's greed for OIL. Sr. Bush attacked Iraq in 1991, which was also for OIL. But Sr. Bush did not accomplish mission in eliminating Saddam, which ultimately Jr. Bush Did.....These Guantanamo bay detainees, who were Waterboarded and Tortured by CIA, under Cheney's orders are very small fish. They belong to countries who are in poverty and not industrially advanced. These countries cannot even manufacture a dagger, leave aside sophisticated weapons. RUSSIA IS SUPPLYING WEAPONS TO AL QUIDA.....What has Bush and Cheney done to stop Russia from Supplying Weapons to Al Quida. Bush and Cheney cannot talk and adopt diplomacy, they only know how to war. BUSH AND CHENEY ARE WARMONGERS. But they cannot war with Russia. Russia it is too Powerful. 1) If waterboarding and other means of torture were/are so effective, then why did the Bush Administration discontinue using it in 2003? Did they suddenly think our country was no longer at risk?

2) Cheney claims that Khalid Sheik Mohammed provided valuable information regarding al Qaeda. While that is true, this information was provided before he was waterboarded; records show that no reliable intelligence was obtained from him after he was waterboarded.

3) The use of waterboarding created a rift within both the White House and the CIA, many of whose members resented the White House's (Cheney's) orders to use waterboarding and other means of torture. That truly demoralized to our intelligence agencies – when they could no longer trust that the head of our government would abide by the Constitution.

Thank goodness we elected President Obama, who is restoring integrity to the White House!

For those of you who support Cheney (last I checked it was well under 20% of the population) please remember you are in a vast minority. Most Americans understand that our country operates soley on the degree of fairness our justice system is based from. Of those rights, which we extend to foreign suspects as well, if we are to pick and chose when the rules do apply and when they don't based on emotional appeal then, yes, the terrorists have won.

For us as a country to question the very basic principles of habeus corpus is to admit that our system, in which we believe is the best, is flawed.

Either we are consistant with our policies, setting an example accross the world, or we can be wish-washy and stand for nothing.

And you call yourselves Patriots?!

1) The terrorists who were waterboarded (3 people) are Illegal Combantants. Therefore they are not covered by the Geneva Convention.

2) Waterboarding is not torture. Unpleasant, but not torture. Our Military is waterboarded as part of their training. However, when we get caught by the Taliban, they cut off our heads and put the video up on the Internet.

3) We NEVER EVER executed the Japanese or any other enemy for simple waterboarding. The people who were executed after WW2 did more then waterboarding. You can look it up, it is all in the history books.

Up until a few years ago I was considered as conservative as they come. Today I am happy to say I have not changed my views one bit and I am proclaimed a liberal. Well, I am proud to wear that title.

The President may not interfer in DoJ investigations he may request an investigation, but even then, its the Attorney General that makes the decision. Whether or not to order an investigation into a proposed crimminal manner is the sole responsibility of the Attorney General. Intereference in such a investigation by anyone to include the President is consider a very serious matter, it is called interferance in a federal investigation.

The investigation is perhaps one of the most patriotic things to have come out of Washington in years. It recognizes that there are Federal Laws that mean something and that one can not just set them aside.

While it is tempting to adopt EITs to extract enough info from the blood-thirsty savages, it also behooves us to do them in a way that we do not have to answer to the human rights goup, no matter how inhuman these animals were. It is quite a tricky and thorny issue, and Cheney can not claim complete credibility' in curbing some of these calamitous catostrophes from befallin' the nation, again.

Scientists, who do statistical studies as to the efficacy of these or other methods, have not been unanimous in thses approaches. Now, politics is a different can of worms and the Dems will deal w/ the GOP in their own unique way of rebuttal.

I am really puzzled that no one has asked Dick Cheney a very key question. What did the administrations of Ronald Reagan, George H.W. Bush and Bill Clinton do that kept our Country safe from terrorist attacks that the administration of George W. Bush and Dick Cheney failed to do? It has been reported that the Bush/Cheney team ignored intelligence data warning of attacks on the Homeland prior to 9/11. It has also been reported that the administration ignored many of the tactical plans put in place under the Clinton Administration to track and potentially attack the planners of terrorist actions in camps of Afganistan.

It was interesting to hear Cheney speak of a 2004 Justice Department investigation into interrogation techniques and the administration being exonerated. How convenient can he get, anyway? A Justice Department that was wholly politically slanted with cronies at the helm clearing the Bush Administration of wrongdoing. The fact is if an independent investigation is done of the CIA is performed, Cheney Gonzoles, and many top level Defense Department Personnel would be found guilty of unlawful policies and acts that appear to only punish those who carry out Bush and Cheney misdeeds.

This is so ridiculous. If anything is political about this it is the fact that Cheney is not in jail yet. Obama is trying NOT to prosecute the big fish in this. Of couse, my hope is that since all the roads lead to Cheney and Rummy, eventually they will be put on trial too. I'm tired of the little guys going to jail (as was the case with Abu Ghraib) and the guys who orchestrated the crimes walk away free.

Cheney is wrong again....He has been wrong on every issue he ever delt with...The man is a certifiable idiot..He needs to just go away and keep his mouth shut...The world will do fine with out his advice or his daughters..

Cheney never served in the military, has always been a desk jockey and his supporters are all tax dodging hippies who never served in the military and are being paid to blog.
