High court avoids larger ruling on university's affirmative action admissions policy

Washington (CNN) – The Supreme Court side-stepped a sweeping decision on the use of race-conscious school admission policies, ruling Monday on the criteria at the University of Texas and whether it violates the equal protection rights of some white applicants.

The justices threw the case back to the lower courts for further review.

    I'm not a lawyer and therefore no expert, but this seems like a cowardly ruling to me. The Supremes are getting into a bad habit of punting on controversial legal issues. We'll have to start calling it the Supreme Fence.

    I believe that Roberts is concerned about the publics view of the Supreme court which is under question in the face of Citizen`s Unired. This ruling to kick it back to a lower court saves the SC from having to make a nationwide decision. It also doesn`t require justices to display idealogical biases as much as the typical 5-4 ruling.

    Supporters of AA would be smart to get aggressive & proactive about the use of the court. Smart about the cases that come before it and smart about the future composition of the court.

    It's not like the young lady who filed suit didn't get to go to college at all because of being denied at UT. She doesn't come across very well in each of her interviews that I've read or seen. Seems a bit brattish. I agree with the Supreme Court ruling.

    Like Justice Thomas, for instance? Talk about Liberal fail! But then affirmative action has never been about screening for ideologies, just about trying to act out a principle: equal opportunity for all. If you want to claim that conservatives are only interested in promoting injustice, inequality and lack of opportunity then I would be quite happy to agree that equal opportunity is part of only the liberal agenda, and that far more Americans are liberal than conservative on the question.

    I just read your comment regarding AA. I would like to say Thank you for that wonderful post. You were right on the money with everything you said. It might even be the best post I have read here before and that's saying a lot considering we do have some very insightful, intelligent posters here like The Real Tom Payne, Sniffit, Dominican Mama, A Kicking Donkey, Data Driven, and many others!

    This case was dishonest from the start. The process underwhich the carefully CRAFTED platiff in this MANUFACTURED case to challenge Affirmative Action was denied entrance to the U of Texas [she got into a Louisiana college] is COLOR BLIND.

    Had this girl been in the top 10% of her HS class she would have gotten admitted, regardless of color. Of all the other admitees to U of Texas [white, Asian, Latinos, and African Americans] they all went thru the same process which the University has the right to do. There were whites admittted. There were whites declined. This girl simply fell into the group that was declined. The same was true of blacks, asians, latinos. Some got in. Some didn`t.

    BTW, this ruling isn't a copout and conservatives should be pretty satisfied with it. 7-1 voting in favor of telling the lower court that it applied the wrong standard and that it should re-do its decision applying "strict scrutiny," the highest level of scrutiny for race-based analysis, is somewhat of a victory for those who oppose affirmative action.

    Skype me from the conservative FEMA camps when it's your turn to use the monitored computers and we'll discuss it then lol. For now I'll just say that you shouldn't confuse demographic voting power with whether institutionalized discrimination has been suddenly, magically stamped out. It is one thing for certain demographic groups to hold the advantage of numbers in the voting booths, but entirely another as to who holds all the "cards"...money, power, influence, assets, business ownership, positions of power...in terms of hiring, college admissions, etc.
