Official: Justice Department plans to sue over Arizona law

(CNN) - Obama administration lawyers are planning to file a legal challenge to a controversial Arizona immigration law within a month, according to a senior administration official.

The Justice Department would not confirm the claim, saying only that "The Justice Department is continuing to review the law."

Federal government lawyers who have been working on the expected challenge for several weeks will most likely file their arguments in federal court in Phoenix in the days leading up to July 28, when the statute is scheduled to take effect, the official said.

This is not just an issue for immigration, it is an issue of blantant racism, and even those in agreement with the legislation know it.

Of course, the final call on whether they sue or not will be made by Democratic pollsters and political advisors. It's a legality thing, but in reality it's not, it is a political thing. Bottom line, the lawyer-in-chief needs votes and he doesn't have them right now. What can he do to get them?

The federal Gov't is in charge of immigration, not states. Whether they are doing a good job or not is a different story. This law is a clear violation of the 14th amendment. If Gov. Brewer were really wanting to curtail illegal immigratin, she'd go after the employers. Thanks to this unconstitutional law, should my Hispanic hubby or kids, all born in Arizona, decide to visit his side of the family, they will for certain get detained because of their strange, funny, foreign sound accent - it's Minnesotan! Ya, you betcha! Now, who wants some hot dish?

I'm glad they are going to contest it. I have read the bill and even though I know that most police are not racist, this law gives them too much power. I'm also afraid that if this law stands it won't be long before everyone will need to have their original birth certificates with them 24 hours every day and need to produce them anytime a police officer thinks you are committing any kind of crime, even though you aren't.

I'm sick of all the bullshit about President Obama. I don't think he's evil.
I'd like to know the race of those who are complaining the loudest about him.

This law could very well could be the start of turning our country into a Nazi like state!

GOOD! This law is racist and unconstitutional. Why are right-wingers - who always pretend to be fighting for the Constitution - always the first ones to shred it? They don't care about this country, only themselves and their paranoid and backwards and racist selves.

okay, new politico, what about the last Bush? He got us into a war under false pretenses and he didn't know his right hand from his left.

To LIf you want something ruined let a democratic community organizer handle it

Better get your original birth certificate and keep it on you at all times as a driver's license is not proof of citizenship.

    Racism is racism is racism.

This should be an easy win for the administration as this law is so obviously unconstitutional in so many ways. Way to go Obama administration, don't let these fools get away with blatant racism.

My oh my, what are you white bigots going to do when white people are not a majority any more?

Maybe the Latinos will pass a proposition that will let the cops inspect any "suspicious" white person, LOL, then you'll be crying

and President Lopez will say, "as I remember we got rid of that amendment a few years back..." "as I remember you got rid of it..." "oh well, papers please, if you have nothing to hide than you shouldn't have a problem with that, right?"

Good! I'm glad we finally have a President who is willing to stand up for what is right even if it means he'll take some heat for it. It's called integrity and it's sadly lacking in many!

Challenge the AZ law? My God, if he would enforce the federal law (which, by the way, the Arizona law is the same), no other state would have to take matter into their hands. This is the most incompetant government I've ever witnessed. Even Bush's "Katrina" isn't as low as Obama's BP disaster. Holder doesn't like white people and the administration is just looking for hispanic votes because all reputable voters have turned on Obama. He is inept and a total embarassment.

Try living and driving in a city where ILLEGALS have almost taken over. Hope and pray they never hit your car – the police will do nothing. What part of Illegal does Washington not understand? If they want to come to America, become citizens, learn the language, learn to live without government assistance, work and pay taxes; that is good. It's just the illegal that messes up the whole deal.

This is the dumbest thing I have ever heard. Arizona's law supports federal law and includes the same wording. If Obama plans to sue Arizona, he better sue the federal government too. Or better yet, how about we all follow the laws of our nation!? This political correctness is ridiculous. Americans welcome all legal immigrants. It is the illegal immigrants that need to be addressed. They are costing too much and do not have US citizen rights!

So, Arizona, but I have grave doubts that a birth certificate will be enough to satisfy the birther movement fraction of the GOP on who is or isn't legally born in America.

My God! If you racists react to a black President this badly, what the hell are you going to do when we elect our first Hispanic President??? Hopefully you'll all leave my country and find an island somewhere where you can all inter-breed until you die out!

Pretty predictable. Our President won't do anything about protecting our borders but will sue the states that are being over run. Send us all the money to take care of all the social services they suck up or seal the border. Just do something. This is going to be standare fare for Obama as we can see where his inaction in Gulf has pummelled us too.

The supporters of this Arizona law do not know that the federal government has exclusive control over immigration. This has been the settled law for many years, meaning even the conservatives on the Supreme Court, who respect precedents, will not overturn federal control of immigration. The supporters do not know that their law, not the lawsuits challenging it, is doomed from the start, and they are being used by the drafters of the law, who want to create an election year issue. Do the supporters know Obama Administration actually deported more illegals in 2009 than in any year of the Bush Administration?

"No Passport, no Visa, no Permit, no entry to the USA, same rule is practiced in Germany, Spain, England, Turkey, Italy, Greece, Holland, Mexico, Costa Rica, Argentina, etc.....Why should the USA be different?"

This is the argument I hate because we pride the US as being a different country, the only truly free country in the world and then people say we need to be like them when it suits them...if this was 2004 and Arizona came up with this law, Bush would have stepped away from it too to try to get the Hispanic vote...its called politics its a game all politicians play including Jan Brewer and her gang. She has been in office since 2003 and just now decides to bring light to the fact illegal immigration is an issue. Ask yourselves why she never made it such a huge issue before.

screw the mexicans, they are the problem. its not americans streaming across the border with guns and drugs. You are not a american if you dont support this law

I'm an American, and I don't support it. I say look to see who's funding the BIG DRUGS streaming in on the backs of maybe Mexicans, maybe your lily-white children returning home from vacation, who knows? Drug smuggling is blind to skin color. All it sees is OUR demand for the product, and the color of MONEY.
