Washington (CNN) - Senate Democrats broke a GOP filibuster Tuesday against a district judge first nominated eight months ago by President Barack Obama for a seat on the federal appeals court.

The Senate voted 70-29 to end debate over the nomination of Indiana Judge David Hamilton, who was tapped by Obama in March to fill a vacancy on the 7th U.S. Circuit Court of Appeals. Hamilton was Obama's first judicial nominee.

The full Senate is now expected to move forward quickly on a final vote on the nomination.

Hamilton's nomination cleared the Senate Judiciary Committee in June. Leading Republicans, however, then spent weeks preventing a final vote, arguing that Hamilton is too liberal.

Congressional Democrats have expressed growing unease over what they argue is a slow pace of both judicial nominations and confirmations since Obama took office.

Filibuster – The term first came into use in the United States Senate, where Senate rules permit a senator, or a series of senators, to speak for as long as they wish and on any topic they choose, unless a 3/5ths of the Senate (60 out of 100 Senators elected and sworn), brings debate to a close by invoking cloture.

There are currently 60 Democrat Senators, who can stop a filibuster anytime they wish. A wholly Republican filibuster is impossible in the current Senate makeup. In other words, the only way that the Republicans can filibuster anything is if they have Democrat Senator support.

to all those people complaining about partisan politics, wake up! partisan politics have been american politics since the dawn of our nation. It's not ever going away as long as we remain some form of democracy. I'm not saying we shouldn't be a democracy, it's just how democracy works.
Politicians could never get elected if they didn't have a polarized electorate so they pander to it. A politician who appealed to everyone would convince no one despite how genuine they may be. I'm willing to bet most of the Republicans in this country you liberals are bashing are the ones who pay most of the taxes (it was shown that only 53% of America actually pays meaningful federal tax). a filibuster occurs when one party or another or group of senators decides to block a vote on an issue, law or nomination by continually debating about it. According to the rules, as long as someone is speaking about the issue, a final vote cannot be taken unless a 2/3 majority of senators vote that enough debate has occured. This tactic has been used often by both republicans and democrats to stop confirmations and new law.
The fact that this filibuster was broken in this manner means that many moderate republicans voted to end debate. This bodes well for the republican party, if these same moderates can curb the far-right insanity currently infecting their party. If they cannot curb it then they are finished as a political power, much like the Whig party, whom they took over from.

In this era of "NO MONEY", because we have already spent our great great -great grand children's money, we need to be looking at down sizing our courts, and building in LOCAL checks to stand against them, and everything that government does becoming to much of a burden on the private sector, which mostly doesn't exist much anymore as it has fled to China.
If everything that Government spends would have to come from the Local Counties were the Government pays 6 figure incomes
to them, the local citizens would be completely broke and start a revolution. To this end, we should push to combine courts,
in other words, no more congress confirmations, just put them all under Local control to be voted on by the people, and end this mess.

When the Dems were doing this to Bush, not even allowing his nominations out of committee so they could come to the floor for a vote, I didn't hear the whining I'm seeing in these comments. You people act like it's only the Republicans that do this stuff. Give me a break! John McCain and others (from both parties) came together and formed a group who agreed that judicial nominations would be given the courtesy of a yes or no vote. It's the Senate's job to provide advice and consent, not determine who the nominees should be.

someone attacked liberal judges...wasnt it liberal judges appointed by FDR that ruled on cases like Borwn vs Education? Is that one of the stupid rulings you are referring to? Judges can be activist no matter what side. We just call them such when they dont rule the way we want them. political ideology is not the same as judicial ideology. the difference in law between the sides is one feels you cant read into the law even if there is no precedent where the other side says not everything is exhaustive in the constitution thus the constitution is like a living tree and must be applied based on the modern circumstances. The constitution does say that blacks were 3/5 of a perosn if they were slaves. but it took the living tree ideal for that to change. so the law is interpreted on both ends. it just depends how its interpreted. learn what jurisprudence is.

I am a bit confused by the title and content of this. It says the vote was 70-29 to end the debate. Isn't that 10 more than was needed to end a filibuster. Did the GOP try to filibuster? Was this first vote to end the debate? Doesn't this mean that 10 Republicans voted to end the debate? Were there 10 Republicans who switched sides, or does this mean that some Republicans were hoping to be able to fillibuster this nomination but did not have the votes on first vote to stop the debate?

