Federal appeals court blocks state lawsuit over health care reform law

Washington (CNN) - A federal appeals court has tossed out Virginia's lawsuit against the sweeping health care reform effort championed by President Barack Obama, after the three-judge panel concluded Thursday the state lacks the jurisdictional authority to challenge the 2010 law.

The unanimous decision sets up a certain Supreme Court review in coming months.

How could you come to any other conclusion, if you are sworn to uphold the Constitution? This shows that not all courts are bought and paid for by the Kochs.

I need to repeat it again. Why would insurers want to turn the chance to gain millions of new customers? They seem to like the personal mandate on auto insurance. It is because of the coverage mandates on insurers. It is because they can no longer drop people when the become ill.

The push against the Affordable Care Act is funded by the insurance industry. The industry cannot come out fight against that which they do not like. So, the altruistic argument has been put forth that personal mandates are unconstitutional in the hopes the *entire* law gets struck down, including the parts they don't like. Notice how all of the lawsuits against the ACA want to strike down the entire law, not just the personal mandate that they cite.

and off we go to the SCOTUS – where they've already said they will announce their ruling in Sept 2012 – i'm sure it has nothing to do with the POTUS election...

Of course they did! I mean, what's unconstitutional about making someone purchase something. Give me a break.

Now the employers will drone on about how expensive health care is as a reason not to hire people. "keep your hands off my healthcare. I can't afford health care". Ah, duh!!

@cali con – Obama cares! Unlike the Kochs, big oil, big corporations, and the health insurance industry. What would a Christian conservative like you have against affordable health care?

@ConservaFascist – Good point. We have not heard a lot from Cootchie Cuccinilli lately. It seems that all the cash strapped red state governors who wasted their tax payer money on this appeal, would send an apology to their voters.

Your're right Wire Palladin, some courts aren't bought and paid for by the Kochs, they're bought and paid for by Soros and his liberal lackeys.

Why is the teleprompter president and his amateur hour administration spending so much money to fight this? It’s not hard to believe that they don’t understand when the America people revolt against the Democrats / liberals in Congress, the 2010 election. Their health care plan is just another way for Obmam and the tax cheating appointee and Democrats in Congress (Timothy Geithner, Charles Rangel, John Kerry etc...) to get their hands in our pockets. Obama / DNC / Democratic Party in Congress are driving this nation into bankruptcy.

Obama, the Democrats in the house and the 23 Senators up for election in 2012 better understand their jobs are on the line, we just have to wait, they will be replaced.

Actually, it probably is mostly motivated by the part of the ACA that limits them to 20% overhead. Overhead = giant CEO salaries. If it's limited to 20%, well, they they might have to settle for silver toilets.

Really California Conserative, they will do anything to destroy this country, what like start a war without funding and keep the cost off the books? You mean like lie to the American people, attack a soverign nation, kill millions of people and on top of it, not have the funding to pay for it so they just kept it off the books? Oh you must mean, create a Medicare Modernization Act that only benefits Insurance and Pharmaceutical companies, again without funding it, so they just kept it of the the books? Oh, you must mean giving tax breaks to guys like me, who did not need it and expecting us people with money to trickle down some of our money to the rest of you, but instead we bouight bigger houses and bigger toys instead? Oh that's right that all happened under the Bush Administration. This country was already destroyed on 01/21/2009, the only thing that the POTUS can do is try to repair some of the damage that was done by the destructive previous administration. Adn for all you that hate the mandate, why have you not gone after your State Government for mandating you to have car insurance?

First of all you can't force someone to have health insurance and as far as upholding the Constitution Obama hasn't done that yet with his Health care Bill and will not enforce the laws we have on the books now because he thinks they are not right.

It's his job to uphold the laws of this country and not what he thinks is wrong.

I don't know why he hasn't been impeached yet Obama is not doing the job he took a oath to uphold.

Not hard to believe the ruling from the 4th Circuit since the judges were all appointed by Democratic presidents — including two nominated by President Barack Obama.

Not hard to believe the ruling didn’t focus on the merits of the law.
