Holder involved in decision to ask for search warrant for reporter's private emails

Washington (CNN) - Attorney General Eric Holder was involved in the Justice Department's decision to seek a search warrant for Fox News reporter James Rosen's private e-mails, a Justice official told CNN.

The decision to apply for the search warrant was vetted at the department's highest levels, including Holder, the official said, although the decision to issue a warrant was made by a federal magistrate judge.

The Obama administration's aggressive posture against leaks to reporters on national security matters has come under scrutiny recently as probes of Rosen and Associated Press reporters have come to light.

It prompted Obama to announce on Thursday he has directed Holder to review federal guidelines for investigating leaks and reporters. That review will include assembling a panel of media representatives.

Justice Department officials dug into the phone records of AP reporters, including work, cell, and home lines, the news agency said earlier this month. It said investigators were looking into its account of a foiled plot to bomb a U.S. airliner in May 2012.

AP reporters were never labeled as suspected criminals, but an FBI affidavit used to obtain the warrant for Rosen's e-mails described him as potentially being an "aider and abettor and/or co-conspirator" to the crime of disclosing government secrets.

That case centers on a 2009 Fox News report on classified intelligence about North Korea.

No charges have been brought against Rosen or Fox News.

Obama said Thursday he was "troubled by the possibility that leak investigations may chill the investigative journalism that holds government accountable."

    Didn't some court in Florida rule a few years ago that Fox did not have to report things truthfully because they were an entertainment station and not a news report? Hence, they do not have reporters, only clowns.

    Funny how CNN once again sat on a news story that made Obama look bad. Even MSNBC covered it hours before CNN. And they are using the comment section that they heavy edit and stop to many negative comments about the White House and their failures.

    Is a threat, of any kind, is perceived it must be investigated.
    I don't remember the rethugs making a big deal after 9/11 of the shrub's administration taking away some of our rights.
    This is the same party that at a state level are quietly taking away civil and human rights from everyone and nobody, including the press, cares one bit.

    Our rights are under attack. Freedom of the press is one of our rights. It helps keep government in check, but it only helps keep government in check if we the people pay attention. America contact your reps and say enough is enough. We the people expect you to serve us with integrity. It used to be said we the people are the government, but with every abuse of power we lose some of that control. I don't care if you are a Republican or a Democrat. We should expect integrity from our leaders, because in the end we put them there.

    Well there you have it. Holder is the typical Obama cronie. First they play like they had no knowledge of their actions but we find later that he was directly involved. This administration is so corrupt and it is blatant. With all the corruption and scandals going on yet Obama still claims that he knew nothing of all the issues. Really?! Is the president that far out of touch or ignorant that he does not know what his own administration is doing?!

    Nixon was forced to resign over a scandal that pales in comparison to the depth of the scandals of Obama's administration. How can the current congressional body not impeach for the number of scandals which have involved the death of several American citizens.

    AG Holder has now been caught in a lie to congress twice. Once in the Fast & Furious hearings, which he escaped via a presidential shield and now for a second time with the Fox/Rosen incident. In that congress is our representative, he has lied to us all.

    This administration which came in with such support of hope has been a terrible disappointment. It has been hyper-political, divisive in that it has sought to divide us even further by pitting one group against another, and it has been anything but transparent.

    Obviously there are those who will excuse whatever bad deeds are done by this administration, but at some point we're going to have to let go of our tribal adherence to our party and deal with this government's misdeeds. Chalking it all up to right wing fanaticism just doesn't pass the smell test these days.

    Some cracks are just now beginning to show. Let's hope we begin to behave rationally and do what's right for ALL of us.

    Yet another development today in the case of James Rosen, the Fox News reporter who was monitored by the Justice Dept. after receiving classified information from a State Department security adviser.

    According to The New Yorker's Ryan Lizza, the Obama administration fought to keep the search warrant for Rosen’s private e-mail account secret on the grounds that they might need to monitor the account for a long period of time.
