Palin to testify in e-mail case

(CNN) - Sarah Palin and her husband Todd will testify in the federal case against a Tennessee man who allegedly accessed Palin's private e-mail account during the 2008 presidential race, Palin's attorney told CNN Thursday.

"Governor and Mr. Palin have been asked by the U.S. Department of Justice to testify in its ongoing criminal prosecution in the case of U.S. v Kernell," attorney Thomas Van Flein said in a statement. "The Palins expect to testify in person in Knoxville, Tennessee."

The case involves University of Tennessee student David C. Kernell, the 22-year old son of a Democratic state representative.

Kernell was indicted in October 2008 after he allegedly used information freely available online to guess the password to Palin's personal Yahoo! account, the name of which was posted on numerous Web sites at the time. Kernell accessed the account around the same time questions were being raised about Palin's use of personal e-mail accounts to conduct state business as governor of Alaska.

After gaining access to Palin's account, Kernell allegedly reset the password, scanned her account for potentially damaging information and posted the new password to a public Web site.

Federal prosecutors broadened their case against Kernell in 2009, charging him with four felonies: identity theft, wire fraud, computer fraud and obstructing a federal investigation. Kernell has pleaded not guilty to all four counts.

A federal judge has set the trial date for April 20.

Reached by CNN, Kernell's attorney Wade Davies declined to comment on the case.

    I would love to ask her some questions on cross examination. I think that I would be hearing a lot of "Objection, relevance!" during the questions though.

    Will Mrs. Palin have her notes on her "palm" pilot?

    She tends to tell different versions of the same story: She told a Canadian audience her family used to go to Canada to get medical care when she was growing up... then told an alternate version of the same story that had her family traveling south by ferry to Juneau from Skagway for treatment of her brother's burned foot, rather than to Canada, according to a 2007 report posted by the Skagway News.

    The tone that CNN uses in its write-ups about Palin is unbelieveable. Even here, it is like they are trying to justify this criminals actions by saying that the information he used to access her password was "freely available online" and that her e-mail address was "posted on numerous Web sites at the time." Why does that matter? He is the criminal. But yet, he gets more respect from CNN than Palin does.

    I don't have much of any respect for Sarah Palin, but we all have a right to privacy.

    Also, I'm not so sure that CNN's description of how he guessed the password was meant as justification of his offence, but rather as a example of how easy it can be to hack into an e-mail account if you are not careful about it. There is no excuse for what David Kernell did, assuming he is found guilty of course, but that is also not an excuse for not taking appropriate measures to protect yourself from people like that.

    He guessed the password using information publicly available? In other words her password was something one of names of he kids. What a moron. Can we trust the country to someone who cant even pick a secure password? Answer is obviously no, but you people are morons and want someone like you in office.
