(CNN) – Republican presidential candidate Herman Cain said it would be "great" to impeach the president, but that the Democratic controlled Senate would prevent such action.
On a conference call with bloggers Tuesday night, the former Godfather's Pizza CEO called the health care law and the Obama administration's stance over the Defense of Marriage Act impeachable offenses.
The news was first reported by POLITICO and later confirmed to CNN by the Cain campaign.
"There are a number of things where a case could be made in order to impeach him, but because Republicans do not control the United States Senate, they would never allow it to get off the ground," Cain said on the call. "The president is supposed to uphold the laws of this nation … and to tell the Department of Justice not to uphold the Defense of Marriage Act is a breach of his oath."

Perhaps Mr. Cain should read up on Concstitutional law, especially the way impeachment works. The House of Representatives draws up and votes on articles of impeachment. If enough Representatives vote for impeachment, the Speaker of the House delivers the articles of impeachment to the Senate. The Senate is then REQUIRED to try the impeached individual (not just the President) on the articles. It's not up to the Senate whether someone will be impeached, it's up to the House of Representatives.
50 mollion dollars and a gridlock congress for a couple of years was the doing of Ken Starr during the Clinton administration, do you realy want the same thing again?
Lets demand Congress work as hard as we do.. and get things done..
GOP can't just stop impeaching Democrats for no good reason. Shameful.
You would think a guy running for president would - or at least should - know that impeachment is done by the House of Representatives, not the Senate.
lunatics.
lets just impeach every president we disagree with. like it or not, obama won an election. in america we wait for another election before getting a chance to undo it, except in rare cases. disagreeing with his policies is not a rare case that lets you trump the rights of those that voted for him...
He is an idiot!!!! ( and so are the rest of the republicans also)
This election will go down in history as the most embarrassing assortment of idiots to have ever run for office.
Cain??? How low in the polls do you have to fall before we don't have to hear from you anymore???
I dislike Obama as much as the next conservative, and as much as I disagree with him, he hasn't done anything that warrants impeachment. If Cain thinks he has, he doesn't understand impeachment.
Kevin, car insurance is a non-issue. Liability insurance is required in most states to protect the people you may injure or the property you may damage. It protects other people. And besides, it's not a national law.
Why impeach President Obama? He's done all he can considering how helpful and supportive everyone in Congress and the nation has been. He has inherited a great weight of problems from the last president. Apparently people have forgotten that (as seen in the November elections). Wisconsin can't even manage to impeach our governor who has to be a puppet for some Republican scheme. He has done everything wrong in the wrong way yet he hasn't done anything that can be used for impeachment. And by next year, most of the people in the states won't even remember who our governor is.
Let's face it; if we didn't impeach Bush for his disastrous presidency, we should never consider impeaching another president. Cain is an idiot who should not be given a forum for expressing his outrageous views.
Another conservative moron....get in line. What should happen is the Republican Congress should be tried for treason for holding up the debt ceiling raise. They only care about maintaining power and their own jobs. They don't give a damn about the people of this country. That, to me, IS TREASON.
Impeachment is almost the same as indictment. Clinton was impeached, but not convicted and that little political vendetta cost The Newt his job. Beyond that, The President of the United States, Barack Obama (elected by a majority of Americans) has not committed a crime except in the eyes of demagogues and morons like Cain.
Cain is a Republican, oh wait I just said that when I called him a moronic demagogue.
Really? You're going to impeach him over heath care legislation? Wow. If that's all it takes, we should start charging ol' Georgie boy for dragging us into two pointless wars. I'd argue that's much more of an impeachable action.
He's done, toast, he even had a few good ideas but only for business. Where do these idots come from. If any of these people get elected then this country is toast as well.
Must be Alan Keye's TWIN or best friend. Both don't have a clue. Wonder if the Tea Party have come up with bumper stickers with "Run, Herman, Run" on it yet.
An edible pizza from Godfathers would be a "great thing" too but it aint gonna happen either.
Well after those statements looks like another Republican clown looking for name and wealth but not actually seeking the Presidency.
ask Cristi if the Prez should be impeached. Republicans, ridiculous
If we couldn't impeach the dynamic duo of Bush and Cheney for all of their crimes, then we certainly don't have anything on Obama to impeach him. Cain... and the whole group of right wing conservatives... are just a bunch of selfish, narrow minded, greedy morons.
I've read through a lot of comments on here and though some are good intelligent arguements, some are just name calling and bullying(Randall in Torrance: Navy veteran (retired), Christian, Double Master's Degree in Political Science and fed up with Palin, Bachman and the un-holy GOP trinity, *ahem*). Now I'm not saying that you don't have the right to express your opinion but please keep it in a respectful tone. Seriously, most of you seem to be adults and I don't hear this much name calling at the after school children's program I work with.
So, Mr. Cain, so how do you explain that the courts cannot agree on whether the health care law is constitutional? Oh, you want to ignore the courts.
I wish he said this when Bush was president. I guess Me. Cain was busy creating $7 an hour jobs with no benefits at his pizza shop
Wow ...there's only one thing you can impeach a president for.. . and that's for.getting a hummer in the Oval Office...brush up a little bit Mr.Cain
