By tiny margin, Dem declared official winner in Virginia AG race; recount uncertain

(CNN) - The Republican who lost by a sliver in Virginia's attorney general will wait a few more days before deciding whether to request a recount, his campaign said Monday.

The announcement came the same day as Virginia's Board of Election's ruled that Democratic state Sen. Mark Herring officially beat Republican state Sen. Mark Obenshain by 165 votes out of about 2.2 million.

When calculated, the vote margin is about .008%. If a candidate loses by less than 1%, he or she is allowed to petition the board for a recount after the votes are certified.

Now that the board has made the vote count official, Obenshain's campaign manager Chris Leavitt said they'll continue to review the results over the next few days before they decide whether to request a recount.

According to the state's election law, Obenshain has 10 days starting from Monday to file for a recount.

"A decision to request a recount, even in this historically close election, is not one to be made lightly," he said in a statement. "We will make further announcements regarding a recount well within that time, in order to ensure the closure and confidence in the results that Virginians deserve."

Virginia election law states that the counties and cities involved must pay for a recount if the vote margin is less than .5%, meaning the recount would be free for Obenshain.

The law does not allow candidates to challenge absentee and provisional ballots that were ruled invalid, or the eligibility of voters. It does, however, allow candidates to challenge whether or not standard ballots were tallied correctly.

With Monday's certified results, Democrats as of now have officially swept all three top-of-the-ballot, statewide offices in the commonwealth for the first time since 1989. Those offices include governor, lieutenant governor and attorney general.

"I am gratified that the State Board of Elections today certified me the winner of a close but fair election," Herring said in a statement, thanking the board and election officials for their work to "bring this historic election to a close."

But voters must wait until Obenshain makes a recount decision. His deadline is December 5.

    Another close election stolen by the Democrats with voter fraud. Why do you think they don't want IDs for voters? All it took was a few hundred fraudulent voters to swing this contest.

    What historical re-write are you creating now? Didn't they have Voter ID laws in place in Virginia this year? Wasn't all of the balloting done electronically, and counted by the Republicans? The Republicans cheated and still got swept in the three major races in Virginia.

    So, what else do Republicans have up their sleeves? I'm still waiting for these "corporation people" to start demanding the right to vote. I know that's coming, but Republicans just cannot figure out how to get around the "one person, one vote" problems that doing so creates.

    How many? Zero, none, zilch. All balloting at the pollls was done electronically. Stop making stuff up that couldn't possibly be true. Furthermore, the statewide elections were administered by the Republican Party in Virginia because they ran the state. Well, they used to run the state. Not anymore.

    Given that Virginia stripped thousands of minorities of their voting rights, just what evidence do you have to support your claim? I am guessing the usual for the Right- none at all. Face it Donna- the Right threw away Virginia with radical anti-abortion, anti-birth control legislation, and the stealing of basic civil and voting rights from minorities and the poor- and they got caught and paid the price at the polls.

    General irritation with Obama never actually did translate into votes for the GOP. Which is why, for me, it is so amusing to see the media go full speed ahead with GOP talking points.

    Apparently the GOP is having a difficult time articulating what they are for ... not against. I would imagine all Americans understood during his first year in Office that President Obama was going to be the talking point up to and including the 2012 election. What the GOP is still unable to grasp - and having gone to great lengths to alienate three quarters of voter demographics - is how to bring the folks they've insulted time and again back into the fold.

    Smearing Obama is not going to help. It never worked to begin with.

    It has become quite evident to me Data, that Republicans have an uncanny ability for repudiating any reality that does not conform to their objectives.
    A fascinating phenomenom really.
    I doubt that one of those true conservatives will see the result of Virginia's elections as a referendum on their Party's attack on women's rights and uanbated alienation of various key voting blocks.
    Instead they will claim voter fraud and the resucitation of ACORN before they face up to the fact that after five years of non-stop obstruction, and blatant pandering to the 1%ers, the voters have come realize that the Republican Party in its' present standing is NOT looking out for the interests of middle-class Americans of ANY color.

    I bet if I put up a fabricated story about Obama in league with Darth Vader, you would be on these comments tomorrow saying how Obama is a dictator like his friend Darth Vader. Don't just copy paste conservative rants without thinking.