With only forty votes in the Senate, the Republican Party cannot sustain a filibuster. Therefore it is self- evident that until today there had to be non-Republicans who were blocking the nomination as well. The DEMS have a filibuster-proof majority. So unless at least 1 DEM was voting against, the GOP couldn't stop it. And 70 to 29 vote means a minimum 10 GOPs voted FOR it. A vote could not be taken on the issue of moving forward with Hamiltons appointment because the "confusitives" kept debating in an attempt to stop a vote from taking place. They finally relented and stopped debating. Its such a sad testament to our 2 party system that one of them are in the midst of such a shock after the election that all they can do is two things, sulk, and bad mouth. All you hear are negatives from them, Look at Guiliani, he's condemning our bringing these terrorist to justice all because they are going to receive a fair trial in New York. What does he think, that the jury is going to let them go? Here is a Politician who either has no faith in our political system, or is just ranting because the Democrats have the floor. "Liberal" judges are not necessarily "activists" on the bench; they may clearly apply the law and the Constitution in exactly the manner the founders intended. An example of this is the Miranda decision, which inevitably follows the principle that we are each innocent until proven guilty.

Conservative judges have been activists – just look at the Dred Scott decision.

The only way to evaluate a candidate for the federal bench is to look at the whole of their record on the bench or off.

At 70-29, a fair number of Repubs had to vote with the Demos. Last time I counted, the Democratic caucus had only 60 votes, even counting Lieberman and the Independent Sen Sanders. Do the 95% of the people commenting here know anything? Conservative judges don't legislate from the bench. They follow the constitution. That is often a problem with the left as they are hoping to get activist judges that create law (not up to a judge to do that). Also your memory is very short, the democrats did the same thing to Bush's nominations for the past 8 years. All judges should be conservative and only interpret laws as they are written. If you want a law changed that is for the congress.

This "my way or the highway" attitude that both sides have is very unproductive. We don't want an America that is split between a radical left and a radical right. I think that most Americans, like me, have a wide range of views and you can't neatly place everyone into a box and call them a liberal or conservative. The whole concept that any step in one direction is just a stepping stone to some radical far end of the spectrum is just stupid. Please. Filibustering judicial nominees as legitimate party policy was introduced by the democrats during the Bush administration. Prior to 1990 it was RARELY used, and certainly not as aggressively and crassly as it is today. Yes both parties do it now, unfortunately, but please don't cry any tears about republicans simply because they're recycling democratic tactics against Obama. "Turnabout is fair play" and the democrats opened pandora's box a decade ago. Have any of you idiots read anything about this nominee - his judgements are inconsistent, not always based on precident, and his decisions often are based on his own opinions versus established law.

He is not the type of judge any of us want in this position. What the Republicans in this case are doing is protecting the Judicial system.

By the way, here are a few facts:

- Ruled that Muslim prayer is allowed in Indiana court room since it is dictated by their religion and the mention of Allah was fine, but yet he blocked Christian prayers and mention of God and blocked the placement of a Menorah by a Rabbi at the Court's Holiday display.

- He was an avid fund raiser for ACORN and at the same time ruled over an ACORN court case (can you say, conflict of interest)

- He's active in the ACLU - which may be fine for a lawyer, but not a seated district judge

- He has also been stamped as "not qualified" by the ABA

The Senate voted 70-29 to end debate ... The full Senate is now expected to move forward quickly on a final vote on the nomination

I do not think that Senator Kennedy's replacement has been seated yet so all of the senators (aka the full Senate) were there.. So the vote was 70 – 29 in favor of allowing the senate to... vote.

We have members of Congress using twitter to inform their staff and lobbyists how things are going in REAL TIME but you can't get business done in a timely manner because of antiquatied procedures. Procedures which were put in place to give members of Congress time to ride a horse back home to tell their constituents what was going on.

The Republicans will take back the House of Representatives in the 2010 mid-term elections. At that point everything will grind to a complete halt. As long as we stick to private based funding methods to elect politicians, we will keep getting the same results. A filibuster is a vote against cloture – that is, what the Republicans are doing is blocking an up-or-down vote, exactly the opposite of what you think they are doing. Also, it is impossible to vote "present" in the US Senate, which has different rules than the Illinois legislature.

Senate Democrats break GOP judicial filibuster??!!??!!?? How did THEY "break" it??

The last time I checked, the Dems don't have 60 votes, much less the 70 that is quoted in the article. The TRUE title is "Senate Republicans allow up or down vote". The article is worthy, but the title is terribly misleading.

