Washington (CNN) - The Senate Judiciary Committee on Tuesday approved the nomination of Solicitor General Elena Kagan to become the nation's fourth female Supreme Court justice, setting up a final confirmation vote by the Senate.
The committee vote broke down mostly along partisan lines, with one Republican joining the panel's Democrats in sending the nomination to the full Senate on a 13-6 vote.
Democrats repeatedly characterized Kagan as a strong legal thinker who would be a fair judge, while Republicans slammed her as an inexperienced activist who would be unable to divorce her legal judgments from her political opinions.
Members on both sides expressed frustration with a confirmation hearing process many observers say increasingly yields few clear answers about a nominee's judicial philosophy.

Once again, a nominee for a critical responsibility affecting the future of this nation is allowed to skate - not truthfully answer or fail to answer questions put to her. It is becoming more and more apparent that the Senate's Constitutional respnsibility for "advice and consent" continues to be watered down and the loss is becoming more and more acceptable to the Executive branch of government (both parties) and the electorate. Integrity is no longer a characteristic required by those who's egos and personal agendas are the driving motivation for government "non-service".

Listen, if we have to live with "the Roberts Court" (you know the one who thinks international corporations should have the same rights as an American citizen) then we should at least be allowed a few justices that don't make us throw up a little bit in our mouths ever time we hear their names. Republicans don't care what race or sex the supreme court nominees were. They just don't want a couple Obama rubber stamps–which we now have (for the next forty years).
Sotomayor already showed that she was willing to say whatever to get the nod. During the approval process she said that she would stand up for the Second Amendment. Yet, she was one of 4 Supreme Court judges to support a gun ban (last month).
Kagen might be good. I hope so. Much like Obama, we have very little evidence of past experience to judge her from. Hopefully she doesn't pull and Obama and give us what we didn't want in the name of 'change'.

His (my assumption, could be she) assertion that Sotomayer lied is another piece of republican misinformation. What about Roberts and Alito statement concering stare decisis? They worshipped at that altar during their confirmation hearings and then as soon as they had an opportunity to overturn over 100 years of precedent, they did it. Now that is what I call an activist court. Kagan, with her intellect, will be a real challenge to the right-wing cabal that currently dominates the court.
The bottom line is that she has been approved by the judicial committee today, obviusly majority is convinced with her capability, and they and then the majority in the full Senate will confirm her for this position. Any voices against her will then have to keep quiet.
Jeff Sessions is just having a fit because she is superior to him and his confirmation was derailed. Meaning, he was not worthy of being on the U. S. Supreme Court.
She is gifted in reading. Her experience as a solicitor general has prepared her well for this job. And what scares the Republicans the most is that she will be able to judge whether the laws the Senate & House passes meet and surpass the constitution.

Very rare for me to congratulate a Republican - but Lindsey Graham's vote for Kagan is a pleasant surprise ... maybe there is hope for less partisanship in Congress ... and note I think that the Democrats play politics as well - everyone just needs to grow up!!! Thanks Senator Graham!
