WASHINGTON (CNN) – Sen. John McCain hammered the Obama administration Friday for its decision to try accused 9/11 mastermind Khalid Sheik Mohammed and four other suspected terrorists in a civilian court in New York.

Mohammed, Ramzi Bin al-Shibh, Walid bin Attash, Ali Abdul Aziz Ali and Mustafa Ahmed al-Hawsawi will all be transferred from Guantanamo Bay to the U.S. District Court for the Southern District of New York - a short distance from the World Trade Center towers that were destroyed in the September 11 attacks.

McCain said in a statement that he is "extremely disappointed" by the decision and argued that the suspects "should be treated as war criminals and tried for their crimes through military tribunals."

"I have worked tirelessly with my colleagues in Congress and with the Obama Administration to make our military tribunals system better able to dispense justice efficiently and fairly while protecting secure information," McCain said. "If military tribunals are suitable for the terrorists who attacked our sailors aboard the U.S.S. Cole, as the Obama Administration has decided, then military tribunals are certainly the right venue to try the Al-Qaeda terrorists, including Khalid Sheikh Mohammed, who murdered thousands of innocent civilians on September 11, 2001."

He added: "Today's decision sends a mixed message about America's resolve in the fight against terrorism. We are at war, and we must bring terrorists to justice in a manner consistent with the horrific acts of war they have committed."

Two things for me: First what if, God forbid, something does happen during the trial? Second, what if, because of "national security", or a sharp lawyer, or our imperfect legal system, that these "things" are actually aquitted? These "things" have no concept of human values, have perverted their own religion for personal gain, strap bombs on their own people including women & children, all in the name of their God! It appears this story must be strictly for democrats since the majority of the responses seem to be attacking McCain. I would like someone to respond to the fact that if the rule of law is so important to you why were you not up in arms when Holder and Obama went to court to have the prisoners at Gitmo remain classified as "non persons" with no rights? So how can any court of law or tribunal convict a "non person"? And why do many of the responses say convict them and kill them or similar words if you want to follow the law so closely that now they are being transferred, someone is now presumed innocent. So in all reality, you have already decided they are guilty therefore a military trial where they were ready to plead guilty would have been fine.

Where else would you try them? The crime was comitted in New York on non military targets. The Cole was a military target, so, therefore a military tribunal. For heavens sake, how many terrorist arrests have been in the news lately? Quite a few. For all their talk, I don't think the Republicans have a leg to stand on as far as terrorism and the country being safer under them.

Obama knows the law and this proves it. We CANNOT try them as war criminals. There was NO WAR in NYC at the time that I know about. These people committed murder in the State of NY. In order for there to be a war tribunal there has to be a war.

If we set this precedent, then ANY AMERICAN on foreign soil could be tried as a war criminal if that Gov't just decides to.

Even so....America doesn't try people for war crimes. There's an International Tribunal for that. So if you want to say these people committed "war crimes" then we have to ship them overseas to be tried.

Well, let's just be sure not to take them on any "shopping trips" while they are in New York. I noticed how adroitly everyone has avoided mentioning the fact that the Ft. Hood terrorist/murder bought a "cop killer" gun so easily at the Guns Galore shop in Texas. You gun-loving nuts still won't admit the damage that something with that fire power can cause. What possible reason would someone need something with that fire power? Certainly not for self -defense!! But you don't want to try the Gitmo prisoners in New York City because you are concerned about security. Let's just keep them away from any gun shops, okay? Maybe then we won't have to worry. And how exactly is having a trial, even a civilian trial, a bad thing. If the evidence is strong (and I assume it is very strong), they will be convicted quite easily and executed... why is preserving the rule of law through a full trial (which will only legitimize the legality of the action in the eyes of the rest of the world and thus help us have better relations with islamic countries in the middle east).

Good lord, exactly what else SHOULD be done with them? Keep in mind that a military tribunal could just as easily find them not guilty as a civillian trial could. What on earth ever happened to due process? The right to be presumed innocent until proven guilty? The rights enshrined in American law and the Constitution?

People who have committed horrible crimes have always done so in complete violation of other people's rights. That's why their actions are "crimes". Why was Timothy McVeigh entitled to a trial and to the presumption of innocence, and the Gitmo detainees are not?

What ever happened to the "freedom" and "justice" and "democracy" and "human rights" that the wars in Afghanistan and Iran were ostensibly fought over? I thought it was the terrorists who hated America and the noble values she stands for.

Hell, if America can abandon its noble values simply beacuse they're momentarily inconvenient, then the terrorists have already won.

When I read this, here is what stands out to me:
The terrorists who have acted against us did horrific things. The fact that they did these horrific things justifies the abandonment of International law, the United States Constitution, the possibility of having taken the wrong person(s) into custody, anything that we know as JUSTICE... because SOMEBODY did us wrong.

In the end, what matters is REVENGE, not justice. By that measure, the Viet Cong were justified in holding and torturing Senator McCain. He was captured out of an enemy plane that was terrorizing their country... Point of FACT, in this case, he ADMITS his participation – it's what makes him a war hero.

