Federal judge rules Utah same-sex marriage ban unconstitutional

(CNN) - A federal judge in Utah has struck down the state's ban on same-sex marriage, saying the law "conflicts with the United States Constitution's guarantees of equal protection and due process under the law."

In striking down the state law, which voters approved in 2004, the judge ruled that the state's "current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason.

    Geez. The state had a vote and they voted for the ban. Now, we have a power hungry judge take away the people of Utah`s voice. We need to make a choice, the fed rules across the country or the states decide for themselves.

    1. Civil Rights are not up for vote. They are not subject to the whims and tyranny of the majority. That's the whole point of the Constitution and the judicial branch.

    2. We already made that choice in 1789. Two words: Supremacy Clause.

    Geez – Southern States went to war over slavery and lost. Southern states went red when voters' rights laws were enacted. This isn't the first time the government upheld the constitution over laws that states have enacted.

    And the Southern states voted for the Jim Crow laws. It does NOT make it right, huh SMITH

    It does not deny anyone the right to marry. Here's the deal. Your birth certificate designates your gender. The state says you may only marry a person of the opposing gender. The state will not recognize the marital status of a same gender spouse. Therefore to enjoy those rights you must marry a person of the opposite gender or remain unmarried. The state of Utah has spoken and all of Utah's citizens are treated the same under this law. Any questions?

    of course you can. it happens every time democrats get elected. the peoples rights get taken away and obamacare is a perfect example of that. now we have the federal government dictating to all of us concerning our healthcare insurance needs and using it as a way of providing free and/or subsidized healthcare to others.