Please Dana, get the title writers to stop treating us like we're idiots – most of us have minds that can think on their own. This title is an insult to anyone who understands even the basics of the system.

Or should I read into this that you are pushing an agenda? So much for the "no room for opinion on our network" montra. Looks like you're carrying Snobama's water. (Get it – Snobama means we're getting snowed by Obama.)

This just shows the incohesiveness of the Dummycrats. With the massive majority that they "won" by being the non-Bush party, they should be able to easily smash any GOP resistance. However, due to their lack of teamwork and unification for a common goal (a familiar issue with the "liberals") they are just as impotent as they were when they were the minority.

I'm sick of all this talk of filibuster. You should NOT have to have 60 votes to pass something. The Constitution clearly states that a law will pass with a simple majority of 51 (or 50 plus the Vice President as tie breaker). Come on, people!!! I learned that in 10th grade Civics class.

The Republicans did the best they could - and congratulations to them for holding out as long as possible. For years, all of our moderate and conservative judges have been blocked - hundreds of them over the past 16 years. Now that the democrats are meeting some resistance, we get all this biased media coverage that fails to mention that the moderates and conservatives have not gotten their fair share of nominations through. Silent on all the years of blocking by the democrats. That is basically unfair and tanamount to journalistic malpractice.

Randy, having 60 votes (just enough to prevent a filibuster) leaves no room for error. If only one member of the Democratic caucus dissents, they can prevent whatever they want. When you have people like Joe Lieberman caucusing with your party, you can't really rely on the votes all of the time. Conservative Democrats aren't reliable votes.

I find it interesting that when Republicans are in power they demand up or down votes on their judicial nominees and decry Democrats delaying tactics. But when the shoe is on the other foot delaying tactics are ok and up and down vote is not that important.

I would hope that at some point the Senators would rise above petty partisonship and put the best interests of the Country first. The large number of judical vacancies hurts our judicial system. The Senators could start with judicial nominations, but I would prefer they start with fixing our broken health care system and replacing it with something that is fair and affordable.

I am so tired of hearing that every time Obama is blocked on something it is deemed as racist. I have a huge problem with everything that he wants done my children and grandchildren will be paying. We have the highest federal deficit ever, this should not be between parties but what is right for our children.

If you think that the government is working for you now with the democrats in control you are sorely mistaken. The mistakes that are being made now we will be paying for forever.

I am tired of our military not getting the respect that they deserve from the liberals of this country. They are fighting for our freedom and you do not even have enough integrity to say Thank You.

I beleive that America's tolerance for and disgust over Partisian politics has reached all time lows. I have watched the political arena for many years but can honestly say that this is a world wide emmbarassment. Not since the Nixon attacks has the politician been so crude and rude in his presentations. It is time for 'real change" alright but it involves a revamp of the two party system to assure balanced and fair decisions based on what is good for al;l americans not just for the select few. It seems simple enough to me to expect people to be civil in their dealings with their co-workers.

Nothing but a ploy to slow down Obama's appointments. Reagan had 43, G.Bush had 28 and Clinton had 26 appointments in the 1st year in office.

Well if this been a Bush nominee the liberal Democrats would cry the person was too conservative.

So not real news just politics in Washington. However, the thing I don’t care for is the liberal judges always seem to be more of a liberal activist in the court then a conservative judge that rules based on the U.S. Constitution!

We are a nation of laws not one that hand out law based on ones feelings! When you get liberal judges you get a justice that is not only blind but is stupid as well!

With Republicans running our entire government the U.S. economy was heading quickly toward another great depression. The American people woke up and put our government in the hands of the Democrats. If the Democrats don't lead they will be replaced. My advice to the Democratic leadership is to do the job that you were put in place to do. hopefully the republicans will keep doing this – stalling / delaying any and everything the uber-leftists try to ram through. That way it FORCES the liberals to have to fully vote (and therefore take responsibility of) anything going through. None of this hiding behind voting "present" like obammy did – and getting away with it. That will let candidates running to replace the very unpopular house and senate be able to call all of these politicians out on each and every vote they make.

This happens with every President. Republicans in the Senate during Clinton's term held up scores of his judicial nominations. When Democrats did the same during the Bush administration, Republicans screeched endlessly about it. I find it interesting that it got a lot more press coverage when it was the Dems playing these games than when Republicans did it, especially since the mainstream media is supposedly so "liberal."

This is good news. I am glad some GOP senators saw reason in ending this filibuster against the nomination of Judge David Hamilton. You do not play politics in everything.
