			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong>WASHINGTON (CNN)</strong> - The Supreme Court on Monday refused to allow a lawsuit filed by former CIA operative Valerie Plame against onetime Bush administration officials to continue. </p>
<p>The justices offered no explanation for deciding not to hear the case brought by Plame and her husband, former Ambassador Joe Wilson. </p>
<p>The two accused then-Vice President Dick Cheney and other top officials of leaking Plame's identity to reporters in 2003, endangering her life as covert operative and violating her constitutional rights. </p>
<p>A federal appeals court had dismissed the lawsuit, saying the allegations do not fall under protections provided by the Privacy Act.</p>
<p><span id="more-57253"></span></p>
<p>The identity leak led to an obstruction of justice conviction for onetime Cheney chief of staff Lewis "Scooter" Libby. A jury found he lied to investigators about his role in the Plame matter. No charges were ever brought against anyone for actually leaking Plame's identity. </p>
<p>The case is Wilson v. Libby (08-1043).</p>

<p><strong>WASHINGTON (CNN)</strong> - A former Bush spokesman said Friday he did not think the president knew about the leak of a CIA agent's identity, but refused to give the same assurances about Vice President Dick Cheney.</p>
<p>"I do not think the president had any knowledge" of the revelation of Valerie Plame Wilson's identity, Scott McClellan said at a House Judiciary committee hearing. "In terms of the vice president, I do not know."</p>
<p>McClellan said the White House is still concealing information about its role in the leak of a CIA agent's identity.</p>
<p>"This matter continues to be investigated by Congress because of what the White House has chosen to conceal from the public," McClellan said. "Despite assurances that the administration would discuss the matter once the Special Counsel had completed his work, the White House has sought to avoid public scrutiny and accountability."</p>

<p><strong>(CNN)</strong> - The revelation by a former White House spokesman that President Bush and Vice President Cheney were "involved" in the leak of CIA operative Valerie Plame Wilson's identity shows how the White House "closed ranks" to protect themselves, her husband, Joe Wilson, said Wednesday.</p>
<p>The information - from an upcoming book by Scott McClellan - also shows how important it was to the administration to commute the sentence of Lewis "Scooter" Libby, Wilson said on CNN's "American Morning."</p>
<p>"I think it now makes it very clear the extent to which the vice president was involved, which, of course, then makes it very clear how important to the vice president the commutation of Mr. Libby's sentence was," the former U.S. ambassador said.</p>
<p><span id="more-3272"></span></p>
<p>Libby, who was Cheney's chief of staff, was convicted in March of perjury and obstruction of justice for lying to investigators and a federal grand jury about his contacts with reporters concerning Wilson.</p>
<p>Just before Libby was to report to a federal prison in July to serve 30 months behind bars, Bush commuted his sentence, although the president stopped short of a full pardon and Libby still had to pay a $250,000 fine.</p>
<p>"They basically closed ranks, guaranteed that the cloud (special prosecutor Patrick) Fitzgerald said was over the vice president's head would not be lifted. And now because of McClellan's statement, that cloud is over the president himself.</p>
<p>"He is either completely out of touch or he's an accessory to an obstruction of justice both before the fact and after the fact," he said.</p>
<p>"At a bare minimum, for openers, think it's incumbent upon the president and vice president now to release the transcripts of their statements to the special prosecutor, so we now have a fuller understanding of what they knew, when they knew it, and what they said to Justice."</p>
<p>In addition, the public deserves to know "whether or not they continue to frustrate the efforts of the Justice Department and the efforts of the government to get to the bottom of what is essentially the betrayal of national security of our country," said Wilson.</p>
<p>Amid a swelling controversy about the leak of Valerie Wilson's name, McClellan went to the White House podium in October 2003 and told reporters that Karl Rove, the president's top political adviser, and Lewis "Scooter" Libby, Cheney's chief of staff, had not been involved.</p>
<p>In an upcoming book, McClellan says five administration officials were "involved" in his "unknowingly" passing along false information about the involvement of Rove and Libby in the leak of Valerie Wilson's identity.</p>
<p>"There was one problem. It was not true," McClellan writes in his new book, "What Happened," which is to be released in April. "I had unknowingly passed along false information. And five of the highest ranking officials in the administration were involved in my doing so: Rove, Libby, the vice president, the president's chief of staff and the president himself."</p>
<p>McClellan does not explain what he means by the word "involved," nor does he give specifics about any actions taken by Bush, Cheney, Libby, Rove or Card with regard to McClellan's dissemination of the false information.</p>
<p>Reacting to the release of an excerpt from McClellan's book, which was posted Tuesday on the Web site of the book's publisher, PublicAffairs, White House spokesman Scott Stanzel said, "The president has not misled his spokespeople, nor would he."</p>
<p>The Wilsons believe the "outing" of her identity was an act of retaliation after Joe Wilson questioned of a claim by President Bush before the Iraq war that the British had learned that Saddam Hussein had sought to obtain uranium from Africa.</p>
<p>The Wilsons have sued Cheney, Libby and Rove over the leak, although a federal judge threw the lawsuit out in July on jurisdictional grounds. Joe Wilson said they are in the process of appealing, and hope the suit will be heard early next year.</p>
<p>On Tuesday, Valerie Wilson issued a statement saying she was "outraged to learn" that McClellan had confirmed "that he was sent out to lie to the press corps and the American public."</p>
<p>McClellan, who served as White House press secretary from July 2003 until April 2006, told CNN he's still writing the book and the excerpt was highlighted by the publisher to build interest.</p>
<p>Valerie Wilson's name was revealed in a column by Robert Novak in the summer of 2003, who cited "two top administration officials."</p>
<p>The lawyer for Rove, who left the White House in August, has acknowledged he was one of the sources. Rove was never charged.</p>
<p>Former Deputy Secretary of State Richard Armitage has said he was Novak's original source for the information, although he insisted the disclosure was not deliberate, and he did not know Wilson was a covert agent.</p>
<p>Because deliberately leaking a CIA operative's name can be a federal crime, a special prosecutor, Fitzgerald, was appointed to investigate. No one was charged in connection with the leak itself; Libby's charges resulted from statements he made during the investigation.</p>

