Even in dissent, Scalia stirs controversy

(CNN) - Supreme Court Justice Antonin Scalia is known for bold disagreement, conservative arguments, pointed questions and the occasional crude hand gesture, and still, it's been an intense few months for one of the high court's most polarizing figures, with biting insults hurled in his direction.

Last month, Scalia dissented in the U.S. Supreme Court's 5-4 health care ruling, writing that the court undermined values of "caution, minimalism, and the understanding that the federal government is one of limited powers."

Get a rare look inside the Supreme Court when Piers Morgan has an exclusive interview with Justice Antonin Scalia at 9 p.m. ET tonight on CNN.

    Do limited powers of government include leaving women's reproductive rights alone? Or does he think that right wing causes are OK when it comes to big government. Time to retire, Scalia.

    To say that Scalia is known for "conservative arguments" inflicts a severe disservice and insult to true conservatism. Scalia is a tailess monkey whose activism on the bench benefits an extreme vision of a do-nothing America, of a self-inflicted power vacuum where rightwing drama queens can rule the day.....there is very little in Scalia that speaks of the conservatism of our founding fathers.

    Scalia is a firm believer in the Constitution AS IT WAS WRITTEN, and should be interpreted in the language as the framers interpreted it. Unfortunately for him, those same framers believed the Constitution was a living document that would change and could evolve to suit the needs of a growing republic. Or, at least that was part of the Federalist papers as written by James Madison, Alexander Hamilton and John Jay. As those responsible for the draft of the document that was approved by the Constitutional Congress in Philadelphia I have more trust in their opinion of the Constitution than the opinion of a Justice who believes that document should be frozen in time to how it saw things in 1788. Based on that limitation, the decisions that John Jay made as the first Chief Justice could be called into question, too!

    Thank-you. And when a major political party gets their marching orders from Rush, it is time for them to go. Mitt Romney will take his orders from the leading conservative thinkers. Guess who? Limbaugh, Hannity, etc. Not one Republican stands up to those guys, and always cave in to their stated positions.

    A bill becoming a law must maintain it's integrity as far as how it was passed. When a law is changes at the SC level it is in fact activism.

    remember the good ol' days when you could trust the SCOTUS and it wasn't so partisan? He and the likes of Clarence Thomas should NOT be out supporting right wing functions no more than the left leaning part of the court should be out supporting left wing functions.

    Hang in there Scalia. People hate you because you actually know the Constitution, the Federalist Papers, and the theory of government that is republicanism (small R). The short-foreheads cannot understand you because they have been educated in fantasies of liberal-land. Thank goodness there are a few on the Supreme Court who know the role of a judge in what was meant to be a federal government of enumerated powers.

    ===============================================================================================
    I do not recall the Constitution including the right to kill another under the guise of "reproductive rights". Wouldn't it more accurately be called "the right to not reproduce" which would be abstinence? Once another life is involved, the question of "reproduction" has already been decided. Liberals simply want to choose to disregard the rights of the child and sentence them to death. And you all call yourself "compassionate"???

    Agreed, especially when the very topic of tax versus penalty was openly discussed and decided. Roberts ruled on a bill which did not in fact exist until he rewrote it in his decision. He has severely tarnished his legacy and that of the court. Now it is up to the people to decide the issue once and for all this November. Dump Obama and Obamacare. Remove the leftist Democrats from the Senate. The will of the majority WILL be done.

    Republicans are concerned about the rights of the unborn, but turn their back on them after they come into this world if they are poor. And to think republicans think they are compassionate.
