Federal appeals court blocks state lawsuit over health care reform law

Washington (CNN) - A federal appeals court has tossed out Virginia's lawsuit against the sweeping health care reform effort championed by President Barack Obama, after the three-judge panel concluded Thursday the state lacks the jurisdictional authority to challenge the 2010 law.

The unanimous decision sets up a certain Supreme Court review in coming months.

    Let' s look at this from a more practical standpoint. If it's illegal to force people to buy health insurance, then it's illegal to force people to buy car insurance. If a driver gets into a wreck and doesn't have insurance, then the state can no longer arrest them for driving without insurance because it's ILLEGAL to force someone to buy insurance.

    That should force insurance providers to come down from their ridiculously unaffordable prices and rates just to get anyone to buy their "commercial product."

    I'm as liberal as they come. But I think the mandate is unconstitutional. I don't believe the government can MAKE me buy something. But what the government CAN do, is tax me...and take that tax money and provide me health insurance.

    I like taxes when they are used for useful things, like roads, police protection, fire emergencies, teachers, public parks, and other things that benefit the public. I would like to add health insurance to that list of things. It would benefit the country to have EVERYONE able to be covered and able to get medical care.

    The mandate that obama said over 20 times in 2008 – that he wouldn't support – is excessive & unfair – just like he said!!!

    It also won't lower costs (like he also said) in the IA debate vs Hillary – The mandate will give more profit to big insurance & its only favored by 36% of voters!!!

    DOWN WITH THE MANDATE!!!

The only difference is that they have destroyed this country, turning us into a nation of service-industry emplyees with few options for recourse than we used to have.     As usual, this is terrible reporting by cnn. The court did not rule on the constitutionality of the law...they just ruled that the state itself could not file the suit because the individual mandate imposes no obligations on the state itself, thus the state is not a direct injured party. Liberty University also filed suit but the court dismissed their suit because it was too early as the mandate had not yet come into effect.

    Important to note, but not shockingly omitted by cnn is that of the 3 judges on the panel, 2 were appointed by President Obama and the other by President Clinton. The reality, like I said last time the lower court had sided with the state, is that this will be settled by the US Supreme Court.

    No country in the world that has a working medi care system can function without the whole entire country joining and paying into the system. The only cost effective measure is to have the entire country under the same unbrella.
