Judge dismisses suit about Obama's eligibility to be president.

(CNN) - President Barack Obama may have one less problem to worry about.

A federal judge on Thursday dismissed a lawsuit that claimed Obama is ineligible to be president because he isn't a bona fide U.S. citizen.

The lawsuit represented the claim by the so-called "birthers" movement that Obama was not born in Hawaii - despite a birth certificate to the contrary - or that if he was, his citizenship was invalidated by living overseas as a child.

In a 30-page ruling, U.S. District Judge David O. Carter of California said his court lacked the jurisdiction to rule on a case intended to unseat a sitting president.

Carter's ruling said the plaintiffs were trying to persuade him to "disregard the constitutional procedures in place for the removal of a sitting president."

"The process for removal of a sitting president - removal for any reason - is within the province of Congress, not the courts," the ruling said.

Carter's ruling also noted that the plaintiffs "have attacked the judiciary, including every prior court that has dismissed their claim, as unpatriotic and even treasonous for refusing to grant their requests and for adhering to the terms of the Constitution."

"Respecting the constitutional role and jurisdiction of this court is not unpatriotic," the ruling said. "Quite the contrary, this court considers commitment to that constitutional role to be the ultimate reflection of patriotism."

The more radical the Republican party becomes, the more they alienate voters. We need to have a system of checks and balances but if the right wing continues to become more extreme it will be marginalized to the point of being ineffective. The way the Democrats lashed out during the Bush presidency and the way the Republicans are now attacking President Obama both look like acts of desperation by dying political parties. Unfortunately the voice of moderates in this country is hard to hear over the dying screams and convulsive thrashings of both the left and right wing nuts. Extremists seem to make the most noise.

The problem here is that the Republicans knew their convention had dealt them a bad hand with making McCain and Palin their candidates. So they decided to do whatever and support whatever to get votes, now they've got all these lunatics in their party and don't know how the hell to shut them up.

When this nonsense of the birthers came up, Obama showed a legitimate birth certificate. They then responded by saying he'd never produced one. Then they found one that said he was born in Kenya, then were embarrassed to find that it was a fake one using an Australian birth certificate! Obviously someone advised them that the lawsuit had no merit before it was even filed, but they didn't care.

All of this nonsense just embarrasses the U.S. to other countries who wonder why we have all these nutcases here.

Most of you need to do some research on this subject. If the president was not eligible to run for election based on citizenship then it is up to the judge to rule and send that ruling to the Congress for impeachment hearings. Additionally, the election could be invalidated by the election commission. The judge took the easy way out because he didn't want to be a target of the overly aggressive and prejudicial white house. Now, why is this a question? The president could lay this to rest easily but the fact that he won't makes it that much more suspicious. So, for all you judgmental fools in here, you might want to make sure you understand the issue before you go jumping all over someone. One of the people who brought suit against obama was a Democrat. One more thing, For the Sake of all of humanity stop labeling anyone who voices an opinion against the sitting president a Racist. You sound more ignorant than the people you attack.

Time for birthers to move on....all they are trying to do right now is cast doubt of President Obama's legitimacy to be president so that by the next election, the seed of doubt will have grown to something very real and therefore....probability of him losing reelection. The president did provide proof of birth from the state of Hawaii. He made it available online for all to see. There were also birth notices in the newspaper. This is just a case of more people trying to steal an election. And considering that Bush Jr took over 1000 days of vacation in his 8 years of office (over 1/3 of his presidency) while destroying our country's economy and terrorizing the rest of the world, it is time for all of the finger pointers to crawl back into the hole they came from. Hopefully this time we can seal it shut.

For the record; Obama did produce his Birth Certificate. And it was verified by the Republican Govenor of Hawaii. The local paper even had the birth announcement in August of 1961.

