Appeals court refuses rehearing on California's Proposition 8

(CNN) - The divisive issue of same-sex marriage in California may become another landmark case taken up by the U.S. Supreme Court after federal appeals court judges refused Tuesday to revisit an earlier ruling.

The 9th Circuit U.S. Court of Appeals in San Francisco denied a request to re-examine the constitutionality of Proposition 8, California's voter-approved referendum defining marriage as only between a woman and a man.

    Referendums should never be used to determine civil rights. Referendums are for tax rates, term limits, school budgets, and other things, but never civil rights. The minority would always lose.

    These clowns have been overturned by the USSC more than any other circuit. It'll happen yet again here. The voters must be allowed to determine the laws, NOT appointed judges.

    So it is OK for the majority to vote on stealing the money of a minority of the population but not other things???? Why is somebody's hard earned money any different and subject to no protection from theft of the majority??? Maybe you think their land and other property can be taken by vote as well???

    Just wait till President Obama is re-elected and Govener Walker is thrown out.The GOP is going to freek out .I can not wait for today and Novembers election.The majority of the people of this country are going to take over and send the most important message to the world that NO money is a match for the peoples voice period.The Republicans are in deep do-do.Finally !

    Please don't take this the wrong way..... I understand this issue means a lot to a lot of people and I believe everyone should have the same rights BUT, we have bigger fish to fry. People need jobs that pay enough to support their families. We have the debt ceiling crisis once again and we all know the obstruction the POTUS will face there. The immigration thing is crazy. This country started with immigrants who pulled off the biggest unarmed robbery in history. They stole an entire country, yet we don't want any immigrants now? I am not taking anything away from the gays, I just think we have more important issues to focus on.

    The USSC should allow the majority opinion to stand. Call it a civil union if the gays have to have a name. It should not be called a marriage.

    I was responding to the assertion that "Referendums are for tax rates".

    As for consenting male and female adults, I agree. Marriage has had a definition for hundreds and hundreds of years and that definition does NOT mean a man/man or woman/woman "marriage". You need to call this something else because it is NOT marriage. Make up a name for it and get the government to recognize it as whatever it is you named it. Do not pervert what men and woman have held sacred for several thousand years. Thank you for your cooperation in this matter.

    The reason why the judges wont revisit this case is because blocking/banning const.itutional rights to a certain segment of the population is....unconst.itutional! This notion that marriage was ordained by God to mean 1 man & 1 woman is patently false! I'm reading the bible again to educate myself in these days of using the bible to promote discrimination! In biblical days the richer a man was the more wives & concubines he had, which was also a sign of his wealth! Polygamy was the way of the world for millennia & God was apparently OK w/that, because I have yet to read a scripture condemning it! Until the 20th century marriages were arranged by families in order to secure standing & wealth! Many young lovers were wrenched apart in order to fullfill their families expectations! That is a short history of marriage, which has evolved into the freewill marriages of today! My take is that God is fine w/our evolving definitions of marriage, as long as the children are protected!!

    while they are at it, they should also debate the theory of evolution, nature creating a species that cant reproduce? Science can explain it simply, your genes have been selected for extinction nature is saying that, not the bible