I agree that we should bring TERRORISTS to justice! If we have captured the right people and have properly documented their actions, we SHOULD be able to get a conviction in Amish Country.
Where I fall away is where we reduce ourselves to terrorists, willing to administer "justice" "in a manner consistent with the horrific acts of war they have committed.," rather than administering JUSTICE in accordance with our Constitution.

Even in this situation, is it REALLY better to convict an innocent man than to follow our laws, just because terrorists attacked us?

I believe that seeing justice dispensed in the courts of NY, the very state that was attacked on 9/11 is appropriate! I expect the outcome would be no different than if the venue were a military tribunal. Furthermore, I think ot will New Yorkers closure. (The decison is symbolic.) Either way, they will be housed in SuperMax prisons (I suspect.) until executed–that is, if found guilty as our justice system presumes "innocence until proven guilty" despite public opinion.

I pray that justice will soon prevail and the long overdo healing shall begin for the loved ones of this horrific crime.

The five people should be tried in New York by the federal prosecutors in NY with a jury of their peers if that is what the government decides. I did watch the announcement this morning and I believe that Attorney General Holder, the Justice Department, Secretary Gates, and the Defense Department have worked together to bring the case forward.

The good Senator has a right to his opinion but it is the responsibility of this administration to decide where and when these men will be tried.

Mr. McCain says we are at war. We are? Since when? Article 1, Section 8 of the Constitution gives Congress the power to declare war and I don't recall Congress officially declaring war on terrorism and terrorists.

I make absolutely no argument that terrorism and terrorists should not be a top priority, and that protecting the country is paramount. However, in this case, the phrase "war on terror" can be likened to phrases such as "the war on poverty," "war on drugs." Which is completely different than phrases like "war with Japan," or "war with Germany" which stir a deeper sense of patriotism. In this case however, Republican use of the word "war" is a disgusting perversion, whose only purpose is to further a their party's political agenda. And in the face of 9/11 victims and their families, that is the most disgusting perversion of all.

Well, the more sessions the more millions of dollars. 80 waterboard sessions in 30 days on a single defendant!!! That's more than 2 per day for 30 days. The Army propaganda wing proudly trotted out and stated in multiple public press releases that the Sheik was singing like a bird after he was Waterboarded.

Its very clear after the lies and distortion, that waterboarding was a complete waste of taxpayer money and did nothing but make the defendants more defiant than they ever were.

The public trial will likely reveal that the veteran FBI interrogation term left Cheney's handpicked blackwater torture wannabe's in utter disgust over their incompetence and tactics.

Of course the Republican lawmakers are going to squeal like pigs as more of their dirty and disgusting behaviors are revealed to fellow Americans and the World.

Imagine the hypocrisy of John McCain complaining about revealing TORTURE against someone suspected of war crimes.

To me, nothing would be more just and send a more powerful message than to give these thugs their day in court and give them the death penalty. Given that there were five military tribunals announced the same day, I presume these five wouldn't be sent to NY if the prosecutors didn't think they had a case, even with the difficulties of torture and so forth.

McCain should keep his opinion to himself. The law states that a crime was committed in NY City, the trial should be there as well. Because they are not citizens of the USA is not a valid reason to hold a tribunal in Gitmo. The important thing here is they will stand trial. Would he rather we just incarcerate the individuals indefinitely? That would be inhumane and against the Geneva Convention Act.

If memory serves correct, this horrific act I witnessed from the top of my apt. building nine years ago was committed, admittedly by Al Qaeda, on the basis of "jihad" or "holy WAR" and was an attack on our sovereign land. Why on earth is this headed to civil trial? Who are the "peers" that are going to be on this jury? I have to have faith in our legal system (holding my breath) and that the families will get justice and they will receive what's coming to them. I actually think they should get life sentences in some hole since they would likely prefer to die for martyrdom, but that is a call for others to make. But i can see the circus starting now with some defense you'd see out of Law & Order that they've been traumatized, threatened by our way of life, a momentary lapse in sanity and now deserve a chance to be understood and to turn their lives around...This is suspicious and seems ridiculous.

Today's decision does not send a mixed message about our resolve. It shows that we have a justice system and we believe in it. Why should we elevate these criminals to some special category? All they are is gangsters who use Jihadist rhetoric to justify their behavior. I think trying them in New York as criminals sends a message to the world that they are just criminals and not larger than life and it lets the people of New York get some closure.

John McCain is wrong. He's a former navy officer and is keenly aware that standards of evidence and presumptions of guilt are significantly more favorable to the prospecution in military tribunals than in criminal courts. His motivation is not about justice....its about exacting revenge through a kanagaroo conviction.

Further, in order to justify a military tribunal the plotters of 9/11 would need to be military representatives of a foreign power. Unless we want to recognize Al Queda as equivalent to a country (which I don't think anybody would support) the defendents simply can't be defined as representing a foreign power nor, subsequently, as military representatives of that power.

Does John McCain not have faith in our criminal justice system that a fair trial would be carried out in the criminal courts as opposed to the military?