They have also released the birth announcements of 2 different newspapers in Hawaii the day after he was born. Also, before he was elected, the Federal Government verified he was a U.S. citizen, otherwise he would have been disqualified to run for President. Why do so many of you identity with the political parties. Clearly Obama was elected. However, to date he has been rather indecisive and let the Congress take the leadership on major issues. I am quite concerned about (1)his socialist leanings and (2) the stimulus monies being spent which in effect devalues the dollar. He will get us further involved in Afghanistan which will make the Russsians and Chinese happy...while NATO proves it unworthiness. I would like to see him man up for once...perhaps kick the UN out of the

Obama DID provide a certified copy of his Certificate of Live Birth. That birth certificate has been authenticated both by bona fide outside experts and by the State of Hawaii which has emphatically certified that the information on the birth certificate provided by Obama is accurate and true: he was born in Hawaii. Period. Get over it.

And the judge was correct. Only Congress can remove a sitting President. Don't like it? Leave. Go take over an island somewhere that you can have your own Constitution. I'll take America and OUR Constitution any day.

I consider this issue scarcely worthy of a comment. The President was born TO an American citizen ~ it does not matter WHERE ~ although I believe that he was born in Hawaii, which was a state in 1961. Even if he had not been born on U.S. soil, if he is not a "naural born citizen," then neither are all the "army brats" and other children of American citizens who were born offshore. The birthers' argument is rdiculous!

The underlying reason for all this is racism. Certainly not all who are opposed to the President's policies are racist. But there are a lot of people in this nation who can't deal with the idea of an African-American president.

Here's the deal folks. Obama was born in Hawaii after it becasme a state. That makes him a citizen, regardless of where his mother lived or where he has lived since then.

No matter how you feel about this issue, the fact remains that Obama has never produced a legal birth certificate.

I was recently required to provide my birth certificate, and submitted the "certification of birth" just like Obama's. This was rejected because it is simply a printout from a computer database, and databases can be altered.

I was required to unearth the original "birth certificate," which is the original vintage document prepared at the birth, with the emossed / crimped seal and stamp.

Obama has never produced this document. Why is it that we require ordinary citizens to produce this original document as evidence of birth for very basic legal procedures, yet for validating eligibility for the leader of the free world, we do not require the same rigor?

Regardless of how you feel about Obama, doesn't this bother you?

"We" already have had access to it, in the form of investigative reporters (the legit kind – not the paranoid kind), the FBI, the Secret Service, the INS and whomever it is that the state of Illinois hires to do their citizenship checking (my guess is they get that info from the Feds).

"We" have had access and President Obama's birth certificate is authentic.

So give it a rest, already!

To all the people saying that Obama should "just provide his birth certificate", he already has, several times, in several forms. The fact that he was legally born in the USA is without question. Case closed.

The problem is that you have a bunch of conspiracy theorists who will *never* believe he was legally born in the USA, no matter what the actual evidence is. They *choose* to believe this nonsense without any proof, and no one will ever be able to convince them otherwise.

It's just very sad that such a small minority of essentially crazy people are granted such unbalanced attention by the media. They should go back to claiming Big Foot exists, or that aliens from outer space have kidnapped them and performed experiments on them.

So let me get this straight: According to the "birthers," President Obama is the result of an elaborate plot hatched on August 4, 1961 in Hawaii.

Two people, Barack Obama, Sr. (Kenyan) and Ann Dunham (Kansan), conspire to place birth announcements in the Honolulu Advertiser and the Star Bulletin, saying they have had a son.

Fast-forward 47 years later ... both Obama Sr. and Ms. Dunham have passed away, but their nefarious plot lives on and has succeeded in electing the first non-U.S. citizen as American President!!!!

People, Obama has presented only his short-form birth certificate and an official document that says Obama has a birth certificate. Obama NEVER provided his long-form birth certificate. Obama would resolve all questions/problems if he simply provided his long-form birth certificate. I'm not sure why he's withholding this information. He may very well have been born in this country, but perhaps there is other information on the long-form birth certificate he doesn't want his children or wife to know about.

Newsweek had a copy of the Certificate on its cover a few months back.

The court was correct to reject and dismiss this absurd suit by the birthers. This case had no logical or legal merit in the first place. The people who brought this suit should have been fined and assessed fees for wasting tax payer's money and the court's time with this nonsense. President Barack Obama was born in Hawaii, an American state and is defacto, an American citizen. The fact that Obama lived in Indonesia for four years does not invalidate his American citizenship any more than it would the citizenship of any other American. This all started with John Mccain last year. There have been elections were the running or elected president with concerns over his birth place was in question. Many still believe that Chester A Arthur was born in Canada. I think there is a book about it. Its was never proven true or false,. and hundred and plus years later its still talked about. Most people would questioned Mccain's birth place because it was on an army base in Panama Canal in 1936. But hey we just love to waste time in this country.

