Palin to testify in e-mail case

(CNN) - Sarah Palin and her husband Todd will testify in the federal case against a Tennessee man who allegedly accessed Palin's private e-mail account during the 2008 presidential race, Palin's attorney told CNN Thursday.

"Governor and Mr. Palin have been asked by the U.S. Department of Justice to testify in its ongoing criminal prosecution in the case of U.S. v Kernell," attorney Thomas Van Flein said in a statement. "The Palins expect to testify in person in Knoxville, Tennessee."

The case involves University of Tennessee student David C. Kernell, the 22-year old son of a Democratic state representative.

Kernell was indicted in October 2008 after he allegedly used information freely available online to guess the password to Palin's personal Yahoo! account, the name of which was posted on numerous Web sites at the time. Kernell accessed the account around the same time questions were being raised about Palin's use of personal e-mail accounts to conduct state business as governor of Alaska.

After gaining access to Palin's account, Kernell allegedly reset the password, scanned her account for potentially damaging information and posted the new password to a public Web site.

Federal prosecutors broadened their case against Kernell in 2009, charging him with four felonies: identity theft, wire fraud, computer fraud and obstructing a federal investigation. Kernell has pleaded not guilty to all four counts.

A federal judge has set the trial date for April 20.

Reached by CNN, Kernell's attorney Wade Davies declined to comment on the case.

    Like many others I'm tired of hearing about Mrs. Palin. Also can the press stop calling her Gov. Palin, she quit, remember!! I know that retired or former Gov's are still referred to as Gov, but she didn't retire, or get voted out of office (she didn't wait for that to happen, which it would have), she QUIT! So lets stop calling her Gov, she's not. As far as her testifying, do you really think she' can tell the truth about anything? Under oath or not, I don't think she even knows what the truth is, just what sounds good at the time, or what will help her get more press. The press relly needs to back off of this person. Really, enough is enough.

    Hey Mark: Sarah has not always been "forthright and honest." When she was first introduced to the country she looked directly into the camera and said "I told them thanks, but no thanks" (referring to funding for the Bridge to Nowhere). You go check the facts and tell me she was honest. She's a polictican and politicians by nature can't help but lie.

    1) she told interviewers there was no family vote on teh VP. she later recounted this by telling Sean Hannity that there was, in fact, a vote.

    2) Palin allegedly blamerd McCain campaign staff for botching her public appearaces and not allowing her to speak freely. In emails, however, she blamed herself and thanked these same staffers for their hard work.

    3) Palin stated she does not support Alaskan wolf huting, despite the fact that in 2007 she approved a bill allowing airborne hutning of Alaskan wolves.

    4) Palin repeatedly claimed she was a frugal flyer, despite the fact she and Bristol spent four (4) nights in a hotel at just under $708.00 a night and billed the state (Alaska) $20,000 for the travel costs of her children.

    5) Palin advuised her voters she made her campaign on small donations and turned her back on large checks over conflict of interest, when in fact she relied heavily on large donations and political action committees adn took over $1000.00 each from a couple whose offices were later raided by teh FBI.

    The fact is, this woman is SO untrustable you can't believe a word she says – even if it's "hello".

    PS: I grew up in Alaska and, although I am Democrat, I was excited to see an Alaskan vice presidential nominee. I was hoping she'd represent my honestate in a golden, shining light. But she failed – and she has harmed my honestate. Thankfully, she quit... but the effects of her presence will be felt for years to come.
