(CNN) – Republican presidential candidate Herman Cain said it would be "great" to impeach the president, but that the Democratic controlled Senate would prevent such action.
On a conference call with bloggers Tuesday night, the former Godfather's Pizza CEO called the health care law and the Obama administration's stance over the Defense of Marriage Act impeachable offenses.
The news was first reported by POLITICO and later confirmed to CNN by the Cain campaign.
"There are a number of things where a case could be made in order to impeach him, but because Republicans do not control the United States Senate, they would never allow it to get off the ground," Cain said on the call. "The president is supposed to uphold the laws of this nation … and to tell the Department of Justice not to uphold the Defense of Marriage Act is a breach of his oath."

Would Cain have called for impeaching Lincoln since he did not support slavery which was they law of the land? Would Cain have called for impeaching Kennedy as he fought the Jim Crow laws since they were also the law of the land? Would Cain say that the Civil War was wrong and all those Union soldiers that lost their lives freeing his relatives died supporting an illegal cause? Should all those that died in the 60s and 70s trying to bring equal rights to Blacks also feel their efforts were illegal. Using Cain's logic blacks should return to the fields as slaves and equal rights should be written out of the history books since both were unconstitutional acts against settled law.

2. The health care bill may or may not be unconstitutional but its hardly a criminal offense, Obama would not be the first, and prob not the last if the Supreme Court struck it down, right now no one knows if its unconsitutional,.
3. The administration is not appealing the RULING of the lower courts that struck down DOMA, however, they are still enforcing it since i believe its on appeal, Mr. Cain is misrepresenting the facts to the point of pants of fire, and that should never be toleratted
