Washington D.C. police investigating whether NBC moderator violated law

Washington (CNN) - Washington Metropolitan Police Department is investigating whether NBC's David Gregory violated D.C. gun laws when he displayed what he described as a 30 round magazine as part of an interview during Sunday's "Meet the Press."

A spokeswoman for the department said Wednesday that a representative for NBC inquired ahead of the broadcast about using the high-capacity magazine, which Gregory displayed while interviewing the executive vice president of the National Rifle Association.

The department spokeswoman, Tisha Gant, said the police told NBC they could not use the magazine, since possessing a large capacity ammunition device is illegal in the District of Columbia. Gant said the matter is under investigation.

On Sunday, Gregory used the device while asking the NRA’s Wayne LaPierre whether banning such magazines could help lessen the impact of deadly shootings.

"So here's a magazine for ammunition that carries 30 bullets,” Gregory said, holding up the black, rectangular device. “Now isn't it possible that if we got rid of these, if we replaced them and said well, you can only have a magazine that carries five bullets or ten bullets, isn't it just possible that we could reduce the carnage in a situation like Newtown?"

It's not known whether the magazine Gregory had in his hand was authentic or a prop.

Possessing a large capacity ammunition device, such as a magazine, is illegal in the District of Columbia if the device holds more than 10 rounds of ammunition. The code also specifies the large devices are illegal regardless of whether or not they're attached to a firearm. Gregory showed the magazine Sunday without a firearm attached.

NBC's studios, from which "Meet the Press" is broadcast, are located within city limits. The network did not have any comment on the matter Wednesday.

In the wake of the school shooting in Newtown, gun control advocates have been pushing for a limit on high capacity magazines. Such a restriction is one of the items President Barack Obama mentioned last week when he announced an administration effort to curb violence.

"I don't believe that's going to make one difference," LaPierre told Gregory during the show.

Several conservative commentators first raised the issue of whether Gregory had broken D.C. law by using the magazine.

    La Pierre and the NRA are going DOWN. The public just can not stand this kind of violence any longer. The gun/ammo manufacturers are funding the NRA with La Pierre making a cool $1million a year salary.

    Whether Gregory broke the law or not ..it's about time that a lot of non believers were able to see just what"killing machines" that have NO place in our society ,look like..!!........What earthly use is there for something like this unless it is in the hands of legal law enforcement???Home security...hardly.....hunting? I think it would tear apart any thing it subsequently hit~ a human target??????goes without saying!!!! ...... Wake up America....while there might be acceptance of some forms of arms....the equiptment out there right now has proven deadly beyond any understanding!!!!!

    iF HE HAD A FIRE ARM OR WAS TRYING TO CONCEAL MAGAZINE THAT WOULD BE DIFFERENT. HE WAS SHOWING IT SO PEOPLE WHO DON'T KNOW ANOUT THESE MAGAZINES COULD SEE WHAT ONE LOOKED LIKE! HE WAS INFORMING WE AS A NATION NEED MORE NOT LESS INFORMATION.

    KEEPING IT THOUGHTFULLY HONEST: David Gregory was making an appropriate and strong visual point by displaying a magazine for ammunition of 30 bullets! End of story! So David Gregory did not violated D.C. of gun laws when he displayed what he described as a 30 round magazine as part of an interview during Sunday’s “Meet the Press.” and is a JOKE! Washington police have better spend of their tax payer money time going after the criminals with guns with magazine ammunition!

    Because the DC Police Department has nothing better to do of course except 'investigate' something that clearly had no malice intended, was meant as a 'teaching/demonstration' device, and with no firearm even in the room much less attached is simply a metal box with no potential for danger greater than a popcorn tin. Well done. Tax dollars well spent in protecting the citizenry. *sheesh*

    Would banning high capacity magazines and placing a limit on magazine size of 5 or 10 rounds make a difference? Go to youtube and search for "fast magazine changer" for the answer.

    This seems to be some extension of ad hominem abuse to sideline the argument that is being made regarding the killing reserves of large ammo magazines. I believe that there are considerably more demanding matters that conservatives (and others) should address rather than a visual aid in a debate session. There is a very small step from the sublime to the ridiculous. Gun control and its related issues will remain disputable for a very long time, the situation regarding our national budget and the constricting timelines are far more nascent.

    So if I teach my son how to drive fast, but do it in a responsible manner and do it to show him how to drive and how not to drive I'm ok if the police stop me? The law is the law and if LaPierre were smart enough, when asked if we should make these magazines illegal, he should have responded "How did you get one here". The discussion we need to have needs to be done rationally and done by the "numbers". The antigun crowd wants to ban a type of weapon that is used in less than 2% of firearm homicide. If there are a little less than 12000 homicides by firearm per year than assault guns account for 240 deaths per year. There are a little over 5 million assault gun owners...so you antigun people want to deprive over 5 million law abiding gun owners of a weapon that accounts for .0008% of gun homicide in the US??? The facts I cite are from the FBI and CDC not from the NRA or some pro gun group. I am a gun owner and yes...I think many things can be improved, such as having everyone do a background check...but banning types of guns is simply ludicrous. Incidently, semiauto pistols account for a little over 67% of homicide by firearm.

    I'm a little weirded out that it's conservatives doing this. I mean - doesn't using gun control laws to give David Gregory a headache sort of, you know, endorse those laws? And yet they're doing this to 'support' La Pierre... who is ardently striving against gun control laws.

    Your posting proves why gun sales are soaring. Those unable to make rational decisions for themselves and only able to repeat right-wing sound bites are buying guns like crazy – just like they did in 2008. Ironically, you "shot yourself in the foot" with your purchases – driving up prices of guns and ammunition so those of us who actually hunt had to pay the "moron tax".

The DC Police are investigating David Gregory, when they should be going about The People's Business of Investigating all the Unsolved Crime committed by REAL CRIMINALS!!