<p><strong>WASHINGTON (CNN)</strong> - The White House is denying a claim in a new book by former White House spokesman Scott McClellan that top administration officials - including President Bush and Vice President Dick Cheney - were involved in his "unknowingly" passing along false information about the involvement of Karl Rove and Lewis "Scooter" Libby in the leak of a CIA operative's identity.</p>
<p>Amid a burgeoning controversy about the leak of Valerie Plame Wilson's name, McClellan went to the White House podium in October 2003 and told reporters that Rove, the president's top political adviser, and Libby, Cheney's chief of staff, had not been involved.</p>
<p>"There was one problem. It was not true," McClellan writes in his new book, "What Happened," which is scheduled to be released in April. "I had unknowingly passed along false information. And five of the highest ranking officials in the administration were involved in my doing so: Rove, Libby, the vice president, the president's chief of staff and the president himself."</p>
<p>Reacting to the release of an excerpt from McClellan's book, which was posted Tuesday on the Web site of the book's publisher, PublicAffairs, White House spokesman Scott Stanzel said, "The president has not misled his spokespeople, nor would he."</p>
<p><span id="more-3263"></span></p>
<p>The portion of McClellan's book released by PublicAffairs did not give any specifics about the actions of Bush, Cheney, Libby, Rove or then-Chief of Staff Andrew Card with regard to McClellan's dissemination of the false information.</p>
<p>There was no immediate comment from McClellan, who served as White House press secretary from July 2003 until April 2006.</p>
<p>In the excerpt, McClellan writes that "the most powerful leader in the world had called upon me to speak on his behalf and help restore credibility he lost amid the failure to find weapons of mass destruction in Iraq. So I stood at the White House briefing room podium in front of the glare of the klieg lights for the better part of two weeks and publicly exonerated two of the senior-most aides in the White House: Karl Rove and Scooter Libby."</p>
<p>In March, Libby was convicted of perjury and obstruction of justice for lying to investigators and a federal grand jury about his contacts with reporters concerning Wilson, the wife of Joe Wilson, a former U.S. ambassador who had accused the Bush administration of misrepresenting intelligence on Iraqi dictator Saddam Hussein's weapons of mass destruction in the run-up to the invasion of Iraq.</p>
<p>Just before Libby was to report to a federal prison in July to serve 30 months behind bars, Bush commuted his sentence, although the president stopped short of a full pardon and Libby still had to pay a $250,000 fine.</p>
<p>Rove, who left the White House staff at the end of August, was never charged in the case. But his lawyer has acknowledged he was one of two sources cited by syndicated columnist Bob Novak, who first reported that Valerie Plame Wilson worked for the CIA in the summer of 2003.</p>
<p>Former Deputy Secretary of State Richard Armitage has since acknowledged that he was Novak's original source for the information that Wilson worked at the CIA, although he insisted the disclosure was not deliberate and he did not know at the time she was a covert agent.</p>
<p>Because deliberately leaking a CIA operative's name can be a federal crime, a special prosecutor, Patrick Fitzgerald, was appointed to investigate the case. However, no one was charged in connection with the leak itself; Libby's charges resulted from statements he made during the investigation.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong>WASHINGTON (CNN)</strong> – Earlier today, a federal trial court judge <a href="http://www.cnn.com/2007/POLITICS/07/19/cia.leak/index.html"><strong>dismissed</strong></a> the civil lawsuit filed by former CIA employee Valerie Plame and her husband, former diplomat Joseph Wilson.</p>
<p>Judge John Bates explained in his ruling on Thursday that he was dismissing the couple’s suit because special considerations counseled against allowing them to pursue monetary damages against Vice President Cheney, Scooter Libby, Karl Rove and Richard Armitage.</p>
<p>First, Bates concluded that the couple could not sue for the disclosure of Plame’s identity because it appeared Congress had not intended that federal employees in Plame’s situation could recover damages against the federal government or its officials.  Second, Bates dismissed the lawsuit because allowing it to proceed would likely cause “judicial intrusion into matters of national security” – matters which the Executive branch of the federal government has unique authority over.  Finally, Bates noted that the couple had not filed the required administrative claim before coming to court. <p>The couple was seeking monetary damages because of the disclosure of Plame’s identity as a covert CIA operative.  They have alleged that Plame was outed by the Bush administration as a consequence of Wilson’s criticism of the White House’s justifications for going to war in Iraq.</p>