And, if he looked at the evidence--it does not appear that he thinks that those who filed the lawsuit-–or the evidence-–is unfounded, or beyond being questioned.

I just recently took my SAT2 and AP US History test, and i can tell you that there is nothing in the constitution that prohibits socialist type legislation or governance. Many of our founding father (Hamiltion, Adams and many others) were actually very aristocratic and socialist in nature. Know your history before you start making generalized statements which simply go along with republican talking points to attempt to discredit our president.

John McCain was never even born in the US in terms of the 50 states and DC. His mom gave birth to him at a US Naval hospital in the Canal Zone-which is now officially Panama. Also, of the first 10 US Presidents and of the first 10 US Vice Presidents; 9 US Presidents and 6 US Vice Presidents were born BEFORE the Declaration of Independence was even signed.

Also, except for the one President, neither one of the first 10 Presidents or first 10 Vice Presidents were born BEFORE the Constitution was even ratified by first of all Delaware or the colony even became a state. Among those who are not quote, "natural citizens of the United States" end quote Washington (who wrote the Constitution) and Jefferson (who did the Declaration of Independence). Does that disqualify them as the 1st and 3rd US Presidents and in Jefferson's case, the 2nd Vice President?

The LEGAL birth certificate has been produced and posted on-line.... you morons. Do you really think Obama has fooled the Secret Service, the CIA, the FBI, and Homeland Security? How many brain cells do you have?

When a birth takes place in a hospital, the mother gets a pretty certificate where everything is written in by hand – names, dates, etc. Now let's say a year or so later you need an official copy because you can't find the original 'pretty' one from the hospital because of a fire, divorce, misplaced, whatever. You have to get one from Vital Record (or equivalent, depending on the state), and what you get is the same thing that Obama got from Hawaii and is posted on line – a computer printout that is completely LEGAL (unlike the the harassment Obama is getting from the GOP losers).

Judge Carter did have technically correct right to dismiss and the counsel was not the best. However, do not gloat for long because his coup will be exposed for the sake of history and the Constitution.There are people just warming up. the people who keep saying "it hasn't been decided on the merits" don't understand the constitutional requirement of separation of powers. There are areas in which courts cannot act because the constitution doesn't permit them to do so. The same people who are (incorrectly) claiming that the constitution renders President Obama ineligible would walk over another part of the constitution to try to prove that. His place of birth has nothing to do with it. He could have been born in Kenya, but if he was born from an American citizen mother and an American citizen father he was still be a natural born American citizen and qualify to be President. The judge should have allowed the lawsuit to go to court as the birth certificate from Hawaii has not been proven to be valid. Obama is not a legal citizen and should never have run for the presidency. McCain was born in Panama but he was born as the child of a man serving there in the military and where ever a military man is serving overseas his children are American citizens if he just has his wife living on the base with him. It has been available not just online, but the actual hard copy item has been seen and reviewed by dozens of experts, including those from the right. Exactly where is the provision in citizenship law that takes away one's U.S. citizenship because the person "lived overseas as a child?"

The amount and depth of racist-based hatred for our President is beyond any level of rational comprehension.

President Obama was duly elected according to Federal Election Law. For the "Birthers" and the "Haters," Senator McCain tried and failed to win the election. It's been nearly a year since the election.

At what point will the B & H'ers let it go?

Interesting, the Judge did not rule on the merits of the claim, only that is was outside his jurisdiction. Of course Obama could put an end to all the sillyness by just granting access to his birth certificate. But that would be too simple, where is the drama in that.

Most of me acknowledges that the suit is without merit, and deserved to be dismissed.

Part of me wishes it went forward, just so the issue could be put to bed once and for all.

Congress isn't going to act in this direction. The Obama presidency was given a free pass and rubber stamp from the beginning of the campaign. What really needs to be addressed is what "natural born" means because the Constitution has been misinterpreted to mean "born on U.S. soil." This is incorrect.
