Iowa rep will file lawsuit over immigration announcement

(CNN) – Firebrand Republican Rep. Steve King announced his intention Friday to file a lawsuit against President Barack Obama, calling unconstitutional the administration's plan to stop deporting some young, illegal immigrants who entered the U.S. as children.

"This is no longer a debate about immigration policy. The debate is now about the Constitution and the Rule of Law," the Iowa congressman said in a statement. "I am preparing to bring suit against the President and ask for a court to enjoin him from implementing his unconstitutional and unlawful policy."

Obama's plan would apply to people under age 30 who entered the country before the age of 16, pose no criminal or security threat, and were successful students or served in the military. They can apply for a two-year deferral from deportation and if accepted would then have the possibility of working legally, Homeland Security Secretary Janet Napolitano said Friday.

The president said the policy "is not amnesty" nor "immunity" or "a path to citizenship."

But King and other Republicans described it as a form of amnesty.

"Americans should be outraged that President Obama is planning to usurp the Constitutional authority of the United States Congress and grant amnesty by edict to 1 million illegal aliens," he said in an earlier statement. "There is no ambiguity in Congress about whether the DREAM Act's amnesty program should be the law of the land. It has been rejected by Congress, and yet President Obama has decided that he will move forward with it anyway. President Obama, an ex constitutional law professor, whose favorite word is audacity, is prepared to violate the principles of Constitutional Law that he taught."

    Pres. Ronald Reagan, a REPUBLICAN GAVE AMNESTY TO THE ILLEGAL IMMIGRANTS IN 1986 WHY CAN'T Pres. Obama do the same thing? REGARDLESS OF YOUR COLOR WHITE, BLACK, YELLOW, ETC. We all came from different parts of the world. We all should be thanking the NATIVE AMERICANS for allowing all of us into their country.

    Dear GOP:

    This is what happens when you say "No" to everything the President is trying to move the country FORWARD. You won't compromise on anything for the mere purpose of saying that the President is not getting anything accomplished. If he does manage to accomplish anything despite your machinations in Congress and your "do nothing" hard line, you then go to the courts to have it overturned. Mind you, this is the same GOP that has been whining about the "activist courts" for literally decades.

    What exactly did you expect the President to do when you won't compromise? You literally have left him no choice but to try to get something accomplished without your input or approval. You wouldn't need the so called "activist courts" to do your job in Congress if you would stop trying to govern with one hand tied behind your back by signing away your governing rights to people like Grover Norquist and start doing your jobs to help the American people.

    I'm not in favori of Obama granting amnesty to a select group of illegal immigrants, although I would like to see a solution, which would also address the issue of improving immigrattion policy for legal, skilled immigrants. Still I would like to know if Obama's executive order is unconstitutional? And like Rep. King, I think Congress needs to get involved. Unfortunately, it's in recess now, but that shouldn't stop them from doing something, since they seem to accomplish so little while in official session. My two cents.

You think President Obama (constitutional law expert) and his extensive team of constitutional lawyers haven't played this out??? Just makes you and the slobbering GOP faithful look even more pathetic than you have looked for the past three and a half years! You can't stand it when the President does anything positive for the country. You can't stand it that the President has the ability to do an end-run on the obstructionism that has forced his hand.

    King simply shows us once again how ignorant our current Congressional Representatives are when it comes to Constitutional Law, separation of powers and the descretion confered on the Executive Branch and prosecutors in genaral ... Perhaps if they took a refresher course in K-12 civics they might keep their noses out of the business of the Rxecutive and Judicial branches and finally start taking care of the Legislature's business that they have been neglecting while still drawing paychecks they have never earned.
